TU College of Law Journals: An Editorial Experience
Students have the opportunity to serve on the College of Law's three journals. Those who participate develop writing and editing skills, work with contributors nationwide, enjoy the camaraderie of an editorial staff, and learn to meet deadlines. Energy Law Journal and ABA Year in Review
The Energy Law Journal is a joint project of NELPI and the Federal Energy Bar. It has a national circulation of more than 2,400 and approximately 150 foreign subscriptions. The primary focus of the journal is federal energy law, particularly regulation and administrative law. Recent issues however reveal the global nature of energy practice and the interrelation between environmental law and energy policy. The journal's board of editors are final-year students in the full time program and third or fourth-year students in the part time program. In addition to editing the Energy Law Journal the board of editors is responsible for the publication of Year in Review, a joint project of the College of Law and the American Bar Association's Section on Natural Resources, Energy, and Environmental Law. Year in Review is a concise, comprehensive, timely analysis of current developments in areas that are of crucial interest to practitioners and students. Student editors also oversee a writing program that qualifies second and third-year students for journal staff positions.

Journal membership develops research, writing, and analytical skills, which are invaluable aspects of legal education. While membership on a journal's staff is a significant achievement, it requires a considerable commitment of time and energy. In addition to preparing their own notes or comments for publication, members must evaluate professional articles, edit manuscripts, proofread, and develop new topics. Students are selected for journal membership on the basis of first-year grades and a writing competition held in the summer after first year. An editorial board for each publication is elected each spring by the current staff members.

Such an element may exist for instance because a contract has been made or is to be performed in another State or because the recognition of a divorce obtained by persons domiciled abroad may arise. Because the courts of the other State may also be asked to exercise jurisdiction in the suit, or because the laws of that other State may be different to those of Ireland, in determining the suit before it an Irish court may be confronted with a conflict of laws. Such conflicts are resolved by applying the rules of private international law. To varying degrees the rules of private international law which have been developed in Ireland will be different to those developed in other States and indeed there are probably as many systems of private international law rules as there are States and therefore national legal systems.

Vol. 15 No. 1 ORDER OUT OF ANARCHY: THE INTERNATIONAL LAW OF WAR Gary M. Anderson and Adam Gifford Jr. W ar is often assumed to be the paradigm of anarchy, the Hobbesian state of nature in practice. War, in that view, is merely the predictable violent breakdown of law and order that follows from the lack of a world government. However, that view ignores an interesting and important aspect of the ``anarchic'' international order. A complex system of norms, including both cultural and legal institutions, exists and functions to constrain warfare. In fact, the idea that the conduct of armed conflict is governed by rules appears to have been found in almost all societies, without geographical limitation (Roberts and Guelff 1982: 2).[1] These rules do not work perfectly. But they clearly restrain the behavior of nations at war, at the margin. The use of violence to transfer resources from one party to anotherthe central feature of waris an externality. Because warfare destroys resources in the process of transferring them, it is also a negative-sum game. Historically, the purpose of the constraints on war was not to eliminate the basic externality resulting from the coercive transfer itself but, more modestly, to make the sum of the game less negative. The resources destroyed during war can be thought of as the transactions costs of war. The cultural and other constraints on war, including what we now call the laws of war, then, reduce the transactions costs. If the constraints worked perfectly, war would become a zero-sum game.
