Firearm Owner's Identification Information
In 1968, Illinois enacted legislation to promote and protect the health, safety and welfare of the public by providing a system of identifying persons who are not qualified to acquire or possess firearms and firearm ammunition within the State of Illinois. The Firearm Owner's Identification (FOID) Act established a practical and workable system to identify persons prohibited by Section 24-3.1 of the "Criminal Code of 1961" as amended, from acquiring or possessing firearms and firearm ammunition. The Illinois State Police was given the responsibility of administering the Act. There are approximately 1.2 million valid FOID card holders. Approximately 210,000-220,000 applications are processed annually by the Firearms Services Bureau. In 2002, 4,642 applications were denied and 6,926 FOID cards were revoked as a result of the extensive review process which identifies individuals whom are prohibited from possessing or acquiring firearms and firearm ammunition. All Illinois residents who buy or possess firearms are required by law to have a valid FOID card. FOID applications can be obtained from any firearm's dealer, law enforcement agency, or printed from the Internet. To obtain a FOID card, complete an application and forward it along with a $5.00 fee and a photograph to the Illinois State Police, Firearm Owner's Identification Unit, Post Office Box 19233, Springfield, Illinois 62794-9233.

History
Illinois is the first state to prohibit voting and jury service by anyone convicted of sodomy. The Illinois Supreme Court becomes the first in the nation to uphold a sodomy conviction for an act of fellatio. The Court had to use an obscure law that denied civil rights to anyone convicted of “sodomy or other crime against nature.” This, the Court said, made it clear that there were many different crimes against nature. The Illinois Supreme Court becomes the first in the nation to hear a sodomy conviction appeal for an act of cunnilingus. Just 16 years after saying that fellatio violated the law, the Court went the double-standard route and found that cunnilingus did not violate the law. In enacting a comprehensive criminal code revision, Illinois becomes the first state in the nation to repeal its consensual sodomy law. Bowers v. Hardwick

"The existence of such an offense is a disgrace to human nature." The Post-Revolution Period, 1776-1873 After the Revolution, Illinois, as part of the original Northwest Territory, received the English buggery law with a 1795 Northwest Territory ordinance, thus making sodomy a capital offense for males only. In 1809, the Illinois Territory was created and a statute adopted all laws of the Indiana Territory, in place of the Northwest Territory law. The harsh code of Indiana adopted by Illinois provided for a penalty of up to five years in prison, a fine of $100-$500, and up to 500 lashes. This statute remained until a new law was adopted after statehood. In 1819, a law was adopted to revise criminal penalties. The sodomy penalty was changed slightly to set the jail term at 1-5 years, and the flogging penalty at 100-500 lashes. The fine remained unchanged. A supplemental law adopted the common law of England and all English statutes in support of the common law adopted prior to the Jamestown settlement.

Criminal Identity Theft and Assumption Deterrence Act
In October 1998, Congress passed the Identity Theft and Assumption Deterrence Act of 1998 (Identity Theft Act) to address the problem of identity theft. Specifically, the Act amended 18 U.S.C. § 1028 to make it a federal crime when anyone: knowingly transfers or uses, without lawful authority, a means of identification of another person with the intent to commit, or to aid or abet, any unlawful activity that constitutes a violation of Federal law, or that constitutes a felony under any applicable State or local law. Violations of the Act are investigated by federal investigative agencies such as the U.S. Secret Service, the FBI, and the U.S. Postal Inspection Service and prosecuted by the Department of Justice.

The Criminal Code of 1961 is amended by adding Section 12-7.5 as follows: (720 ILCS 5/12-7.5 new) Sec. 12-7.5. Cyberstalking. (a) A person commits cyberstalking when he or she, knowingly and without lawful justification, on at least 2 separate occasions, harasses another person through the use of electronic communication and: (1) at any time transmits a threat of immediate or future bodily harm, sexual assault, confinement, or restraint and the threat is directed towards that person or a family member of that person, or (2) places that person or a family member of that person in reasonable apprehension of immediate or future bodily harm, sexual assault, confinement, or restraint. (b) As used in this Section: "Harass" means to engage in a knowing and willful course of conduct directed at a specific person that alarms, torments, or terrorizes that person. "Electronic communication" means any transfer of signs, signals, writings, sounds, data, or intelligence of any nature transmitted in whole or in part by a wire, radio, electronmagnetic, photoelectric, or photo-optical system. "Electronic communication" includes transmissions by a computer through the Internet to another computer. (c) Sentence. Cyberstalking is a Class 4 felony. A second or subsequent conviction for cyberstalking is a Class 3 felony. Section 99. Effective date. This Act takes effect upon becoming law. Passed in the General Assembly May 08, 2001. Approved August 01, 2001.

California's Castration Law
California's new law mandating castration for certain sex offenders was passed on Aug 30, 1996, and became part of the criminal code on Jan. 1, 1997. According to this law (chapter 645 of the penal code) offenders convicted for the second time of rape, oral copulation, sodomy, or lewid or lavicious acts in cases in which
"the victim has not attained 13 years of age, shall, upon parole, undergo medroxyprogesterone acetate treatment or its chemical equivalent, in addition to any other punishment prescribed for that offense or any other provision of law."
There are several problems with this law:
  • There is no provision that the state prove that this treatment will actually prevent recidivism.
  • There is no rationalle provided to explain why these offenses have been singeled out over others.
  • The provision that the offender is still subject to "any other punishment prescribed for that offense or any other provision of law." implies that he may still be subject to civil commitment or to mandatory registration. If the castration solves the problem of recidivism, why is he elligible for additinal sanctions? If he is still dangerous and these sanctions are necessary, how is the castration justified? It has never been proven that castration will actually prevent recidivism in sex offenders. Castration has certainly never been linked specifically to sexual acts against children. The etiology of sex offending is complex. There are biological, psychological, social, cognitive factors involved. How does the specified treatment relate to these factors?
