Wahid cleared but impeachment still likely
Wahid is running out of time, and options JAKARTA, Indonesia Indonesian prosecutors have cleared President Abdurrahman Wahid of wrongdoing, but moves to oust him are expected to persist. Attornery-General Marzuki Darusman cleared Wahid of any involvement in two graft scandals late Monday. Wahid's involvement in the corruption cases triggered moves to impeach him. But Wahid's clearance is unlikely to derail pressure to oust him because the criticism has moved to a more general attack on his erratic leadership. Parliament has so far issued two motions of censure against the president one for his alleged involvement in two high-profile corruption cases and another for failing to meet key policy targets set by parliament. The Impeachment of Andrew Johnson
Only one president in U.S. history has been impeached by the House of Representatives: Andrew Johnson in 1868. At his trial in the Senate, Johnson escaped conviction by a single vote. In the election of 1864, Abraham Lincoln, a Republican, chose Senator Andrew Johnson, a Tennessee Democrat, as his vice-presidential running mate. Lincoln believed that Johnson, the only senator from a rebel state to remain loyal to the Union, would help persuade Democrats to vote Republican. After Lincoln was assassinated, Andrew Johnson took the oath of office on April 15, 1865. Two profound questions faced the nation. First, under what conditions should the Southern rebel states be readmitted into the Union? Second, what rights should the freedmen, or ex-slaves, have? A little over a month after becoming president, Johnson began executing his plan for reconstructing the South. Johnson pardoned all rebels except Confederate leaders. He also restored all rebel property except for slaves. Finally, he authorized each rebel state to call a convention of white delegates to draw up a new constitution. Once completed, a new state government could then be formed, and the state could apply for readmission to the Union.

A Constitutional Primer
by Jason J. Vicente Jason J. Vicente is a recent graduate of the Boston University School of Law and is presently a law clerk at the Massachusetts Superior Court in Boston. Executive Summary As the scandal surrounding the Clinton administration grows, the possibility of impeachment looms ever larger. It is an appropriate time, therefore, to examine the function and history of the impeachment provisions of the American Constitution. The Constitution divides the impeachment power between the two houses of Congress. The House of Representatives has the "sole Power of Impeachment" while the Senate has the "sole Power to try all impeachments." That division of responsibility guards against potential abuse of the impeachment power. Only the House can initiate the impeachment process. But the Senate determines if the charges are appropriate and if the evidence warrants conviction. Over the course of American history, the House of Representatives has impeached 15 individuals, including a president, 12 judges, a senator, and a Cabinet member. The Senate has convicted 7 of the 15.

Committee on Federal Legislation These events raise two fundamental questions. First, what conduct merits impeachment of a sitting President? Second, may Congress, if it chooses, respond to allegations of Presidential misconduct with some less drastic alternative to impeachment and, upon conviction, removal from office? The Association’s view as to the first issue is set forth in a Watergate-era report of this Committee, " The Law of Presidential Impeachment ." In this report, we address the latter question. The Committee on Federal Legislation concludes that Congress may, indeed, constitutionally respond to alleged Presidential misconduct by means other than the impeachment process. Either House of Congress, or both, may pass a resolution condemning or disapproving presidential conduct. (This report will adopt the term "censure" to describe such resolutions generically, although Congress need not use that term.) We believe Congress may censure Presidential misconduct irrespective of whether such conduct would, in fact, merit impeachment. Such censure, by itself, of course carries only the moral weight of expressed congressional condemnation, however heavy that weight may be.

For only the second time in the history of our nation, Congress and public are giving serious attention to the possibility of impeachment and removal of a President. The Executive Committee of this Association, among others, urged that Congress proceed to "investigate whether or not impeachment proceedings should be instituted" against President Nixon.* Yet there is little general knowledge of the substance and procedure of this seldom used constitutional authority. In the interest of informing the Bar and the public, and without taking any position on the evidentiary matters involved in the current impeachment controversy, we have undertaken to prepare this brief analysis of the applicable law. The report expresses our views on the controverted legal issues concerning proper grounds for impeachment and the availability of judicial review of the proceedings in Congress. (We shall use the term "impeachment" primarily in the technical sense, to refer to the action by the House of Representatives stating charges against a public official, rather than in the common parlance, by which the term refers to the entire process of impeachment, trial and removal.)

A gaping, smouldering hole in the financial center of our greatest city. George W. Bush passing himself off as a patriot, even as he disassembles the Constitution with the voracious glee of piranha skeletonizing a cow. "There is no opposition party," Republican congressional leader Trent Lott chillingly announced as Democratic counterpart Tom Daschle watched in silent, cowed assent after Bush's speech to a joint session of Congress. And even if it's mainly the result of our pathetic desire to follow someone anyone in the aftermath of Sept. 11, there's little opposition out in the cities and towns across our vast continent: Bush's job-approval rating is hovering up there with puppies and sunny days. It may have seemed meaningless at the time, but now we know why 7,000 people sacrificed their lives so that we'd all forget how Bush stole a presidential election. And as it turns out, national amnesia was only the beginning.

Indonesia party backs off early impeachment
There have been hopes that Wahid and Megawati can mend their relationship, which has been increasingly cool By staff and wire reports JAKARTA, Indonesia Indonesia's biggest political party has backed away from efforts to bring forward an impeachment hearing against embattled President Abdurrahman Wahid, local media reported. Earlier, some legislators in the Indonesian Democratic Party-Struggle (PDI-P) of Vice President Megawati Sukarnoputri had said the impoverished country was too volatile to wait until the August 1 impeachment session, the date originally planned. However, after a meeting on Tuesday, the party decided there was no firm constitutional basis for speeding up the hearing, The Jakarta Post reported. Meanwhile, Defense Minister Mahfud MD one of Wahid's senior ministers tasked to lobby major opposition parties to prevent the impeachment process told reporters on Wednesday that the lobbying team has finished its work. ALSO Australia prepares for Wahid's visit "The response is generally positive," he said, as quoted by detikcom news portal, without giving any more details.
