Defending Your Rights
Labor and Employment Rights Attorney General Lisa Madigan advocates, legislates and litigates for Illinois workers and labor unions. Madigan appointed the state's first Labor Liaison shortly after taking office. The Labor Liaison provides a line of communication between the Attorney General's office and the working families in the state of Illinois. The Attorney General's Labor Liaison goes out to meet the workers of Illinois to inform them of the services and programs that the Office provides and then reports back on the issues that the state's unions and working people find most relevant. The Liaison also provides referrals within the Attorney General's office or around the state and is the state's advocate for the rights of the working family. The Office of the Attorney General also is responsible for prosecuting cases referred from the Illinois Department of Labor. Madigan's Labor Law Unit in the General Law Bureau handles about 1,500 of these cases. Referrals to the Attorney General's office concern violations of the Illinois Minimum Wage Law, the Illinois Prevailing Wage Law and the Illinois Wage Payment and Collection Act. The Labor Law Unit also enforces the Department of Labor's administrative subpoenas when the Department of Labor attempts to investigate Prevailing Wage Act violations. Additionally, the Attorney General's Labor Law Unit defends claims of age, sex or race discrimination and other employment-related allegations brought by current or former state employees against their employing agency or other individual agency employees.

Illinois has three branches of government; executive legislative and judicial
The executive branch, is headed by the Governor The Lieutenant Governor is elected with the Governor. The Lieutenant Governor helps the Governor do his/her job. The Lieutenant Governor may also have programs of his/her own. The Attorney General is the state's chief lawyer. The Attorney General is the lawyer for all of the elected state officials, departments and agencies. The Attorney General also is responsible for protecting the people of Illinois from things such as pollution, fraud and crime. The Secretary of State has a very interesting job. The Secretary of State is responsible for maintaining all of the official state records and the state seal. In addition, the Secretary of State issues all driver's licenses and license plates. The Secretary of State serves as the state librarian. Sometimes people get the Comptroller and the Treasurer mixed up. The Comptroller is the chief financial officer for the state and is responsible for keeping track of the state's money. The Treasurer is the state's banker. The Treasurer decides where the state should invest its money. The legislative branch consists of the Illinois House of Representatives and the Illinois Senate. The House of Representatives consists of 118 members. The members are elected by the people in their district or area of the State. A Representative serves a 2-year term. The Senate has 59 members who are elected from districts throughout the State. A Senator serves a 4-year term. Together, the House and the Senate are known as the General Assembly. The General Assembly makes the laws for the State of Illinois.

Chicago, IL, June 27, 2003 - The Illinois Coalition for Competitive Telecommunications (ICCT) today praised Illinois Attorney General Lisa Madigan for filing a motion with U.S. District Court requesting that the Illinois Commerce Commission (ICC) become a nominal party in the highly controversial court battle over the SBC-backed Senate Bill 885. The Attorney General's motion would excuse the ICC from any briefing or pleading requirements in the court proceeding and states that the ICC will abide by the June 9th preliminary injunction granted by Judge Kocoras, and that the Illinois Attorney General "will not defend the newly-enacted provisions of the Public Utilities Act." Senate Bill 885, legislation that would allow SBC to significantly raise local wholesale phone rates, was rammed through the Illinois General Assembly and signed into law in just 96 hours. The law has not yet taken effect because SBC's competitors and consumer groups have challenged the measure in federal court. In a recent victory for Illinois consumers, Judge Kocoras issued a preliminary injunction to block the ICC from implementing the significantly higher wholesale local phone rates dictated by SB 885 until the constitutionality of the law is determined.

Frequently Asked Questions
- Illinois General Divorce Information FAQ's -
  • Does it matter who files first? It does not typically matter who is the first to file a case. The person who files the case is known as the Plaintiff and the other party is known as the Defendant. By filing the case, the Plaintiff will ultimately have the opportunity to go first if the case cannot be settled, at trial. There may be a slight advantage to being in this position. However, since 90% of all cases settle prior to going to trial, this is not a sufficient reason for you to be concerned with filing first. Additionally, it costs approximately $100.00 more in court costs to be the Plaintiff than the Defendant.
  • How long does the divorce last? Each case is unique and there is no simple formula for determining the length of the case. The more issues that are unresolved and the more the parties disagree, the longer the case will take. Typically, from the point of reaching a settlement, it takes approximately one month to have the paper work completed and to obtain a final court date. If the case cannot be resolved and will need to go to trial, the case will take a minimum of approximately one year to complete. On average, however, most cases even if they are tried, will be resolved within eighteen months.
  • Can I date during the proceeding?

New Illinois Laws on Child Passenger Protection Boosters Save Lives. According to the Partners for Child Passenger Safety "Using a BPB [Belt Positioning Booster] with a seat belt instead of a seat belt alone reduces a child's risk of injury by 59%." Don't let more Illinois children become statistics. According to the Centers for Disease Control and the National SAFE KIDS Campaign , motor vehicle crashes are the #1 killer of kids ages 1-14. Most of these "statistics" were unrestrained or improperly restrained. Appropriate laws can help encourage parents to protect their children from the #1 danger to their young lives. Parents should note that the legal age and weight guidelines are not always adequate to insure the safety of their children. Kids don't fit well in seatbelts made for adults. If the seat belt does not fit right, kids will often slouch, lean, pull on the seatbelt or put the shoulder belt behind their arm or back. That can lead to serious abdominal and head injuries. A five-step test for proper fit is the best way to make sure a child is as safe as possible. A booster seat makes sure the seatbelt fits properly. They are available at many stores, with some models starting under $20. Regardless of the state law, the laws of physics show that children are much safer when they are appropriately restrained. If you would like more help with selecting or using a booster, please visit these

In comparison to federal legislative history documentation, there are far fewer sources to determine legislative intent for Illinois legislation. One good (but dated) source about Illinois legislative research is Wendt, Illinois Legal Research Manual (St. Paul: Butterworth Legal Publishers, 1988) (R,REF KFI 1275. W4 1988). Chapter Six discusses Illinois Legislative History. This chapter originally appeared at 1982 Southern Illinois University Law Journal 601. An additional authoritative resource is the following: Researching Legislative History by Richard C. Edwards, Illinois Legislative Reference Bureau.
    LEGISLATIVE HISTORY RESEARCH STEPS:
Determine the Appropriate Statute To Be Researched To trace the legislative history of an Illinois statute it is necessary to obtain a copy of the statute and determine the particular Illinois public act that was the source for the section that you want to research.
