General description
The Institute's research fellows usually work on questions of public international law and European law, as well as in the area of comparative law. The Institute is not divided into departments. The research fellows observe specific areas of public international law and legal developments in the public law of states in different parts of the world and report on important developments. The production of synergies from the various fields of work is ensured institutionally. Every Monday all research scholars (including the guests) participate in a two-hour meeting in which new legal developments (including selected academic publications) in the relevant areas of law are presented and discussed. In addition, a series of regular working groups deals with specific subject areas such as international security and constitutionalization, international economic law, the European Union, ethics and law or human rights. The working groups are organized by the research fellows and are also open to the guests.

  • 1. Library profile The library collects literature on public international law and foreign public law from all over the world and in all languages. The library has the status of a United Nations Depository Library since 1949 and is also a European Documentation Centre of the European Union. The holdings of the library contain at present about 512.000 volumes. The library subscribes to about 4.500 current periodicals. The library is the largest German library in its field. The United Nations Depository Library receives and collects all publicly accesible documents and publications of the United Nations as well as those of other international organizations. In addition, the United Nations Depository Library holds the publications of the League of Nations. The European Documentation Centre collects all publications of the European Union. UP

    Programme Director: Pat Capps
    The School of Law offers six taught LL.M. degrees: Commercial Law, European Legal Studies, General Legal Studies, International Law, Maritime Law and Public Law . Each degree may be studied either full time over one year or part time over 8 years. In each programme, students must satisfactorily complete four units and submit a dissertation on an approved legal topic. For the LL.M. in General Legal Studies , students may take any four units offered by the School and submit a dissertation on any approved topic. For the specialised LL.M. programmes, students must normally choose at least three units from a list of core Law units and submit a dissertation on a topic in the relevant area of law. (However, for Maritime Law you must choose four units from that core list). Furthermore, for the degree in European Legal Studies students may choose to take two units from this cluster and two from the International Law cluster and write a dissertation in the field of European Law. Similarly, for the degree in International Law, students may take two units from each of the International and European clusters and select an International Law topic for their dissertation. The Commercial Law programme offers students an opportunity for intensive study of units in specialist commercial and industrial topics. A student may wish to concentrate upon European commercial issues, upon international trade or domestic commerce. Students may pick a broad range of topics or a cluster of units around one special interest.

    international law: an overview
    International law consists of rules and principles which govern the relations and dealings of nations with each other. International Law, which is in most other countries referred to as Public International Law, concerns itself only with questions of rights between several nations or nations and the citizens or subjects of other nations. In contrast, Private International Law deals with controversies between private persons, natural or juridical, arising out of situations having significant relationship to more than one nation. In recent years the line between public and private international law have became increasingly uncertain. Issues of private international law may also implicate issues of public international law, and many matters of private international law nave substantial significance for the international community of nations. International Law includes the basic, classic concepts of law in national legal systems status, property, obligation, and tort (or delict). It also includes substantive law, procedure, process and remedies. International Law is rooted in acceptance by the nation states which constitute the system. Customary law and conventional law are primary sources of international law. Customary international law results when states follow certain practices generally and consistently out of a sense of legal obligation. Recently the customary law was codified in the

    Article GENERAL WILLIAM T. SHERMAN: WOULD THE GEORGIA CAMPAIGNS OF THE FIRST COMMANDER OF THE MODERN ERA COMPLY WITH CURRENT LAW OF WAR STANDARDS? by Thomas G. Robisch I. INTRODUCTION From March 18, 1864, until the close of the Civil War, Major General William T. Sherman was the commander of the Federal Division of the Mississippi. The campaigns he designed and conducted led to Sherman's reputation as one of the most successful military leaders of the war. Sherman's high standing seems anomalous, however, if judged exclusively by his battlefield exploits, because although he usually succeeded in achieving the objectives of his campaigns, he rarely won individual battles clearly and decisively. His great military prestige is really based upon his visionary strategic and operational concepts and his army's striking execution of those ideas. In this sense, Sherman is regarded as the first commander of the modern era. The general's reputation as a contemporary commander stems from his belief in total war, which is the concept that armed conflict involves a struggle not only between competing military forces but also between the societies of the competing states. Within that context, Sherman recognized that a nation could succeed militarily by destroying the opposing side's ability to wage war, and that an army could conduct better campaigns for this purpose by maneuvering its forces against an enemy's economic infrastructure in addition to engaging belligerent troops.

    Treaties are among the primary sources of international law. This chapter will give you some guidance on how to go about treaty research, with a particular emphasis on electronic resources. Since there is no such thing as a comprehensive collection of treaties in print or on-line, you will have to conduct your research with a certain amount of creativity, and a lot of perseverance.
    I. Introduction to Treaty Research
    The history of treaties stretches back for thousands of years, (a treaty existed between the Hittites and Akkadians (http://ccat.sas.upenn.edu/~humm/Topics/Contracts/treat01.html) around 1380 BC, for example). However, it is only relatively recently that they, and the rules under which they are formed, have become increasingly codified. After drafting efforts in the early 20th century by various bodies such as the League of Nations, the International Law Commission of the United Nations drafted the Vienna Convention on the Law of Treaties (1969) (http://www.un.org/law/ilc/texts/treaties.htm), which came into force in 1980.

    OVERVIEW
    Following the Commission's conclusion that the establishment of an international court to try persons charged with genocide or other crimes of similar gravity was both desirable and possible, the General Assembly established a committee to prepare proposals relating to the establishment of such a court. The committee prepared a draft statute in 1951 and a revised draft statute in 1953. The General Assembly, however, decided to postpone consideration of the draft statute pending the adoption of a definition of aggression. Since that time, the question of the establishment of an international criminal court has been considered periodically. In December 1989, in response to a request by Trinidad and Tobago, the General Assembly asked the International Law Commission to resume work on an international criminal court with jurisdiction to include drug trafficking. Then, in 1993, the conflict in the former Yugoslavia erupted, and war crimes, crimes against humanity and genocide in the guise of "ethnic cleansing" once again commanded international attention. In an effort to bring an end to this widespread human suffering, the UN Security Council established the ad hoc International Criminal Tribunal for the Former Yugoslavia, to hold individuals accountable for those atrocities and, by so doing, deter similar crimes in the future. Shortly thereafter, the International Law Commission successfully completed its work on the draft statute for an international criminal court and in 1994 submitted the draft statute to the General Assembly. To consider major substantive issues arising from that draft statute, the General Assembly established the Ad Hoc Committee on the Establishment of an International Criminal Court, which met twice in 1995. After the General Assembly had considered the Committee's report, it created the Preparatory Committee on the Establishment of an International Criminal Court to prepare a widely acceptable consolidated draft text for submission to a diplomatic conference. The Preparatory Committee, which met from 1996 to 1998, held its final session in March and April of 1998 and completed the drafting of the text.

During the long period between the fall of the Roman Empire and the definitive beginning of modern European states the greatest influence working for a recognition of international law among all peoples was the Church. A common faith, imposing the same obligations upon the individual members of the Church among all nations, obviously tended to the establishment and recognition of rules of justice and morality as among the nations themselves; and, when the more general acceptance of the obligations of Christianity became the rule, it followed naturally that the Head of the Church, the pope holding the Divine commission, should become the universal arbiter in disputes among nations. For centuries the great offices of state, especially those having to do with foreign relations, were held by bishops learned in canon law, and, as canon law was based upon Roman law and especially adapted to the government of the Church whose jurisdiction was not bounded by state lines, it naturally suggested many of the rules that have found a place in international law. The pope became the natural arbitrator between nations, and the power to which appeals were made when the laws of justice and morality were flagrantly violated by sovereigns either in relation to their own subjects or to foreign nations. As the empire founded by Charlemagne gained in power and extent, the controversies precipitated by the conflicting claims of civil and ecclesiastical jurisdiction developed still further the position of the pope as the highest representative of the moral power of
