Israel and
the Occupied Territories Human Rights in Palestine
Human Rights abuses are rampant in Israel. Until recently, torture was legal and the security forces routinely tortured political detainees, most of whom were never charged with any crimes. Methods include violent shaking of detainees, restraining in very painful conditions, sensory deprivation, sounding of loud music for prolonged periods and others. Several prisoners have died as a consequence of torture. It's hoped that a recent Supreme Court decision outlawing this practice, however, will finally put an end to this widely condemned practice. Israeli forces continue to arbitrarily detained hundreds of Palestinians on "security" grounds. Hundreds are put under administrative detention, without being charged or sentenced, in violation of internationally protected due process rights. Some are kept in prison for years without ever being charged. Hundreds more are sent to prison for political reasons following trials that do not comply with international due process standards. Often the main evidence against prisoners are confessions extracted through torture. Detainees are regularly denied visits from their lawyers or family members. Dozens of Lebanese are also being held in administrative detention in Israeli-controlled Southern Lebanon. This includes men, women and children. Liberties Law Fellowship. back to top Wielding influence over civil rights in Israel By SHAUNNA BENNETT Among those gathered in the Chagall Room of the Knesset Building in Jerusalem as 1999 drew to a close were some of the mightiest figures in the Israeli justice system. There to celebrate the inauguration of the International Symposium of Jurists on Human and Civil Rights, they were concurrently honoring the 15th anniversary of the influential New Israel Fund's Civil Liberties Law Fellowship Program of AU's Washington College of Law (WCL). The program, founded by AU professor Herman Schwartz, has pioneered civil rights law in a country where the very concept is still in its infancy.
The influence of the fellowship program extends beyond the halls of the Knesset into many aspects of Israeli life. Its 38 graduates, who constitute much of the civil liberties bar in Israel, are everywhere, advocating for the disenfranchised: women, gay people, older people, people with disabilities, and children.
In a country where everyone is subject to a different set of laws according to religion, where there are ten separate tribunals just for Christians and no constitutional law that applies to all, it is no wonder there are so many U.S.-trained lawyers finding civil rights advocacy work. Says Kaufman, when different legal codes apply to those of different faiths, "This violates the civil rights of people."

Beginning with the declaration of the state of Israel in 1948, for more than 55 years the conflict has cost thousands of lives, involved neighboring countries in major wars, and unsettled the politics of the entire region. Palestinians and Israelis, the United States, and most of the world want the conflict to end. Given the almost universal desire for peace, Global Exchange believes that understanding the obstacles to peace is crucial, and that it is our role as a human rights organization to call attention to dimensions of this conflict that have been historically neglected in the United States. This is especially important because so many Americans want the United States to play a constructive role in ending it. Some of the obstacles that stand in the way of peace have received much attention in this country. Suicide bombings directed against Israeli civilians have been massively condemned, and the Palestinian leadership subjected to relentless diplomatic, economic and military pressure from both Israel and the U.S. to find and arrest the bombers. Global Exchange condemns violence directed against civilians, and we mourn the deaths of all innocents—Israelis who have been the victims of bombings, and the much larger number of Palestinian civilians killed by the Israeli military and by settlers. Israel receives more U.S. foreign aid on a regular basis than any other country. Global Exchange believes that U.S. citizens need to be fully apprised of the situation in the territories that Israel controls, and that when they are, they will insist that aid be reduced until Israel abides by international law and agreements to which it has been a party. The United States cannot act as "broker" of a peace settlement when it so clearly favors Israel despite evidence of Israeli obstructionism.

WHEN THE International Court of Justice at The Hague meets on Monday about Israel's "security fence" in the West Bank, it should find that the wall constitutes a violation of both fundamental human rights and international law. The fundamental issue lies between "military necessity" and "proportionality." Israel certainly has an obligation to protect its citizens from violent attacks, but it also has a responsibility to protect the safety, well-being, and rights of the Palestinian civilian population under its control. The wall's route, extending deep into Palestinian territory, has the look of a political border, not a security barrier. Rather than a linear defensive barrier bordering the West Bank, the wall is a complex matrix that literally imprisons thousands of Palestinians in enclaves encircled by 24-foot high walls, electronic fences, and watchtowers manned by armed Israeli soldiers. In a brief presented to the International Court, the Association of Civil Rights in Israel argues that the wall's route and its other mechanisms of control are not necessary, proportionate, or legitimate security measures.

The International Covenant on Civil and Political Rights (16 December 1966)
The right to return is most clearly enshrined in the 1966 International Covenant on Civil and Political Rights (ICCPR) under its provisions on the right to freedom of movement (Article 12). Freedom of movement has two main components: an internal aspect, relating to freedom of movement within a country (Article 12 (1)); and an external aspect comprising freedom of movement between States. The latter includes the right to leave one's country (Article 12 (2)), and the right to enter one's "own country" (Article 12 (4)). Article 12 of the ICCPR states:
  • Everyone lawfully within the territory of a State shall, within that territory, have the right to liberty of movement and freedom to choose his residence.
  • Everyone shall be free to leave any country, including his own.
  • The above-mentioned rights shall not be subject to any restrictions except those which are provided by law, are necessary to protect national security, public order (ordre public), public health or morals or the rights and freedoms of others, and are consistent with the other rights recognized in the present Covenant.
  • No one shall be arbitrarily deprived of the right to enter his own country.

    Human Rights Watch has long defended the right of refugees and exiles to return to their homes. We have upheld this right both when international borders were settled - Guatemala, El Salvador, Honduras, Malawi, Burma, Mauritania - and when they were in dispute - Bosnia, Croatia, Kosovo, East Timor, Ethiopia/Eritrea. Human Rights Watch similarly urges that this right be recognized for all displaced people in the Middle East, regardless of religion or nationality. In the case of the Middle East peace agreement currently being negotiated, the agreement should recognize this right for Palestinian refugees and exiles from territory located in what is now Israel or in what is likely to be a future state of Palestine. Recognition should accord with the following principles: The right is held not only by those who fled a territory initially but also by their descendants, so long as they have maintained appropriate links with the relevant territory. The right persists even when sovereignty over the territory is contested or has changed hands. If a former home no longer exists or is occupied by an innocent third party, return should be permitted to the vicinity of the former home. As in the case of all displaced people, those unable to return to a former home because it is occupied or has been destroyed, or those who have lost property, are entitled to compensation. However, compensation is not a substitute for the

    Rights Under Israeli Occupation and the Palestinian Authority
    Palestinians living in the territories occupied by Israel have lived under military occupation with severe restrictions on their access to jobs, land and public services. In addition they have been victims of human rights and humanitarian law violations. In July 1998 Israel presented its initial report to the United Nations Human Rights Committee, the U.N. body of independent experts responsible for monitoring implementation of the International Covenant on Civil and Political Rights (ICCPR) and its two Optional Protocols. It was the first time that Israel had reported on the full range of civil and political rights guaranteed under international law. In its "Concluding Observations" on Israel's report the Human Rights Committee acknowledged Israel's security concerns, but identified twenty-one areas of concern, in some cases recommending specific steps to end the violations. In particular the Committee expressed concern over Israeli interrogation practices, urging Israel to cease using methods of handcuffing in painful positions, hooding, violent shaking and sleep deprivation that are believed to be authorized in Israel's confidential Landau Commission interrogation guidelines; the use of administrative detention; the use of prolonged solitary confinement; discrimination against Palestinians living in the Occupied Territories, in particular in regard to planning and building permits and access to land and water; the Israeli security forces "use of firearms and rubber-coated metal bullets in dispersing demonstrations - resulting in many deaths, including of children; restrictions on Palestinians" freedom of movement, and on residency in East Jerusalem; and the practice of demolishing Arab homes as a means of punishment or because they were "illegally" constructed.

    [April 4, 2002] Unarmed Palestinian and Israeli children, women, and men are dying in great numbers. Violations of medical neutrality are occurring on almost a daily basis. The killing and targeting of unarmed civilians are atrocities and violations of human rights whether committed in war, occupation, or peace. This intensifying crisis requires that physicians and other health professionals of integrity in the region and throughout the world join to defend and uphold health and human rights in Israel, Gaza and the West Bank. The Israeli, Palestinian, and international medical communities should demand that the Israeli Defense Forces cease shelling and firing upon non-combatants, denying them access to food, water and essential supplies and assaulting medical facilities, personnel and transport all protected under international humanitarian law. They should proclaim loudly that suicide bombings against Israeli civilians come to an end. They should make demands of the international community to take affirmative steps toward protecting the rights of Palestinians within their own state and of Israelis to live within secure borders.
