    (b. Dec. 29, 1808, Raleigh, N.C., U.S.d. July 31, 1875, near Carter Station, Tenn.), 17th president of the United States (1865-69), who took office upon the assassination of President Abraham Lincoln during the closing months of the American Civil War (1861-65). His lenient Reconstruction policies toward the South embittered the Radical Republicans in Congress and led to his political downfall. Johnson's lack of formal schooling and his homespun quality were distinct assets in building a political base in eastern Tennessee, where his family moved in 1826. Before he was 21 he organized a workingman's party that elected him first alderman and then mayor of Greeneville. During his eight years in the legislature (1835-43), he found a natural home in the states' rights Democratic Party of Andrew Jackson and emerged as the raucous spokesman for mountaineers and small farmers. He went to Congress for 10 years as their representative (1843-53), after which he served as governor of Tennessee (1853-57). Elected a U.S. senator in 1856, he generally adhered to the dominant Democratic views favouring lower tariffs and opposing antislavery agitation. In 1860, however, he broke dramatically with the party when, after Lincoln's election, he vehemently opposed Southern secession. When Tennessee seceded in June 1861, he alone among the Southern senators remained at his post and refused to join the Confederacy. Although denounced by his constituents, he remained loyal to the Union. In recognition of this unwavering support, Lincoln appointed him (May 1862) military governor of Tennessee, by then under Federal control.

    The Senate Votes on a Presidential Impeachment On May 16, 1868, the Senate voted 35 to 19 to remove President Andrew Johnson from office one vote short of the necessary two-thirds. For many of these fifty-four senators, this was unquestionably the single most difficult vote of their congressional careers. Seven Republican senators William Pitt Fessenden, James Grimes, Edmund Ross, Peter Van Winkle, John B. Henderson, Joseph Fowler, and Lyman Trumbull courageously defied their party's leadership and voted with the twelve Democratic senators to acquit the president thereby saving him and, possibly, the institution of the presidency. Johnson's impeachment is a complex story, but one important issue related to a vital Senate prerogative the confirmation of presidential nominations. In the eight decades since the 1787 framing of the Constitution, the question had repeatedly arisen, "If the Senate is responsible for confirming appointees, does it also have a role in removing them?" In 1867, as President Johnson's relations with Congress rapidly deteriorated, the Senate and House passed the Tenure of Office Act over his veto. That act required officeholders confirmed by the Senate to remain in place until the Senate approved their successors. When Johnson subsequently defied Congress by firing Secretary of War Edwin Stanton, the House of Representatives impeached the president for violating the Tenure of Office Act.

    A casual reading of the history of impeachment by the Congress might lead one to believe its use, contrary to its clear purpose, "had sunk in this country to the ouster of dreary little judges for squalid misconduct." It has been our good fortune not to have been confronted with the tyrannies of our own Kings and their attendants and forced to struggle for freedom from their despotism. Still the existence of the impeachment power in the Constitution has been present and raised publicly, often prominently, during the administration of every American president. In 1974, to aid the House of Representatives Committee on the Judiciary in its consideration of possible grounds for the impeachment of President Nixon, C. Vann Woodward, distinguished professor of history at Yale University, serving as Editor and Director, with the assistance of fourteen prominent historians, compiled a 398 page "Authoritative History of Accusations of High Crimes and Misdemeanors from George Washington to Lyndon Johnson." Charges of misconduct and threats of impeachment against the President, or his civil officers are found in every Presidential administration. Most often the charges have involved corruption which was present in many and prominent in the administrations of Presidents Tyler, Buchanan, Grant and Harding. Sometimes they have involved personal misconduct. Some charges reflect "politics as usual" and are an abuse of the impeachment power itself seeking political advantage. But on many occasions the charges have claimed usurpation of power not delegated to the President, abuse of delegated Presidential power and serious criminal conduct destructive of constitutional government and the rule of law.
