Judicial, Legal and Law Enforcement Training Opening the Bench and Bar to People with Disabilities Access to the legal system is a basic necessity in our society. Most people with disabilities want to participate in the legal system - as jurors, witnesses, litigants, attorneys or judges. In addition to participating in the legal system, people with disabilities seek legal representation for other purposes such as buying a home, obtaining a divorce, drafting a will or planning for retirement. In some cases, however, physical, attitudinal or informational barriers keep them from participating in the legal process or obtaining legal representation. The Attorney General appointed a committee to review the needs of people with disabilities in a legal setting and recommend a plan of action. The committee established the four goals listed below. The Attorney General met with the Chief Judges of the circuit courts who endorsed the project. Products of the project include:
  • A pamphlet for attorneys describing their obligations to accommodate people with disabilities under state and federal law. The pamphlet is distributed to interested/affected parties.

Since so much has been going on, I've decided that I'll try to keep some sort of running log of what is currently happening. The newest stuff is at the top of the page. I'll try to keep it up-to-date. 9/22/03 - On Wednesday, September 10th, members of the computer security industry and law enforcement testified before a subcommittee of the House Committee on Government Reform in a panel entitled Worm and Virus Defense: Can We Protect the Nations Computers From These Threats? Once again, the litany of "write more secure software" and "patch, patch, patch" was presented. After several phone calls and emails and discussions with the subcommittee staff, I was invited to present written testimony to the committee. Needless to say, my proposal for what steps should be taken differed radically from those proposed by the other members of the panel. Read it for yourself. 9/15/03 - I was interviewed as part of a story by Larry Abramson of NPR on methods to slow and stop the spread of internet worms. I find myself really annoyed at the public consensus that the only way to combat worms is to "write better, more secure software" and have "ubiquitous patching." Certainly we need to have more secure code, but that is a long term goal, while the danger to our infrastructure presented by network malware exists today. Patching vulnerabilites is a key, and the speed with which those patches are applied is critical, but anyone who believes that companies will roll out untested patches on critical systems is dreaming. Unless we find some way to insure that patches don't create more problems than they cure, this will never happen, and fixing these issues is again, a long term goal. At present Illinois has three operational Tax Increment laws. They are: The Tax increment Allocation Redevelopment Act (65 ILCS 5/11-74.4.1 etc.) This is Illinois’ original and most frequently used TIF law. It was approved in 1977 and has been amended frequently since that time. A major reform of this statute was approved by the General Assembly this spring (1999), was signed by Governor Ryan on August 11, 1999 and will become law on November 1, 1999. The Industrial Jobs Recovery Law (65 ILCS 5/11-74.6-5 etc.). The Illinois General Assembly enacted this law in 1994. It differs from the basic TIF law, cited above, primarily because it focuses on industrial projects in areas of high unemployment and on properties in need of environmental cleanup rather than restoring "blighted" or "Conservation" areas. The law, as enacted, contained a 6-year sunset provision that would terminate the law in 2000 unless extended by the General Assembly. The General Assembly recently renewed the law through the year 2010 while adding many of the same reforms applied this year to the basic TIF law. For first time in Illinois, new law recognizes rights of innocent victims of crime A YOUNG man sitting on a Chicago porch with his date sees an armed robbery taking place at the gas station next door. The robber spots him, fears recognition, fires, and kills the youth — A man, visiting a friend, is knifed in a hallway — An elderly woman, walking alone, is held up and beaten — All are innocent victims of crimes. Under a new Illinois law, they and similar victims who qualify are eligible to receive compensation from the Stale. The law provides for withholding names or details where necessary to protect the innocent or where the interests of justice require. Claims are processed before the Illinois Court of Claims by the Office of the Attorney General, William J. Scott. $10,000 maximum amount
"Basically, the law compensates innocent victims of crimes or their dependents for medical and related expenses and loss of earnings up to $10,000 per claim," said Saul R. Wexler, assistant attorney general and chief of the Attorney General's Court of Claims division. The Crime Victims' Compensation Act of 1973 provides compensation for certain unreimbursed losses resulting from a crime of violence: medical and hospital expenses, loss of earnings up to $500 per month, and loss of future earnings because of disability, with a maximum of $500 per month.

Attorney General's office administers program through Court of Claims to get all records he requests, including those from police, medical, employment, and insurance sources. Once an applicant decides to file, he must notify the Attorney General's office in writing of his intent. He has six months from the date of injury to do this. Completed applications must be filed with the Court of Claims in Springfield within two years from the date of injury. "Certain situations exclude applicants from compensation," Wexler said. "They can't get compensation if the victim and his assailant are related or sharing the same household; if the injury or death of the victim was substantially caused by his own wrong act; if the victim substantially provoked the assailant; if financial loss is not over $200; or if the applicant has not cooperated fully with law enforcement officials in the apprehension and prosecution of the assailant." How does the Illinois experience compare with that in other states having similar laws? "When our law was drafted," Wexler said, "we studied what was happening in New York and California. Like Illin6is, they are large states with a large urban population. New York, where a compensation law took effect in 1967, had 196 claims tiled during its first year. In the past year, they've had 2,000 claims filed - more than half of them as a result of mugging. They have a backlog now of just under 1,000 claims. California initially had 169 claims. At the close of last year, there were 838 claims pending there that hadn't been resolved.
