- A group of prominent national environmental and government ethics organizations today called for appointment of a special counsel to conduct a criminal investigation of Deputy Secretary of Interior J. Steven Griles. In a separate but related action, three of the organizations filed suit today in U.S. District Court in Washington, DC, to compel the government to surrender records concerning yearly payments totaling $1.1 million that Griles is receiving from his former employer, an oil and gas industry lobbying firm.

A longtime lobbyist for the energy industry, Griles has met regularly with clients of his former employer, National Environmental Strategies (NES), during his tenure at Interior while receiving $284,000 per year from NES as part of a $1.1 million payout for his "client base." Griles has played a key role in decisions affecting the Clean Air Act, oil and gas leasing on the Outer Continental Shelf, coal bed methane development in Wyoming's Powder River Basin, and wetland permit rules. While a lobbyist, Griles represented oil, gas and coal clients with interests in these same issues.

Interior Department halts future wilderness consideration On April 11th, Secretary of Interior Gale Norton entered into a settlement with the state of Utah that directs the BLM to immediately stop further consideration of wilderness on as much as 220 million acres of public lands across the United States including over 13 million acres in Oregon. The settlement abolishes the BLM's Wilderness Inventory handbook and reverses a 25-year old practice of encouraging the BLM to consider wilderness qualities on public land before allowing it to be developed for other uses such as oil and gas drilling, mining, off-road vehicles, and logging. ONDA has worked with dozens of volunteers over the past couple years and has used the handbook to conduct a citizen's wilderness inventory of over 560,000 acres on public lands throughout southeast Oregon including areas such as Steens Mountain and the Alvord Desert. The settlement not only takes away the public's ability to participate in the protection of BLM wilderness but also removes protection from several wilderness study areas in Eastern Oregon. Kennewick Man belongs to American Indians and they can block any future scientific tests on the ancient bones, the Department of the Interior declared Monday. As a result, the Corps of Engineers announced it would deny the requests of eight scientists to further study the remains an issue that will be settled by a federal judge. Based on tribal oral history and where the remains were found, the Interior Department made a "close call" that the bones are culturally affiliated with modern Northwest tribes that have claimed them under the Native American Graves Protection and Repatriation Act. "This is all that the tribes have been asking for the right to take care of their ancestral remains," said Adeline Fredin, manager of the history and archaeology department of the Colville Confederated Tribes in Nespelem. "Let him come home to his people."

For more information, contact National Partnership Office Desk Officer Ella Ennis The Colorado Rural Development Council The Utah Rural Development Council , serving as the Vice Chair for the Southwest Utah Planning Authorities Council (SUPAC), helped develop a Memorandum of Understanding (MOU) among the US Forest Service, the National Park Service, the Bureau of Land Management, and the State of Utah to deal with Wild and Scenic Rivers designations in Utah. This MOU formalizes the cooperative relationship among the parties to conduct studies of Utah's rivers for potential designation under the Wild and Scenic Rivers Act. It confirms commitments to coordinate Federal processes conducted for planning activities; to share data and planning resources between State and Federal agencies; and, where appropriate, to coordinate public education and information outreach programs. This MOU eliminates duplication of effort and reduces the likelihood of conflicting goals among agencies on this issue in Utah.

World US Interior Department cancels drilling off Florida coast but sells leases in Eastern Gulf of Mexico Succumbing to Congressional defeat and widespread public hostility, Secretary of the Interior Gale Norton has announced that drilling for oil and gas will not take place off the Florida coast, but much further out into the Gulf of Mexico. Norton made the announcement on 2 July, following a heavy Congressional defeat (see related story ), over proposals central to the Bush Administration’s energy plan to expand development of national fossil fuel reserves (see related story ). However, drilling will be permitted in a portion of the Outer Continental Shelf, also known as Sale 181. “We have listened and worked carefully with officials and affected citizens around the 181 lease area,” Norton said. The outcome, she said was “a balanced and common sense proposal”, which has adjusted the area for exploration from 5.9 million acres to 1.5 million acres, all of which is at least 100 miles from any portion of the Florida coast. The 181 Area will help the US reduce its dependence on foreign oil and helps to meet the President’s “commitment to develop our nation’s energy needs in an environmentally safe way”, she said. The Department projects the adjusted area contains 1.25 trillion cubic feet of natural gas - enough to serve one million families for 15 years – as well as 185 million barrels of oil - enough to fuel the automobiles of a million families for nearly six years.

Petition Filed Under the Federal Airborne Hunting Act
WASHINGTON, DC Today Defenders of Wildlife submitted a petition to Secretary of Interior Gale Norton requesting that she issue regulations clarifying that the Federal Airborne Hunting Act does not allow the use of aircraft to kill wolves for the purpose of boosting game populations. The petition was generated in response to the recent issuance of permits by the Alaska Department of Fish and Game to private hunters that would allow them to kill wolves from airplanes in an area about three times the size of Yellowstone National Park. The permits are part of an Alaska program that the state hopes will artificially increase moose populations for hunters. "Governor Murkowski and the Alaska state legislature have resumed the practice of hunting wolves from airplanes despite the fact that voters in the state have twice passed ballot initiatives banning the practice," said Joel Bennett, Defenders of Wildlife Alaska spokesperson. "Our efforts to address this issue with Alaska’s leaders have fallen on deaf ears, leaving us no choice but to turn to the federal government for help." The petition summarizes the legislative history of the Federal Airborne Hunting Act, which clearly demonstrates that killing predators to increase game populations is illegal under the Act. The Act was enacted in 1971 principally to curtail the airborne hunting of wolves in Alaska. The Act provides a limited exception for persons operating under the authority of a state "to administer or protect or aid in the administration or protection of land, water, wildlife, livestock, domesticated animals, human life or crops."

Defenders Sues the Interior Department
to Protect the Endangered Sonoran Pronghorn. Filing Coincides with Congressional hearing on military use of the Goldwater Range in Arizona
Washington, D.C. Defenders of Wildlife will file suit today in Federal District Court alleging that several federal agencies are violating the Endangered Species Act (ESA) and the National Environmental Policy Act (NEPA) by failing to protect the highly endangered Sonoran pronghorn antelope in southern Arizona. The legal complaint targets the U.S. Fish and Wildlife Service (FWS), the agency charged with implementing the ESA, and the Bureau of Land Management (BLM), the agency that manages the land in much of the pronghorn's remaining habitat, including the Barry M. Goldwater Range in Arizona. Both agencies have repeatedly failed to take the steps necessary to conserve and protect the Sonoran pronghorn and to establish or implement adequate recovery programs for the species. The Department of Defense, which jointly manages the range, is not named in the lawsuit. This suit comes at a crucial time for the pronghorn. As early as this summer, Congress will consider renewal of the military withdrawal from the Barry M. Goldwater Range. This action could afford some protection for the pronghorn's habitat from the fragmentation and urbanization problems increasingly found throughout the Southwest, but only if done correctly.

June 29, 2001 CAPPS CALLS ON INTERIOR DEPARTMENT TO FOLLOW COURT RULING ON OIL MMS Goes Forward with Development of Offshore Oil Leases Despite Court Decision Washington, D.C. - Congresswoman Lois Capps today sent a letter to Interior Department Secretary Gale Norton urging the Department to follow a court ruling which halted the development of 36 offshore oil leases off the coast of Santa Barbara County. Last Friday, U.S. District Judge Claudia Wilken ruled that all federal activities on the leases must cease, pending approval of the plans by the state of California. “This issue is about states’ rights,” said Capps. “California must have the right to review any decisions relating to oil and gas drilling off its coasts. A court of law has agreed and the federal government must follow the law. The Interior Department doesn’t seem to be adhering to the order and this is wrong.” The Mineral Management Service (MMS) informed Capps’ office that it plans to continue its activities to bring these leases to development, including holding scheduled public scoping meetings and other related activities. These actions appear to run directly counter to the judge’s order that MMS “…direct suspensions of the 36 leases , including all milestone activities, for a time sufficient for it to provide the state of California with a consistency determination…” (emphasis added).

Interior Department Fires Whistleblower

WASHINGTON - The Interior Department has fired an employee who told a court investigator that the department was failing in its duty to protect the Navajo Indians from being cheated by oil and gas companies.
Kevin Gambrell, who had been head of the Farmington, N.M., Indian Minerals Office since 1996, said he protested for six years that Navajo landowners were not receiving fair compensation for the use of their land, but he was ignored.
This year, he contacted Alan Balaran, an investigator appointed by a federal judge presiding in a class-action lawsuit against the Interior Department. The suit alleges that the department has mismanaged Indian money for more than a century.
Balaran filed a report last month that said private landowners near the sprawling Navajo Nation were paid, in some cases, 20 times what the Indians were being paid.

The Department of the Interior's U.S. Fish and Wildlife Service is contributing $200,000 to assist states and territories with local projects to protect coral reefs and the species that depend on them, Assistant Secretary of Interior for Fish and Wildlife and Parks Craig Manson announced at the 10th meeting of the U.S. Coral Reef Task Force. "Coral reefs are among the world's most imperiled ecosystems they are the next rainforests in terms of threats from human development," said Manson, the co-chair of the task force. ... Chambers Gets 45-Day Stay During Investigation Washington (AP) - The Interior Department says the gag order against suspended U.S. Park Police Chief Teresa Chambers was never lifted - and she did a recent round of interviews without permission.
A Interior Department spokesman tells The Washington Post that Chambers was given permission in February to speak at one particular event and that she may have misinterpreted it as blanket permission. Chambers spoke to reporters last week. She said she had permission, as long as she didn't discuss the events leading up to her suspension in December.
Chambers was suspended after saying publicly that her 620-member force was underfunded and overstretched by new guard duties on the Mall. The National Park Service is now trying to fire her.

By Stewart Truelsen If this were true, the hue and cry over it would never end. At the very least, there would be congressional hearings into the despicable scheme. But in truth this really did happen; only the perpetrators were an environmental organization seeking to intimidate Interior Department employees. In 1996, Clinton used the Antiquities Act of 1906 to designate the Grand Staircase-Escalante National Monument in Utah. The fight over that designation is still going on. Lawyers for an association of Utah counties have asked a federal judge to abolish the monument. The contention is that Clinton misused the act to designate wilderness areas, a power rightfully belonging to Congress. Interior Department employees do not need to report to Big Environmental-Brother to do their jobs well.
