Israel's Association for Civil Rights demands end to military violence against civilians Here is a letter from Vered Levne, executive director of the Association for Civil Rights in Israel, that was sent on April 7 to the Israeli Defense Minister Benjamin Ben-Eliezer. ACRI is Israel's largest and leading civil rights organization, the only such organization representing the entire country and all citizens. It is particularly important, working as it does in a country with no constitution. Levne's letter was made available by Ronin Shamir, associate professor of sociology at Tel Aviv University (author of Managing Legal Uncertainty: Elite Lawyers in the New Deal Duke, 1995, and The Colonies of Law: Colonialism, Zionism, and Law in Early Mandate Palestine, Cambridge UP, 2000). In his note to colleagues in the United States, Shamir wrote:
Dear Friends: Attached please find an urgent letter sent yesterday by the Association for Civil Rights in Israel to the Israeli Defense Ministry. In it, this respectable and highly reputable association indicates that Israel commits what cannot be understood but as serious war crimes against the Palestinian civil population. The European Union has condemned the destruction in Rafah by the Israeli Occupation Army. The United Nations Security Council has adopted a resolution condemning the killing of Palestinian civilians in Rafah and calling on Israel to stop the demolition of Palestinian homes. Amnesty International and other international human rights agencies have recognized that Israel is guilty of war crimes and grave breaches of humanitarian law, international human rights law and the Fourth Geneva Convention.
We, as Palestinians, commend the international community for their condemnation of Israel's atrocities against the people of Rafah. But we also wish to remind you that since 1948 our history has been replete with international condemnations and Security Council resolutions and yet we are still vulnerable and our path to justice is still long. The international community continues to fail us after 56 years of dispossession and violence against the Palestinian people because no punitive action against Israel has ever been taken.

1948: The Origins of the Israeli-Palestinian Conflict
  • As in Ireland, India and Cyprus, British colonial "divide and rule" tactics culminated in November 1947 in the partition of Palestine into two newly independent states one Palestinian Arab and one Jewish. UN Resolution 181 allotted Jews, who were less than one-third of the population and owned only 8% of the land, 56% of the territory of Palestine. Palestinians saw the partition plan as a grave injustice, especially since most Jews in Palestine were recent arrivals. Fighting broke out between Jewish forces and local Palestinian militias. In May 1948, the British evacuated Palestine, and Israel declared independence. Several adjacent Arab countries declared war against the new state. During the war, Israeli forces destroyed over 500 Palestinian villages and captured 78% of historic Palestine.

DEFENCE FOR CHILDREN INTERNATIONAL-ISRAEL SECTION (DCI-ISRAEL/AVI)
DCI Israel was founded in November 1987 at the initiative of Dr.Philip Veerman by a group of Arab and Jewish educators,psychologists, lawyers and social workers to promote and protect the rights of the child of children in Israel and under the effective control of the State of Israel in the occupied territories. The International Association for Children's Rights (AVI) as the Hebrew name of this NGO reads,became the Israeli Section of DCI (Defence for Children International) an International NGO for the rights of the child,headquartered in Geneva,Switzerland.
The first years DCI worked for family reunification of Ethiopian Jewish children and promotion of legal representation of minors in the juvenile and district courts.In 1988 it started to represent Palestinian minors in the Jerusalem district court and juvenile courts,who did not have lawyers.
DCI-Israel soon began to represent minors in the Tel Aviv and Haifa courts and came with a lawproposal to create a public defender for children.This helped to chance the climate in which legal aid and legal representation for young people became more acceptable.
In 1995 DCI-Israel received the Prize for Quality of Life of the Chairman of the Knesset (Israeli Parliament) for its pioneering work in legal aid and representation.

In the media and in interviews with Palestinian leaders, we often hear and read statements asserting that the Palestinian Refugees have a right to return to Israel. As will be shown, these statements are based on an erroneous reading of the relevant texts. We will discuss the subject from three points of view: general international law, the most relevant UN resolutions, and various agreements between Israel and her neighbors. 1. General International Law Several international human rights treaties deal with the freedom of movement, including the right of return. The most universal provision is included in the 1966 International Covenant on Civil and Political Rights, which says: "No one shall be arbitrarily deprived of the right to enter his own country." The question arises, who has the right of return, or: what kind of relationship must exist between the State and the person who wishes to return? A comparison of the various texts and a look at the discussions which took place before the adoption of these texts lead to the conclusion that the right of return is probably reserved for nationals of the State. Even the right of nationals is not an absolute one, but it may be limited on condition that the reasons for the denial or limitation are not arbitrary.

For Immediate Release A Call Issued by Palestinian Civil Society Organizations, August 2002 In September 2001, one year after all international efforts at halting Israel’s violent military repression of the second Palestinian uprising in the occupied West Bank and Gaza Strip had failed, some 3,000 civil society organizations from around the world met at the third World Conference Against Racism in Durban, South Africa and approved their NGO Declaration and Program of Action. These NGO documents address racism and racial discrimination related to the root causes of the Israeli-Palestinian conflict, including military occupation and the denial of the right of return of Palestinian refugees and internally displaced persons to their homes and properties. Already in Durban, representatives of 3000 civil society organizations from around the world were united in their call for global boycott and sanctions against Israel. In a resounding response, more than 1,250 organizations, networks, coalitions, grassroots activists, community leaders, and intellectuals from across the world have joined in few days the “International Response” to the declaration made by President George W. Bush supporting the policies of Ariel Sharon.
The Palestinian Right to Return movement in its entirety and organizations representing Palestinian refugees and those exiled took the lead in standing firm and unified in their collective demand to exercise the inalienable right to return. Grassroots activists from all walks of life joined with influential intellectuals and organizations from across the glob to echo the very same demand.
On May 15, 2004, this response and signatories will be sent to all members of the United Nations General Assembly and other relevant parties.

Israeli-Palestinian-International Civil Society Partnership A meeting organized at the Foreign and Commonwealth office, March 22-24 2002 Main Conclusions A Civil Society Partnership The participants (hereafter known as the London group) want to contribute to building an Israel-Palestine civil society movement or partnership. This movement will include the different communities in the region and abroad: Palestinians in Israel, Palestine and elsewhere; Jewish communities in different parts of the world; and people of all sorts who want to be part of the movement. The goal of the movement is to end the violence and to build trust among individuals and communities in the region. Even if a peace agreement is reached by the politicians, it cannot be implemented if there is no trust. And if civil society succeeds in beginning to build trust, then politicians will be forced to reach an agreement. The movement is based on equality and mutual solidarity. In the past, Israeli and international peace movements have tended to be one-sided; movements, which expressed solidarity with Palestinians. Today, Israelis need Palestinian help in ending the suicide bombers; just as Palestinians need Israeli help in ending the occupation. International civil society needs the help of both Israelis and Palestinians in ending terrorism and the war on terrorism.

SUSTAIN (Stop US Tax-funded Aid to Israel Now) Individuals Al-Arian, Dr. Sami Arraf, Huwaida Shapiro, Adam The Al-Awda - Right of Return Coalition , an international grassroots organization, argues that Palestinian refugees have the right to return "to their original homes and villages" and should be paid restitution. Al-Awda has organized large protests with the International Action Center and its anti-war affiliate, ANSWER. Al-Awda is also active in several anti-Israel boycott campaigns. The American-Arab Anti-Discrimination Committee was founded in 1980 and describes itself as a "civil rights organization committed to defending the rights of people of Arab descent and promoting their rich cultural heritage." ADC lobbies the U.S. government for "a balanced U.S. foreign policy in the Middle East." The American Muslim Council seeks to empower American Muslims politically and advocates on issues of concern to the Muslim community. It describes itself as active in civil rights issues like anti-Muslim hate crime and the safeguarding of civil liberties. AMC is strongly anti-Israel, and its leaders have expressed support of anti-Israel terrorist organizations Hamas and Hizballah.
