History
The idea for the ICC is not new; efforts to have an international criminal court date back over 80 years. Chronological time line of the ICC's history : An International Criminal Court is mandated in the Treaty of Versailles Article 227 of the treaty mandates that a special tribunal be established to try Wilhelm II (the former German Emperor) for "a supreme offence against international morality and the sanctity of treaties." The tribunal was to consist of judges from the United States, Great Britain, France, Italy and Japan. Following the end of World War I, the Commission on the Responsibility of the Authors of the War and on the Enforcement of Penalties concludes that an international court should be established. The Commission recommends that an international court be created to punish those "belonging to enemy countries, however high their position may have been ... including Chiefs of States, who had been guilty of offences against the laws and customs of war or the laws of humanity." The Court was established but failed due to a lack of cooperation on the part of countries where indictees had been found to surrender them to the Court.

    Argentina/Italy: Under international law crimes against humanity cannot be subject to statutes of limitations
    Amnesty International is making an urgent appeal to Italy and Argentina to carry out their international obligations and not to allow any statutes of limitations to be applied to cases recognized as crimes against humanity under international law.
    "The decision by the Rome Appeal Court to release Jorge Olivera, apparently concluding that a crime such as torture, which is punishable under international law, is subject to a statute of limitations under domestic law is extremely worrying," the organization said today.
    France has requested Italy to extradite Jorge Olivera for the kidnapping and torture of French citizen Marie Anne Erize Tisseau. These offences, which reportedly appear on the arrest warrant, were carried out systematically in Argentina and, given their scale and gravity, they constitute crimes against humanity.
    The Rome Statute of the International Criminal Court, in its article 7, recognizes that torture, when carried out systematically or on a large scale, constitutes a crime against humanity. Article 29 of the same Statute rules that crimes which fall under the jurisdiction of the Court cannot be subject to any statutes of limitations. The article confirms that under international law the application of any statute of limitations in cases of crimes against humanity is prohibited.

These materials are to be used for research purposes and do not circulate. Often these materials are also available in electronic format.

W elcome to this page, the primary purpose of which is to explore, and seek debate concerning, international law issues arising out of the increasing use of military personnel in circumstances below the threshold of armed conflict.
Background
A s the twentieth century draws to a close, the law governing the use of military force is becoming increasingly complex. While armed conflicts continue and are likely to do so, since 1990 there has been a huge increase in the deployment of armed forces into non armed conflict situations, that is, into operations below the armed conflict threshold. In these operations the deployed armed forces are not expected, required (or indeed, allowed) to take or perform armed conflict actions or roles.

W hile international armed conflicts have continued since 1945, their number has been (comparatively) limited. Internal armed conflicts, however, continue to plague the world in significant numbers and, although international armed conflicts are likely to continue, it is these, the internal armed conflicts, that are likely to do predominate into the foreseeable future. It is mainly into these latter, internal armed conflict, situations that UN troops (and the troops of other international bodies such as the Multinational Force of Observers in the Sinai or the South Pacific Peace Keeping Force that went to Bougainville in September 1994) are deployed. While the different factions in the host country may be in armed conflict, the peacekeeping forces themselves, not being deployed to perform armed conflict roles, are not normally in armed conflict. It is therefore clear that military operations are no longer being conducted solely within the narrow compass of armed conflict.

Before you start researching international law, it is important to know the difference between international law (both public and private foreign law , and comparative law . While the focus of this tutorial is international law, the researcher should have a basic understanding of the definitions of international and foreign law. Public International Law Public international law governs the relationships between national governments, the relationships between intergovernmental organizations, and the relationships between national governments and intergovernmental organizations. I. Introduction
Most legal scholars agree that a recognizable body of international criminal law does exist. However, the precise parameters of this body of law are often unclear, perhaps due to the rapid and complex developments of our global society. In its widest context, the source of international criminal law might be derived from the general principles of international law recognized by civilized nations; and therefore, found in the customary law accepted by states, the general criminal law recognized by nations, and the treaties which govern particular conduct. International criminal law can also be categorized according to whether the conduct in question is international, constituting an offense against the world community, or whether the act is transnational, affecting the interests of more than one state. For example, international crime would encompass acts that threaten world order and security, crimes against humanity and fundamental human rights, war crimes, and genocide; whereas the transnational crime category would include drug trafficking, transborder organized criminal activity, counterfeiting, money laundering, financial crimes, terrorism, and willful damage to the environment.
