The Appellate Court held that the trial judge lacked jurisdiction to modify defendant's sentence where the State filed a motion to reconsider the sentence nine days after defendant filed a timely notice of appeal. (See SENTENCING

Defendant was convicted of murder and several other crimes, and was sentenced to death. After the convictions and sentence were affirmed on direct appeal, defendant filed a post-conviction petition. After the petition was denied and the denial was affirmed on direct appeal, defendant filed a second post-conviction petition. The trial court denied relief on the second petition, and defendant appealed.
Defendant argued that the trial judge violated due process by ruling on the second post-conviction petition, which alleged that the judge had a conflict of interest at the original trial and sentencing because he knew the victim and had previously prosecuted defendant on a conviction used by the State as impeachment during trial and as an aggravating factor at the death hearing. Defendant also argued that both trial and appellate counsel had been ineffective for failing to raise the trial judge's conflict of interest, the prosecutor had a conflict of interest because she had served as defense counsel on the case in which the trial judge had prosecuted defendant, trial counsel was ineffective for failing to investigate and present evidence that defendant should be found guilty but mentally ill, and trial counsel was ineffective at sentencing for failing to investigate and present evidence concerning defendant's mental deficiency.

Sec. 9-2. Second Degree Murder. (a) A person commits the offense of
second degree murder when he commits the offense of first degree murder
as defined in paragraphs (1) or (2) of subsection (a) of Section 9-1 of
this Code and either of the following mitigating factors are present: (1) At the time of the killing he is acting under a sudden and intense passion resulting from serious provocation by the individual killed or another whom the offender endeavors to kill, but he negligently or accidentally causes the death of the individual killed; or (2) At the time of the killing he believes the circumstances to be such that, if they existed, would justify or exonerate the killing under

(b-5) "Computer services" means computer time or services, including data processing services, Internet services, electronic mail services, electronic message services, or information or data stored in connection therewith.
