On Thursday, Amnesty International said the barrier, which Israel refers to as a "fence," "is contributing to grave human rights violations" against Palestinian residents living within the West Bank. "Any measure Israel undertakes in the Occupied Territories in the name of security must comply with its obligations under international law," the London-based group argued. The Amnesty statement followed closely on the publication by the International Committee of the Red Cross (ICRC) of a statement calling on Israel "not to plan, construct or maintain this Barrier within occupied territory." "Where it deviates from the 'Green Line' into occupied territory, the Barrier deprives thousands of Palestinian residents of adequate access to basic services such as water, health care and education, as well as sources of income such as agriculture and other forms of employment," the Geneva-based agency said, adding that to the extent the wall deviates into occupied territory, it violates international humanitarian law (IHL).

A CONTRADICTION OF INTERNATIONAL LAW?

This obligation derives from a long-standing principle known as Nullum crimen sine poena, "No crime without a punishment." It is codified directly in many different sources, and is also deducible from the binding Nuremberg Principles. According to Principle 1: "Any person who commits an act which constitutes a crime under international law is responsible therefore and liable to punishment." it follows that the State of Israel, now in the process of releasing large numbers of convicted terrorists, is acting in clear violation of international law. Perhaps the best way to understand the profound illegality of Israel's terrorist release policy - a policy that flies in the face of all civilized respect for law - is simply to recall the specific account of PLO terrorism found in the Tel-Oren decision. In the words of Judge Edwards: "On March 11, 1978, thirteen heavily armed members of the Palestine Liberation Organization...turned a day trip into a nightmare for 121 civilian men, women and children. the PLO terrorists landed by boat in Israel and set out on a barbaric rampage along the main highway between Haifa and Tel-Aviv. They seized a civilian bus, a taxi, a passenger car, and later a second civilian bus. They took the passengers hostage. They tortured them, short them, wounded them and murdered them. Before the Israeli police could stop the massacre, 22 adults and 12 children were killed, and 73 adults and 14 children were seriously wounded..."

Once again, Palestinian terrorists who killed Israelis may be released in the cause of "peace." From the political standpoint, especially as a quid pro quo for presumed Palestine Authority (PA) concessions to Oslo/Wye River and for certain U.S. guarantees, it would appear that such release may yet take place. Yet, as a matter of law, such action would represent a very substantial and ominous wrongdoing by the State of Israel. August 2003 TOP In August 2003, the International Federation for Human Rights (FIDH) and its affiliate and partner organizations in Israel, ACRI – The Association for Civil Rights in Israel, Adalah – The Legal Center for Arab Minority Rights in Israel, B’Tselem – The Israeli Information Center for Human Rights in the Occupied Territories, HaMoked, and the Mosawa Center - the Advocacy Center for Arab Palestinian Citizens of Israel, requested that the UN Committee on the Elimination of Racial Discrimination (CERD) consider the new law, “Nationality and Entry into Israel Law (Temporary Order) – 2003,” adopted on 31 July 2003, for an urgent procedure. The human rights organizations asked the UN CERD Committee to declare the new law in grave violation of the International Convention on the Elimination of all Forms of Racial Discrimination (ICERD), and to urge Israel to revoke it as well as to reconsider the current family unification policy. In its 14 August 2003 decision, the UN CERD Committee called upon Israel "to revoke this law, and reconsider its policy with a view to facilitating family unification on a non-discriminatory basis."

The ICJ was founded in Berlin in 1952 and is now based in Geneva. Its activities include inquiry commissions, trial observations, fact-finding missions, public denunciations and "quiet diplomacy." The Commission functions as a network with a well-defined structure. The International Secretariat is responsible for decision-making and is assisted by a network of 97 autonomous national sections and affiliated organizations located in some 70 countries. The Ibn Rushd Fund for Freedom of Thought awards its prize this year to Dr. Azmi Bishara, an Arab member of the Israeli Knesset. The prize, awarded for special contributions to freedom of speech and democracy in the Arab World, will be presented on Saturday 14th December 2002 in the German capital Berlin.
The Ibn-Rushd Fund, named after the philosopher Ibn Rushd (1126-1198, a.k.a. Averroes), supports freedom of speech and democracy in the Arab World by awarding this prize. The thematic focus varies annually: so far, people from the fields of journalism, women's rights and humanities were honoured. This year, the prize will be awarded to an Arab personality who has shown special commitment to promoting democracy as a member of parliament.
An independent jury elected Dr. Azmi Bishara . The Palestinian intellectual, born in Nazareth in 1956, is an Israeli citizen. Since 1996, he has been a member of the Knesset. Bishara started to be engaged in political activities already as a high school student; as a university student, he co-founded the Union of Arab Students, the first political organisation of this kind in Israel. From 1980 to 1985, he studied Philosophy and Political Science at the Humboldt-University in Berlin In Ramallah, West Bank, he co-founded the Institute for Democracy and was involved in publishing many important studies in the field of research on democracy. From 1986 to 1996 held a chair for Cultural Sciences, Philosophy and Political Theory at Bir Zeit University near Ramallah, West Bank.. Furthermore, he did research at the Van Leer-Institute in Jerusalem from 1990 to 1996.
