May 13, 2004 - India's ruling Hindu nationalist party conceded electoral defeat today, opening the way for Sonia Gandhi to become India's first foreign-born leader and restoring her family's dynasty to power in a dramatic political upset in the world's largest democracy. Unofficial results indicated that millions of rural poor people abandoned Prime Minister Atal Bihari Vajpayee, believing they had been left behind by the country's economic boom and rejecting his Hindus-first message in favour of the secularism of Gandhi's Congress party. Vajpayee was expected to resign later today. His decision to call the election six months early was a devastating miscalculation. "We have not got the mandate of the people," said Venkaiah Naidu, president of Vajpayee's Bharatiya Janata Party, adding that the decision to concede defeat was taken at a 90-minute meeting of the BJP and its allied party leaders. The opposition Congress party and its allies had earlier claimed victory and declared that Sonia Gandhi, who was born in Italy and is the widow of assassinated Prime Minister Rajiv Gandhi, would be the next leader.

NEW DELHI, India (CNN) The party headed by Sonia Gandhi said Tuesday it had enough support to form a new Indian government, but Prime Minister 's ousted coalition immediately challenged the claim. The Congress Party will be ready to form a new government by Wednesday, party officials said, after the lower house of parliament votes on a national budget, a priority of President K. R. Narayanan. A spokesman for the party said after three days of maneuvering it had letters of support from the parties that helped it bring Vajpayee down over the weekend. But it remained unclear whether the Congress Party would have enough support to form a minority government with the alliance of regional, leftist and caste-based opposition groups with which it joined to defeat Vajpayee. None of the parties on which Congress Party would rely for a majority of 272 lawmakers confirmed their support, and a leader of one 20-deputy group denied it had sent a letter of support.

in our Constituent Assembly this twenty-sixth day of November 1949, do hereby Adopt, Enact and Give to ourselves this Constitution. * The words "Socialist Secular" and "the unity and the integrity of the Nation", were added by the 42nd Amendment. As the world's largest democracy, Indian government rests on: the central parliament and state legislatures, the judiciary and the executive. Each one functions independently, however, all of them are interlinked and operate under the parameters defined by the Constitution. India's government consists of a central government and state governments. The central government has exclusive authority, which include foreign policy, defense, communications, currency, taxation on corporations and nonagricultural income, and railroads. State governments have the sole power to legislate on such subjects as law and order, public health and sanitation, local government, betting and gambling, and taxation on agricultural income, entertainment, and alcoholic beverages. On some issues both the union government and state governments may legislate, though a union law generally takes precedence. Among these areas are criminal law, marriage and divorce, contracts, economic and social planning, population control and family planning, trade unions, social security, and education. Matters requiring legislation that are not specifically covered in the listed powers lie within the exclusive domain of the central government.

Child Labor and India A proactive policy towards eliminating child labor India has consistently followed a proactive policy to tackle child labor, and has adopted constitutional, statutory and developmental measures with a view to eliminating it. The Indian Constitution prohibits the employment of children in factories, mines or other hazardous employment (Article 24); enjoins the State to direct its policy towards securing that children are not abused, that citizens are not forced by economic necessity to enter avocations unsuited to their age or strength (Article 39 (e)); that children and the young are protected against exploitation and moral and material abandonment (Article 39(f)); and requires provision of free and compulsory education to children up to the age of 14 years (Article 45). Indian labor laws are in compliance with ILO Conventions on child labor to which India is a Party. India has ratified six ILO Conventions relating to child labor (see Annex A) and played a leading role in the adoption of ILO Convention No. 182 on Elimination of the Worst Forms of Child Labor at the 87 th Session of the International Labor Conference in Geneva in June 1999.
