The Role of International Treaties in Environmental Conservation The same dynamics that led to the United Nations Conference on the Human Environment in Stockholm in 1972 created the demand for international treaties and conventions to cope with environmental conservation, modification and pollution problems. It became clear that bilateral arrangements, which might be appropriate for cooperative research between two countries or necessary to deal with specific cross-border problems, were inadequate to deal with global concerns. The new agreements included: The Convention on Wetlands of International Importance , concluded in Ramsar, Iran in 1971 (now generally referred to as "Ramsar"); The Convention on the Conservation of Migratory Species , concluded in Bonn in 1972 ( the "Bonn Convention"), covering birds, animals and marine creatures. The Convention on International Trade in Endangered Species of Wild Fauna and Flora , concluded in Washington in 1973 (known as CITES and, outside the U.S., as the "Washington Convention"). Also concluded were several treaties on marine pollution; conventions on environmental modification, Protection of the World Cultural and Natural Heritage, Conservation of Antarctic Marine Living Resources; and several regional environmental agreements under the framework of the United Nations Environment Programme (UNEP).

Laws governing foreign trade
National Laws
The most specific of these is the Trade Law, adopted in May, 1997 by the National Assembly of Vietnam. To guide the implementation of the law, the government issued:
  • Decree No 57, dated July 31, 1998, regulating export and import activities, processing for trade, and sale and purchase agencies
  • Decree No 45, dated September 6, 2000, regulating the establishment and operation of representative offices and branches of foreign companies in Vietnam
  • Other relevant laws such as the Civil Code and the Ordinance on Economic Contracts
As a result of this legislation, the following regulations and practices have gone into effect:
  • The right to handle export and import business has been expanded to all business entities in all economic sectors.
  • Vietnamese companies, including private firms, have the intrinsic right to export and import within the scope of registered business lines.
  • In addition to representative offices, foreign companies can now set up branches in Vietnam to undertake certain profit-making trading activities.
  • Vietnamese businesses, including private firms, are allowed to act as sale and/or purchase agents in Vietnam for foreign firms and individuals.

Trade treaties, alcohol and public health
by Jim Grieshaber-Otto and David Jernigan
There was a time when it was not necessary to pay much attention to trade treaties. But those days are gone The time has come for public health advocates to make sense of the seemingly incomprehensible 'alphabet soup' of treaty acronyms, and to demand greater public involvement in negotiations that are already well underway. What do the latest international trade treaties have to do with efforts to minimize alcohol-related harm? Plenty. As we shall see, the two are frequently in conflict. Recent impacts on alcohol regulation International treaties have already impaired government efforts to control alcohol availability and alcohol-related harm. Taxes One of the most common and effective ways to prevent alcohol-related problems is to tax alcoholic beverages so that they become more expensive and hence less accessible. Under the very broad 'national treatment' provisions of many trade treaties, governments are prevented from taxing alcohol or anything else in ways that even unintentionally or incidentally protect domestic production from foreign competition. For example, governments that seek to discourage citizens from developing a taste for new, foreign alcohol products having a higher alcohol content than local products may run afoul of national treatment rules. In 1999, a WTO panel ruled that Chile could not tax foreign spirits with a high alcohol content at a higher rate than low alcohol pisco, a Chilean liquor.

20 November 2000 Kia ora,
Further to our last alert on the International Treaties Bill, 3 November 2000, the Bill has passed its first reading in parliament and has been sent to the Foreign Affairs, Defence and Trade Select Committee for consideration. All parties except National voted in favour of the Bill going to Select Committee. The purpose of the Bill is to ensure that the NZ government will not be able to enter into international treaties without parliament’s approval. This is in part to replace the existing Standing Orders which since 1998 have resulted in some international treaties (not bilateral treaties except at the Minister’s discretion) being ‘referred’ to parliament. Among other things, the International Treaties Bill 2000 provides for the Minister of Foreign Affairs and Trade to present to parliament the text of draft treaties which are under negotiation - this would assist in preventing the type of secrecy around some international agreements, such as the MAI which the then NZ government could have become a party to without anyone else knowing of its existence. If you require a copy of the Bill, please contact the PMA office and we can email, fax or post it to you.

The EU disavows any intent to create a protectionist instrument. But its proposals for changing the GATT/WTO provisions to get ex ante legitimization for trade restrictive measures purportedly taken under Multilateral Environment Agreements (MEAs), both against parties and non-parties to an MEA will in fact achieve this. The EU MEA would encompass all the way from UN negotiated instruments commanding global consensus to instruments fashioned by a few industrial countries but technically thrown open for universal adherence.

International Treaties Bill - Second Reading
Keith Locke MP , Green Party Foreign Affairs Spokesperson Parliament, 19th February 2003
I am disappointed that this bill will probably be voted down after this second reading debate, although I am optimistic that members will be convinced during the debate to change their minds, just as I am optimistic that Team New Zealand will probably come back from three down. I am very pleased that the bill has received serious consideration by the House and by the Foreign Affairs, Defence and Trade Select Committee.
Several proposals for improving Parliamentary oversight of international treaties were contained in the first Interim Report on the International Treaties Bill, which was discussed in Parliament late last year and there was a very constructive atmosphere in the Select Committee in producing these recommendations.
The Chairperson of the committee in the last Parliament, Graham Kelly, said the bill was ahead of its time, a comment I welcome, because I think it recognises the moral and principled case underlying this bill.
It is what one might call a “democratic deficit” when Parliament can debate and vote on everything else, bar international treaties and agreements.

International Treaties Bill
Keith Locke MP , Green Party Presented by Ian Ewen-Street MP on behalf of Keith Locke MP Parliament, 2nd October 2002
I am presenting on behalf of my colleague Keith Locke. The International Treaties Bill was drafted by him and is being considered by the Foreign Affairs, Defence and Trade Select Committee of which he is a member.
It is a pleasure to be able to explain the interim report and the second interim report on the International Treaties Bill.
The Bill itself is a very important bill, and I congratulate the Foreign Affairs, Defence and Trade Select Committee for dealing with it in such a constructive manner.
Essentially the bill deals with a “democratic deficit” in our legislative system, in that international treaties are approved, not by the Parliament, but by the government of the day.
What we are engaged in with this bill is a process of democratisation. Executive authorities have been slow to devolve treaty making powers to the people. In earlier centuries, when the King or Queen gave powers over the Parliament, he or she kept treaty making powers. Now many governments are reluctant to pass those powers over to the Parliament.
However, several European parliaments have a treaty approval process, so it can be done. With MMP we have become more of a European-style proportional system of government, so why not follow the Europeans in approving treaties?
