The legal issues generated by the emergence of cable television as an increasingly dominant force in communications have exploded in the last few years. This course is important to students interested in practicing communications law and who are taking other media law and intellectual property courses. In addition, general practitioners and city attorneys are being drawn into cable law as cable franchises are renewed or legal issues regarding the cable systems arise. The course includes a final examination and some practice-oriented projects.

Quaker Marriages
Marriage has always been regarded by the Quakers as primarily a religious compact. “They say”, remarked William Penn, “that marriage is an ordinance of God, and that God only can rightly join man and woman in marriage.” Accordingly the Quakers have held that divorce could be granted only on Biblical grounds, namely, fornication or adultery. To safeguard the sacred institution of marriage the Friends have hedged it about with rules and observances which now appear strange or even fanatical to some, but which, nevertheless, have prevented moral laxness and a multitude of divorce cases. For the moral teaching of its young people the Society of Friends placed the chief responsibility on the parents, requiring of them by frequent reminders that they “exercise a religious care in watching over their children, and endeavor to guard them against improper or unequal connections in marriage”. On the other hand, when a young man or woman contemplated this serious step, before entering into a formal engagement they were expected first to consult their parents for advice; while older persons independent of parental care were admonished to consult interested friends with a view to learning their judgment as to the propriety of the union. In any case and above all else the parties concerned were expected to solemnly consider the weightiness of the matter, and to seek divine direction before plighting their troth.

It would be very convenient if all state and federal codes, statutes, and caselaw were available on the World Wide Web. This would give lay people easy access to the laws that they must follow and it would allow attorneys to do legal research without having to leave their office to go to a law library, or pay for expensive collections of casebooks. Unfortunately, economic realities dictate that we may never see all of the substantive law of all the states on the Web. Several states receive quite a bit of income by selling the exclusive rights to publish that state's caselaw. In addition, it is quite expensive to publish and maintain a web site, and money for such a project is not available in all states. Caselaw on the Web ideally would include decisions from at least the last 30 years, a sophistocated search engine for locating relevant law, case summaries, headnotes, etc. Providing all of these on a Web site would be very expensive. Given the above, it is impressive how much substantive law

When Administrative Action is Necessary
The Investigating Officer's Role
Administrative penalties often receive greater attention than simple misdemeanor fines imposed by the courts, so an investigating or arresting officer many times provides information that precipitates the administrative hearing process.
Law enforcement officials, along with fire and health officials report violations of alcoholic beverages and related laws by forwarding investigation reports to the Iowa Alcoholic Beverages Division. The reports are then forwarded to the Iowa Department of Justice for further action.
Administrative Hearing Complaint
An assistant Attorney General reviews investigation reports, and when appropriate, contested case hearings are initiated through an administrative hearing complaint.Administrative hearing complaints also may be filed with the Division by county and city attorneys.
Administrative hearing complaints must be filed within one year of the alleged violation, or within one year from the date of conviction, whichever is later.

    State Computer Harassment or "Cyberstalking" Laws
    Law enforcement agencies estimate that electronic communications are a factor in from 20 percent to 40 percent of all stalking cases. Forty-four states now have laws that explicitly include electronic forms of communication within stalking or harassment laws. State laws that do not include specific references to electronic communication may still apply to those who threaten or harass others online, but specific language can make the laws easier to enforce. Two reports from the U.S. Department of Justice provide detailed information on cyberstalking: Stalking and Domestic Violence: Report to Congress (May 2001) and Cyberstalking: A New Challenge for Law Enforcement and Industry (Aug. 1999). CyberAge Stalking , from LLRX.com , discusses the prevalence of cyberstalking and outlines state and federal statutes and case law. It also provides resources and information about how to protect against this crime. Cyberstalking: Navigating a Maze of Laws New York Law Journal , July 2002) describes various statutory definitions and provisions in several state cyberstalking laws.
