Following are highlights of Iowa's liquor control system:
Jan. 20, 1920 -
Volstead Act (national prohibition) becomes effective following ratification of the 18th Amendment by the states. (18th Amendment prohibited the 'manufacture, sale, or transportation of intoxicating liquor.')
Feb. 20, 1933 -
U.S. Congress repeals the 18th Amendment and the Volstead Act by approving the 21st Repeal Amendment. Iowa votes in favor of repeal of the 18th Amendment at its ratification convention on July 10, 1933.
Dec. 5, 1933 -
Proclamation 2065 officially replaces the 18th Amendment with the 21st Repeal Amendment; 14 years of national prohibition are ended.
March 8, 1934 -
Iowa becomes one of the original 'control' or 'monopoly' states and assumes direct control over the wholesale and retail distribution of all alcoholic beverages except beer.
Also effective on this date: the general public is required to obtain a special permit from the Liquor Control Commission and to present a special booklet to purchase liquor (repealed May 16, 1963); and, liquor stores are required to be closed on national, state and municipal election days. (Repealed Jan. 1, 1972.)

An environmental audit report is privileged. It is not admissible as evidence in any civil or administrative proceeding. The environmental audit report must be labeled, ÒENVIRONMENTAL AUDIT REPORT: PRIVILEGED DOCUMENT.Ó (Section 455K.3) The audit report is defined as including supplemental information such as auditor working papers, photographs, sample information, and corrective action plans. The privilege extends to these documents as well. (Section 455K.2) A court or an officer in an administrative hearing may require disclosure of a portion of an environmental report in a civil or administrative proceeding, if it is determined that any of the following conditions exist: (Section 455K.5)

Disciplinary Process The IBME is authorized by statute to investigate complaints and reports about licensees under its jurisdiction and to take appropriate disciplinary action against any licensee found to be in violation of state law or Board administrative rules governing the practice of medicine and surgery, osteopathic medicine and surgery, osteopathy and acupuncture in Iowa. The procedures and grounds for IBME discipline are specified in the Iowa Adminstrative Code 653-Chapters 12-14. Section 147.103A of the Code of Iowa gives the IBME the authority to appoint investigators to aid in the enforcement of the provisions of the law relating to medicine.

Board members or staff persons may hear of potential violations through the media, reports from other medical boards or the Federation of State Medical Boards, or other sources. In these instances, the Board itself may open a file on its own motion. Once a complaint/report is received, it is assigned a case number and an investigative file is opened. Under the direction of the Chief Investigator, investigative reports are prepared and sent for review to the Board of Medical Examiners. During the complaint investigation phase, all information related to the investigation is strictly confidential. Cuffs fights for BDSM rights

There have been racial rights, women's rights and most recently, gay rights movements in the United States. But what about bondage, discipline, domination and sadomasochism rights? This is the next step in civil rights movements, some ISU American Civil Liberties Union members and Cuffs members said as they gathered Monday to discuss the issue and hear from Cuffs president Harlan "Duane" Long Jr. in light of the university charging Cuffs, an ISU student organization that teaches BDSM practices, with assault. "Cuffs is part of a burgeoning social movement on behalf of the BDSM community. It's time someone took a stand," Long said. "BDSM should be an accepted social activity if done safe, sane and consensual, as Cuffs promotes."

    February 19, 2004 In the Feb. 18 Daily article "Cuffs fights for BDSM rights," ISU Director of Judicial Affairs Bethany Schuttinga said she based her decision to charge Cuffs with assault on the 1985 case State of Iowa v. Edward Collier. The case itself, though, is a suspect ruling upon which to base a charge. Under Iowa Code section 708.1, a person commits an assault when, without justification, the person commits any act which is intended to cause pain or injury to, or which is intended to result in physical contact ... to another; any act which is intended to place another in fear of immediate physical contact which will be painful, injurious, insulting or offensive ... ; or intentionally points any firearm toward another, or displays in a threatening manner any dangerous weapon toward another. Collier said the sadomasochistic activity, which he claimed occurred, was a social activity, which would make it exempt from the definition of assault in section 708.1 of the Iowa Code. Voluntary participants in a sport, social or other activity, not in itself criminal - and if the the act is a reasonably foreseeable incident of such sport or activity - isn't seen as assault.

    You read a lot in divorce-law periodicals and occasionally hear at CLE shows about the need to pinpoint and chart out where a married couple were living over the course of many years when they acquired various marital property interests. This shows up especially with regard to pensions and other assets that are acquired over time. Was this military couple living in Arizona, New Mexico, or Ohio when they acquired that asset? After all, some of those are community property states, so beware. And was the asset 16.35% acquired in Arizona, 20.29% in Virginia and other percentages in Germany or France?
    Many lawyers are greatly concerned about assiduous nailing down of these details, calculation of the percentages, etc. They naturally infer that if it can be done, there could be malpractice liability if it is not done. After all, that's the name of the most important game of all in our end of the profession: defensive practice. But just what is the law as to the necessity for all of this? Could you really prove to a court that because a certain asset, or part of the asset, was acquired in a community property state, there has to be an absolute and inflexible 50% rule as to that asset or portion of asset?

    600.3 Commencement of adoption action-jurisdiction-forum non conveniens.
    An action for the adoption of any natural person shall be commenced by the filing of an adoption petition, as prescribed in section 600.5, in the court of the county in which an adult person to be adopted is domiciled or resides, or in the court of the county in which the guardian of a minor person to be adopted or the petitioner is domiciled or resides. An adoption petition shall not be filed until a termination of parental rights has been accomplished except in the following cases:
  • No termination of parental rights is required if the person to be adopted is an adult.
  • If the stepparent of the child to be adopted is the adoption petitioner, the parent-child relationship between the child and the parent who is not the spouse of the petitioner may be terminated as part of the adoption proceeding by the filing of that parent's consent to the adoption. For the purposes of this subsection, a consent to adopt recognized by the courts of another jurisdiction in the United States and obtained from a resident of that jurisdiction shall be accepted in this state in lieu of a termination of parental rights proceeding. Any adoption proceeding pending on or completed prior to July 1, 1978, is hereby legalized and validated to the extent that it is consistent with this subsection.
