    WDR / Intelecon Regulatory News WDR Home Indonesia: Government yet to establish regulatory body 14 February 2003 – According to a report by The Jakarta Post , there have been calls from industry representatives for changes to the current telecommunications law so that an independent regulat ory body can be established.
    Jamhari Sirat, Director General of Post and Telecommunications at the Ministry of Transportation said that Telecommunications Law No. 36/1999 makes the ministry the regulat ory body for telecommunications, while the Independent Regulat ory Body (IRB) functions only as an advisor to the Ministry. Several key industry players want the IRB, which would include representatives from government, industry and telecom specialists, to be a powerful agency with the authority to influence telecommunications policy, protect consumers with regard to pricing and maintain healthy competition.
    The establishment of the IRB has become a difficult issue for years as the industry keeps pushing the government to establish the agency, while the government keeps delaying surrendering its hold on the sector. The latest controversy results from the directorate general’s statement last week that there was no need to set up the IRB as the law only stipulated that the IRB "can" give input to the ministry. The IRB thus would be ineffective.
    On the same day, the World Bank countered the government’s statement by saying that the IRB should be established to ensure healthy competition in the country's telecommunications sector. Independent regulatory bodies have proven their effectiveness in many other countries, the bank said.
