24 May 2004 The US has announced that the Iraqi interim government to be set up on 30 June will be led by a president, two vice presidents and a prime minister at the head of a government of 26 ministries. A White House statement also said the US would demolish the notorious Abu Ghraib prison near Baghdad in consultation with the new government. Resolution circulated at UNSC
Meanwhile, Britain and the US have circulated a draft UN Security Council resolution endorsing sovereignty for the interim Iraqi government. The resolution sets no date for US-led forces to leave Iraq. According to a senior British official, the interim government will have an effective veto over the operations of foreign troops in the country.

Mr Speaker, the House will recall that on the 18 March this year it resolved to support the government’s decision to commit Australian Defence Force personnel to the international coalition to disarm Iraq. The coalition undertook to enforce Iraq’s compliance with its obligations under successive resolutions of the United Nations Security Council, with a view to restoring peace and security to that area of the Middle East. Mr Speaker, I am pleased to report that the coalition’s major combat operations in Iraq have been successfully concluded. Australian military forces participated with just cause, in an action properly based in international law, which resulted in the liberation of an oppressed people.

Kurdish Leaders Demand a Top Position in New Iraqi Government
WASHINGTON - Iraq's Kurdish leaders told a top U.S. envoy in Iraq Friday that they want one of the two top positions in the new interim government president or prime minister or the Kurds will not participate in the body that is scheduled to take over when the U.S. occupation ends on June 30, according to Kurdish and U.S. sources. The Kurds were slated to take a lower position, as one of two vice presidents, in a formula designed by U.N. special envoy Lakhdar Brahimi that the Bush administration hoped to unveil next week. But Jalal Talabani, a veteran Kurdish leader and one of 25 members of the U.S.-appointed Iraqi Governing Council, informed U.S. presidential envoy to Iraq Robert Blackwill Friday that the Kurds would not take the job, Kurdish and U.S. sources said. The move is a serious setback that complicates U.S. hopes of winning agreement from Iraq's disparate ethnic and religious factions on the makeup of the interim government. Unless the Kurds back down or U.S. and U.N. envoys negotiate a compromise soon, the process of forming a government could drag on longer than expected and potentially deepen rivalries, experts on Iraq warned. The Bush administration hopes that the Kurds are merely posturing and can eventually be brought around, rather than be blamed for sabotaging the third attempt to form a government.

Iraq GOVERNMENT The Constitution provides for a governmental system that, in appearance, is divided into three mutually checking branches, the executive, the legislative, and the judicial. In practice, neither the legislature nor the judiciary has been independent of the executive . The Revolutionary Command Council In 1988 the Revolutionary Command Council (RCC) continued to be the top decision-making body of the state. The RCC was first formed in July 1968, and since then it has exercised both executive and legislative powers. The chairman of the RCC is the president of the republic. The number of RCC members has varied over time; in 1988 there were ten members. According to the Constitution, the RCC is the supreme organ of the state, charged with the mission of carrying out the popular will by removing from power the reactionary, the dictatorial, and the corrupt elements of society and by returning power to the people. The RCC elects its chairman, who serves concurrently as president of the republic, by a two-thirds majority vote. In case of the chairman's official absence or incapacitation, his constitutional powers are to be exercised by the vice chairman, who also is elected by the RCC from among its members. Thus the vice chairman (in 1988 Izzat Ibrahim, who had served since 1979) is first in line of succession. The members of the RCC, including both the chairman and the vice chairman, are answerable only to the RCC itself, which may dismiss any of its members by a two-thirds majority vote and may also charge and send to trial for wrongdoing any member of the council, any deputy to the president, or any cabinet minister. Since 1977 the Baath Party has regarded all members of the Baath Party Regional Command as members of the RCC. The interlocking leadership structure of the RCC and the Regional Command has served to emphasize the party's dominance in governmental affairs.

Iraq Government and Politics THE POLITICAL SYSTEM in 1988 was in what was officially characterized as a "transitional" phase. This description meant that the current method of rule by decree, which had been in effect since 1968, would continue until the goal of a socialist, democratic republic with Islam as the state religion was attained. The end of the transition period was to be marked by the formal enactment of a permanent constitution. The timing and the specific circumstances that would terminate the transitional stage had not been specified as of early 1988. The country remained under the regime of the Baath (Arab Socialist Resurrection) Party, which had seized power through a coup d'etat in July 1968. The legality of government institutions and actions was based on the Provisional Constitution of July 16, 1970, which embodied the basic principles of the Baath Party Arab unity, freedom, and socialism. These principles were in turn rooted in the pan-Arab aspirations of the party, aspirations sanctified through identification with the historic right and destiny of all Arabs to unite under the single leadership of "the Arab Nation." The most powerful decision-making body in Iraq, the tenmember Revolutionary Command Council (RCC), which functioned as the top executive and legislative organ of the state, was for all practical purposes an arm of the Baath Party. All members of the RCC were also members of the party's Regional Command, or state apparatus. President Saddam Husayn was both the chairman of the RCC and the secretary general of the Baath's Regional Command. He was generally recognized as the most powerful political figure in the country.

The United States and Britain, as well as their private contractors engaged in rebuilding Iraq, could face an onslaught of lawsuits - perhaps claiming hundreds of millions of dollars in damages and taking up years of court time. The grounds? That the coalition broke international law in the way it invaded and occupied Iraq, and in the way it is using Iraq's wealth and resources. This warning comes from an international lawyer who has just finished a detailed study of the possible legal consequences of America's first pre-emptive war. David J. Scheffer, a visiting professor at Georgetown University Law Center who was President Clinton's ambassador-at-large for war-crimes issues, argues that the United States and Britain have ignored the "short leash" granted by the internationally accepted rules governing the behavior of occupying powers. He contends that they have gone far beyond just patching up Iraq, which he said is allowed under international law, and are now moving onto the forbidden ground of exploiting the oil wealth of the country.
