Department of Justice and U.S. Army Facilities Most Japanese Americans interned during World War II were held in facilities run by the War Relocation Authority (WRA) and Wartime Civilian Control Agency (WCCA) described in previous chapters. However, other facilities were also used to imprison Japanese Americans during the war. In all, over 7,000 Japanese Americans and Japanese from Latin America were held in internment camps run by the Department of Justice and the U.S. Army. Eight of these facilities were visited for this project. After the attack on Pearl Harbor and prior to Executive Order 9066 on February 19, 1942, about 4,000 individuals from all over the U.S. were detained by the FBI. Over half of these were Japanese immigrants who were long-term U.S. residents denied U.S. citizenship by discriminatory laws. These Issei, now classified as "enemy aliens," were first sent to temporary detention stations, then transferred to locations known generally as "Justice Department Camps." The camps were run by the Immigration and Naturalization Service, part of the Department of Justice. After hearings, most of the Issei were then sent to U.S. Army internment camps where they remained through May 1943. After that time the internees were returned to Department of Justice control for the duration of the war.

The Department of Criminal Justice Training (DOCJT) is a nationally ranked public safety and law enforcement agency that provides law enforcement officers in Kentucky with state-of-the-art training. It is one of four departments in the Kentucky Justice and Public Safety Cabinet.
The DOCJT provides entry-level and professional development training for approximately 11,000 students each year, including city and county police officers, law enforcement telecommunicators, all coroners, sheriffs, deputy sheriffs and university police. It also offers training to officers from several other state and federal agencies.
The primary mission of the Department of Criminal Justice Training is to provide quality training and improvements to the criminal justice system to advance the delivery of law enforcement services in Kentucky.

Phil Carter on Torture Phil Carter argues cogently that a system that extracts information by torture is a system that will obtain few convictions in court.
There is, I think, a touch of credulity to Phil's piece namely, his willingness to take seriously the premise that the administration is interested in bringing top al Qaeda people to justice (as opposed to just killing them).

Judicial Muscle I always tell my Constitutional Law students that an impeached and convicted President's legal challenge to the validity of his impeachment and conviction is the paradigm of the case that no court would dream of touching. That's just what the justiciability principle called the " political question doctrine " is for, I tell them. What court, I ask them, would dream of trying to pull off the trick of reinstating an impeached and convicted executive?

Image: Artville US Justice Department investigators want to know how academic scientists spend their time and the government's money. The department is making quiet inquiries at research institutions to determine how they've used their federal funding. Research executives would not say which schools the Department of Justice (DOJ) has approached, and department officials refuse to comment, as is their policy with matters under investigation. The inquiries could go nowhere, or they could herald a return to past cycles of scrutiny by the department, which has enforcement powers anywhere federal dollars are spent. "I don't really know what it is that they're after," says Robert Killoren, incoming president of the National Council of University Research Administrators (NCURA). "It's such a pity. When we talk about accountability for the way our federal funds are spent, we shouldn't be dealing with accountants necessarily. We should be dealing with people who understand scientific research." ON ALERT The DOJ can target any aspect of researchinvestigator time, goods, and materials and indirect costsif it believes the intent to do wrong is present, says James Sheehan, chief of the civil division for the US Attorney's office in Philadelphia. Willful blindness, where universities shield themselves from seeing their star scientists' wrongdoing, also counts. "What we prosecute is lies, intentional false statements," he says.

More Power to Wiretap Citizens
The U.S. Foreign Intelligence Surveillance Court of Review issued its first opinion ever on November 18, 2002, granting the Justice Department new powers to use wiretaps in criminal cases. The Court of Review reversed an earlier decision by the Foreign Intelligence Surveillance Court, which had limited those powers out of concern for citizens’ privacy.
The Foreign Intelligence Surveillance Court (FISC) and Court of Review were established in 1978 by the Foreign Intelligence Surveillance Act (FISA) . The purpose of the FISC was to authorize electronic surveillance requests in foreign intelligence investigations. The government, represented by the Attorney General , had to seek the FISC’s approval before wiretapping. Permission was granted based on a finding of probable cause that the surveillance target was an agent of a foreign power. The determination was made regardless of whether the target was suspected of criminal activity. Information obtained under FISA rules could not be shared with criminal investigators or prosecutors unless the Justice Department sought special permission.
After September 11, 2001, the wall between criminal investigations and intelligence gathering was faulted as outdated and dangerous. The FBI and the CIA were accused of failing to share information in a way that might have prevented a terrorist group from carrying out an attack in the United States. In the

Harlan, Distinguished Professor of History, University of Maryland, College Park One of the most striking features of the economy of the South in the early 20th century was the extent to which its farms, plantations, mines, and mills availed themselves of a system of forced labor known as "peonage." This system developed from the practice of holding laborers in debt and forcing them to remain on the premises of their creditors to work off the debt. Peon laborers were thus bound to their masters’ firms or plantations, often by means of violence and intimidation. Because the overwhelming majority of peon laborers were black, the system served to entrench racial as well as class divisions throughout the South. In many respects, peonage served as a holdover of the antebellum slave labor system.
