Mr. Nicol's complaint is also within the subject matter jurisdiction of the Commission as the allegations that the Respondent constructively discharged the Complainant due to his age and disability fall within the statutory prohibition against unfair employment practices. Iowa Code § 601A.6 (1985). "it shall be a. .. discriminatory practice for any person to refuse to hire... or to otherwise discriminate in employment against any applicant..... or employee because of the age . . . or disability of such applicant or employee." Id.

3. "Disability" means the physical ... condition of a person which constitutes a substantial handicap." Iowa Code §601A.2(11) (1985). "Substantially handicapped person" includes "any person who has a physical ... impairment which substantially limits one or more major life activities. 240 Iowa Admin. Code §6.1(1) (now at 161 Iowa Admin. Code §8.26(l)). "Impairment" includes "any physiological disorder or condition ... affecting [the neurological] ... body system. Id at 6.1(2) (now at 161 Iowa Admin. Code § 8.26(2)). "Walking" is a "major life activity." Id at §6.1(3) (now at 161 Iowa Admin. Code §8.26(3)).
4. Complainant Nicol has a "disability" as that term is used in Iowa Code sections 601A.6 and 601A.2(l 1) because he has a physical condition which constitutes a substantial handicap. Iowa Code §601 A.2(11) (1985). The condition constitutes a substantial handicap under 240 Iowa Administrative Code section 6.1(1) because:

Nothing in this chapter shall be construed as indicating an intent to prohibit an agency or commission of local government having as its purpose the investigation and resolution of violations of this chapter from developing procedures and remedies necessary to insure the protection of rights secured by this chapter. All cities shall, to the extent possible, protect the rights of the citizens of this state secured by the Iowa civil rights Act. Nothing in this chapter shall be construed as limiting a city or local government from enacting any ordinance or other law which prohibits broader or different categories of unfair or discriminatory practices. The Iowa civil rights commission may designate an unfunded local agency or commission as a referral agency. A local agency or commission shall not be designated a referral agency unless the ordinance creating it provides the same rights and remedies as are provided in this chapter. The Iowa civil rights commission shall establish by rules the procedures for designating a referral agency and the qualifications to be met by a referral agency.

    Plaintiff, who had completed course at Law Enforcement
    Acedemy, appeals from district court decision affirming academy's denial of certification as law enforcement officer. AFFIRMED
    Thomas J. Miller, Attorney General, Gary L. Hayward, Assistant Attorney General, and Annette J. Scieszinski, County Attorney, for appellees.
    Considered by McGiverin, C.J., and Harris, Larson, Carter, and Neuman, JJ. LARSON, J. Edward J. Hollinrake, who was denied certification as a peace officer by the Iowa Law Enforcement Academy (academy) because his eyesight did not meet its minimum standards, sought judicial review in district court. The district court dismissed his petition, and appealed. We affirm. This is the second appeal in this case. In the first, Hollinrake v. Monroe County, 433 N.W.2d 696 (Iowa 1988), we held that Hollinrake could not pursue a civil rights action under Iowa Code chapter 601A (1987) but was limited to the judicial review provisions of chapter 17A. Hollinrake, 433 N.W.2d at 699. The pertinent facts are set out in the first Hollinrake case, 433 N.W.2d at 697, and we need not repeat them in detail here. Essentially, the record shows that Hollinrake's distance vision in his left eye does not meet the standards of 501 Iowa Administrative Code 2.1 (9), which requires uncorrected vision of "not less than 20/100 in both eyes, corrected to 20/20." The academy determined that Hollinrake did not meet the vision criteria of the rule and therefore could not be certified. In making this determination, the academy interpreted rule 2.1 (9) to require 20/20 corrected vision in each eye.

    Federal Driver's Privacy Protection Act
    The Federal Driver's Privacy Protection Act and Iowa Code Section 321.11 prohibits the release of personal information when the request is submitted by plate number except to a law enforcement officer or law enforcement agency; licensed private investigation agency; Iowa security service or licensed employees of either, and employees of a Federal or State agency or political subdivisions and contract employees of the Department of Inspections and Appeals in the conduct of their investigations. Personal information means information that identifies a person, including a person's photograph, social security number, driver's license number, name, address, telephone number, and medical or disability information. The Federal law has further restricted the release of some personal information as being "sensitive" (Public Law Number 106-69, section 350(b) and Title 18 U.S.C. 2721). This "sensitive" personal information includes the social security number, medical or disability information, and the photograph. Social security numbers are not released unless being used as a driver license number and the requestor is a specified authorized recipient. Iowa law requires strict confidentiality of medical and disability information. Iowa law also limits the release of a photograph only to law enforcement agencies, law enforcement officers, or a governmental agency with a legitimate use for the photograph.
