Genocide is not a political crimes but it is a usually deliberate crime even if it’s committing by a political motivation. Genocide is an International Crime. South of Iraq ( Previous Picture) H istorical development this crime goes back to time of Babylon and it was committed in the First World War by Germans who used the poisonous gasses in France and during the Second World War too in 1939-1945. Kurds inside Kurdistan and other places of Iraq has also suffered from this crime and what the Faily Kurds has been exposed to emigration, disappearing and execution out of judiciary girdle. The same crimes have been committed against Shiaa in central and south Iraq before and after uprising 1991. Iraqi workers find themselves in exceptionally difficult circumstances. On top of the war, bombing and carnage, the massive unemployment and months of unpaid wages have brought them much hardship and distress. Their protests for jobs, unemployment benefit and basic rights have come under attack by the US forces. After 35 years of repression under the Baathist regime, they are faced with new repression and new repressors.
The Union of the Unemployed in Iraq is one of the first attempts of Iraqi workers to organise themselves to defend their rights and livelihood. With over 100,000 members, it is a strong voice for welfare and freedom in Iraq today. For the past six months, it has been waging a vigorous fight for jobs and unemployment benefit for the millions of Iraqis made unemployed as a result of the war. It deserves the wholehearted support of the international labour movement.
The USA is the natural ally of the upstart bourgeois and reactionaries in Iraq. Their representatives have already taken their seats on the handpicked Iraqi Governing Council - an oppressive and reactionary assembly of religious mafia, political charlatans, despots and misogynists, ethnic and tribal chiefs and criminal bandits.

WHEREAS: The ostensible purpose of the U.S. military invasion of Iraq was to eliminate weapons of mass destruction, facilitate "regime change" by ending Saddam Hussein's brutal dictatorship and "liberate" the Iraqi people; and WHEREAS: The real purpose that war was waged by Bush was for control of Iraq's nationalized oil fields and to impose its influence in the Middle East; and WHEREAS: To realize those aims the U.S. is occupying Iraq and imposing its own military dictatorship while the Iraqi people have been angrily demonstrating in the streets demanding U.S. military withdrawal; and WHEREAS: This war cost $75 billion dollars while the U.S. economy is in shambles, leaving people jobless, homeless, without universal health care, and public school systems in major cities like Oakland bankrupt; and WHEREAS: Over a billion dollars is being cut from veterans' benefits as many who fought in the 1991 Gulf War are still suffering from debilitating diseases while hundreds of millions of dollars in contracts are being given to U.S. companies closely connected to the Bush Administration like Stevedoring Services of America to run the port of Umm Qasr and the San Francisco-based Bechtel Corporation to rebuild the infrastructure destroyed by U.S. bombs in Iraq; and

GENEVA, Switzerland, May 5 (UPI) U.N. human rights experts in Geneva Wednesday called on the leadership in Iraq to respect international human rights law and grant detainees access to courts. Leila Zerrougui, chairwoman of the U.N. Commission on Human Right's Working Group of Arbitrary Detention, expressed her "serious concern regarding the uncertainty of the legal status of many detainees currently subjected to interrogation in Iraq." Noting reports of torture of people in detention by U.S. and British military officers, she urged the U.S.-led Coalition Provisional Authority and the U.S.-appointed Iraqi Governing Council "to allow the clarification of the legal status of each detainee and apply the rules and norms enshrined" in the Universal Declaration of Human Rights and the International Covenant of Civil and Political Rights. Zerrougui was "seriously disturbed by the fact that these persons have not been granted access to a court to be able to challenge the lawfulness of their detention, as required" by the covenant.

Soros lambasts US's Iraq policy

NEW YORK: George Soros, billionaire financier, has issued a virtual indictment of the Bush administration for what he belives is"the heedless assertion of American power in the world resembles a financial bubble - and the moment of truth may be here."
In an article in Atlantic monthly Mr Soros argues that "the supremacist ideology of the Bush administration stands in opposition to the principles of an open society, which recognize that people have different views and that nobody is in possession of the ultimate truth."
Lambasting the neo-conservatives in the Bush administration who had been making a case for invading Iraq since 1998, Mr Soros says, "Whatever the justification for removing Saddam Hussein, there can be no doubt that we invaded Iraq on false pretences. Wittingly or unwittingly, President Bush deceived the American public and Congress and rode roughshod over the opinions of our allies."
He asserts: "The gap between the administration's expectations and the actual state of affairs could not be wider. It is difficult to think of a recent military operation that has gone so wrong. Our soldiers have been forced to do police duty in combat gear, and they continue to be killed.

Tue Feb 11 16:16:43 EST 2003 I personally don't beleive in international law and feel the prospects for such are dim. It's a bit too much to get into here, but suffice it to say that at this point in our evolution we aren't ready. This is evidenced every day by the actions of our government and the actions of most governments around the world. Perhaps one day. What gets me is how willing our government and many of our citizens seem to be to scrap procedure and civil rights in the face of terrorism. You mentioned our criminal justice system and I will point out that the Bush administration and many citizens alike don't feel that normal criminal justice rights or procedures should apply. When they are willing to do that, I'm not sure I can trust anything else about them.

Islam, Democracy, And Human Rights In Iraq

) – Two powerful forces are at work in Iraq. How they are handled will determine whether they blend harmoniously or collide in conflict. One powerful force is many Iraqis' desire for democracy following decades of dictatorship. There appears to be a consensus among Iraqi and American leaders that Iraq should become a democracy. But it's not clear that both sides define democracy the same way. While the Iraqis, emerging from dictatorial rule, may understand democracy to mean primarily the ability to select leaders who would be accountable to the people, Americans undoubtedly understand democracy also to mean protection of civil rights (rights of women, ethnic minorities, and religious minorities). The second powerful force is many Iraqis' desire for an Islamic state following decades of secular rule when religion was stifled. The vast majority of Iraqis are Muslim, and thousands of Shias and Sunnis have been in the streets calling for the establishment of a religious state. They view the U.S.-led war as a war of liberation from Saddam, not liberation from Islam. Religious leaders are the only established, indigenous authorities in Iraq today; in fact, U.S. invasion/occupation troops have been relying on those religious leaders to help re-establish law, order, and public services (trash collection, electricity, public transportation, etc.).

    Ensuring justice for human rights abuses
    Those responsible for crimes under international law and other grave human rights abuses in Iraq must be brought to justice. To ensure that this goal is achieved, a comprehensive anti-impunity program needs to be developed. Its central pillar would be reforming the Iraqi criminal justice system. However, other complementary and transitional approaches will be needed, including approaches involving the international community.
    Currently a number of proposals for bringing to justice perpetrators of human rights abuses in Iraq are being discussed. They reportedly include proposals for military tribunals or military commissions set up by the United States of America (USA). While under international humanitarian law the USA, as one of the occupying powers in Iraq, would be entitled within narrowly circumscribed limits to set up US courts in Iraq, there are a number of considerations that would make this approach undesirable.
    Military tribunals should not be used to try civilians or to try soldiers accused of crimes under international law. Additional concerns include the fact that even if tribunals which have important fair trial guarantees are used, such as US courts martial, they will inevitably be perceived as victor's justice. Other mechanisms, such as military commissions modelled on those established after the attacks in the USA of 11 September 2001, are administrative bodies, not courts, and their procedures are grossly unfair. In either case, defendants would be exposed to the death penalty.

    October 28, 2002 Nationally syndicated radio host Bev Smith spoke to Gregory Fossedal, the author of Direct Democracy in Switzerland, for one hour this evening. The two held a spirited and wide-ranging talk that moved from civil rights issues to the potential war in Iraq.
    "Gregory Fossedal has written a thoughtful study on a country that does democracy in a very distinctive way than the U.S., and I would say, perhaps a better way," Smith said. "In the United States, we like to think we are ahead of everybody in the world, that we have the most perfect system possible but if you look at things like Enron and the corporate greed dominating our Congress, or all the shenanigans in places like Florida in the presidential election, it's clear that we need to make some improvements of our own system. I want to talk about that tonight about your very optimistic and uplifting concept that we can continue to improve and perfect democracy right here at home."
    "It's no stain on the United States to say that our democracy, though an excellent and improving system, isn't the ultimate, unimprovable way to do things," Fossedal agreed. "In fact, my guess is, we would project a little better image in the world, and also benefit ourselves at home, if we had a little humility and said, maybe we can give our system an upgrade, and maybe there are other countries we could learn something from. I went to Switzerland to study their system for that reason, and came away with a heightened respect for the Swiss system and the Swiss citizen it has produced."

    WHAT DOES WAR MEAN FOR WOMEN AND FAMILIES IN IRAQ?
    • The Bush Administration wants to bomb Baghdad, a city of five million people. This would cause a humanitarian catastrophe equivalent to a heavy air bombardment of Los Angeles. A November report by the global health organization Medact estimates that at least 50,000 civilians are likely to be killed by a US attack ( http://www.medact.org/tbx/pages/section.cfm?index_id=2 Many more civilians are likely to die from longer-term effects of a bombing, including environmental damage and the destruction of food supplies, agriculture and critical infrastructure, such as pharmaceutical plants and hospitals.
      • REMIND PEOPLE THAT this war is broader than the attack now being planned. It includes the combined impact of the 1991 Desert Storm bombing and the 12 years of sanctions and bombing since then. US and British forces have bombed Iraq more than 50 times this year alone and killed over 500 people since 1999.
