Students Student Publications Syracuse Law Review

Now in its fifty-fourth year of publication, the Law Review is an intense legal research and writing program for student editors and a national forum for scholars who contribute to it. The editorial board publishes four Law Review issues annually, one of which is the Annual Survey of New York Law.

I. Women's Human Rights in the Context of International Law Research Women's rights, in international law, emerges today as an exciting, rapidly-developing sub-field of international human rights protection . As stated in a related research guide of this series (please refer to Marylin J. Raisch, Guide III: International Protection of Human Rights at the Bora Laskin Law Library page under Research Guides and Publications, Curriculum-based guides at http://www.law-lib.utoronto.ca/resguide/index.htm Treaties are … the international equivalent of "legislation" broadly stated, as the basic norm-creating text. The major multilateral treaties may occupy any one of a number of places in a hierarchy of legal authorities depending on the domestic law of the member state. A treaty may be on a par with domestic constitutional law, above it, somewhere between domestic constitutional law and domestic statutory law, or lack validity. In the last case, an enabling or implementing law of the jurisdiction must expressly declare a treaty to be a law of that country. These variations are true for member states of the UN and of the Council of Europe, parent bodies of the most widely-known human rights treaties.

    PROFESSOR JOHN NORTON MOORE: As we look internationally at the rule of law, no issue is more important than the control of unauthorized violence, or what Myers McDougal used to term the maintenance of minimum world public order; that is, an orderly world in which change takes place by negotiation, by consensual arrangement, and not by unauthorized coercion.
    Unfortunately, as we look at these issues and we seek to stop aggression and we seek to stop democide and the contemporary genocides that, sadly, continue in the modern world, we find that there is a movement which seeks to curtail the scope of the lawful defensive right and which seeks, in a variety of ways, to cut down the ways in which one can lawfully engage in defense when one is engaged in these struggles.
