    THE JUDICIAL BRANCH: INTERPRETING THE CONSTITUTION "... the judiciary is the safeguard of our liberty and of our property under the Constitution." The third branch of the federal government, the judiciary, consists of a system of courts spread throughout the country, headed by the Supreme Court of the United States. A system of state courts existed before the Constitution was drafted. There was considerable controversy among the delegates to the Constitutional Convention as to whether a federal court system was needed, and whether it should supplant the state courts. As in other matters under debate, the delegates reached a compromise in which the state courts continued their jurisdiction while the Constitution mandated a federal judiciary with limited power. Article III of the Constitution states the basis for the federal court system: "The judicial power of the United States shall be vested in one Supreme Court, and such inferior courts as the Congress may from time to time ordain and establish." THE FEDERAL COURT SYSTEM With this guide, the first Congress divided the nation into districts and created federal courts for each district. From that beginning has evolved the present structure: the Supreme Court, 13 courts of appeals, 94 district courts, and two courts of special jurisdiction. Congress today retains the power to create and abolish federal courts, as well as to determine the number of judges in the federal judiciary system. It cannot, however, abolish the Supreme Court.

    Pocahontas County Courthouse The first county seat of Pocahontas County was located at Old Rolfe. A brick building with a stone foundation served as both the courthouse and schoolhouse. The bricks were made from local clay and all of the timber was either oak, elm, or walnut. The county seat was moved from Old Rolfe to Pocahontas in 1875. The old courthouse was sold for $200 and a new one was built for $2,600. The present courthouse, which was built in 1923, is a neatly constructed building of classical Greco-Roman design.     Child Support Guidelines
    The supreme court has undertaken to prescribe uniform child support guidelines and criteria pursuant to the federal Family Support Act of 1988, Pub. L. No. 100-485 and Iowa Code section 598.21(4). The following child support guidelines are hereby adopted, effective August 1, 2000. The guidelines shall apply to cases pending on August 1, 2000. The following charts are established as guidelines for use by the courts of this state in determining the amount of child support. The charts are applicable to modification of child support orders as provided in Iowa Code section 598.21(9). The purpose of the guidelines is to provide for the best interests of the children by recognizing the duty of both parents to provide adequate support for their children in proportion to their respective incomes. While the guidelines cannot take into account the specific facts of individual cases, they will normally provide reasonable support. In ordering child support, the court should determine the amount of support specified by the guidelines. There shall be a rebuttable presumption that the amount of child support which would result from the application of the guidelines prescribed by the supreme court is the correct amount of child support to be awarded. That amount may be adjusted upward or downward, however, if the court finds such adjustment necessary to provide for the needs of the children and to do justice between the parties under the special circumstances of the case.
