Performance-Based Employment Contracts
for Superintendents
June 29, 1998 Contributors
Effective January 1, 1998, employment contracts between Illinois boards of education and superintendents (as well as other administrators) may range in duration from a single year to a multi-year period up to five years. Determining the length of a contract depends on many factors. Their distinguishing features, however, greatly influence the decision to use a single-year or multi-year contract. Under one-year contracts , superintendents gain and retain their tenure rights and are not subject to performance-based contract extension requirements. Thus, a superintendent employed under a one-year contract gains tenure after being employed for two consecutive school terms, or, if first employed after January 1, 1998, after four consecutive school terms. Although a superintendent does not receive tenure in a specific position, a tenured superintendent has the same due process rights as a teacher. Under multi-year contracts , superintendents waive all tenure rights. A multi-year contract must include specific performance-based components. The parties may, by mutual agreement, amend the performance-based contract anytime during a multi-year contract's term. If the performance goals are not met during the contract, the contract may not automatically roll-over, although the parties may enter into a new contract.

    It's important to understand the "residency" requirements of Illinois law contained in the Illinois School Code, 105 ILCS 5/10-20.12b and 105 ILCS 5/14-1.11a, as well as the educational rights of homeless children as embodied in The Education for Homeless Children Act, 105 ILCS 45/1-5 et seq., and the federal McKinney-Vento Act, 42 U.S.C. § 11431 et seq. Waiver of School Fees
    The Illinois School Code requires that one of the duties of local school boards in Illinois is "to waive all fees assessed by the district on children whose parents are unable to afford them . . . ." See 105 ILCS 5/10-20.13. A working knowledge of the law and regulations concerning school fees will give school personnel the opportunity to ensure that low-income children, including children experiencing homelessness, are able to fully participate in curricular and extra-curricular activities.

      • Article X - Education : this short article of the Illinois Constitution authorizes the state's interest in education.
        • Section 1 simply lays out the goals, including provision for "an efficient system of high quality public educational institutions and services."
        • Section 2 empowers a state board of education.
        • Section 3 is Illinois' very own "Blaine Amendment" prohibiting any funding for "sectarian" purposes.     Illinois Schools Legislative Issues Increased Access to School Counselor Services Increased Access to School Counselor services by allowing for additions to the current approach for School Counselor Endorsement To allow more students access to school counselor services we are proposing an additional approach enabling qualified and appropriately trained persons to become certified school counselors. This bill would provide the authority to the Illinois State Board of Education and the Teacher Certification Board to draft rules that would allow for school counselor certification without obtaining an Illinois teaching certificate.
  • School Counselors Certified in other states. It would allow ISBE and the State Teacher Certification Board to establish rules to allow certified school counselors from other states, who have experience as school counselors and equivalent or greater educational experience as Illinois requires, but who do not have teaching certificates in those states, to be certified in Illinois.
  • Counselors who do not have a current teaching certificate. It would allow ISBE and the State Teacher Certification Board to establish rules to allow counselors to become eligible for the Type 73 school counselor certificate if they had a master's degree in counseling and equivalent or greater educational training that meets all current state requirements for school counselors. The person would also need to pass the ISBE School Counselor Examination.

    Higher education in Illinois: a 'system of systems' manages the knowledge industry KNOWLEDGE is power. And our Federal system still lodges major control of the nation's multibillion dollar "knowledge industry" in the state capitals. By any possible measurement of size (dollars appropriated, students enrolled, research carried out, etc.) the knowledge industry developed by Illinois is surpassed by only a couple of other states. The management apparatus which the State has built for operating its share of this industry is both immense and complex. Yet even in the halls of the Illinois legislature and in state executive offices it is difficult to find anyone who can identify the levers of power in this allimportant area of government. As 1975 begins, it is critical that state leaders and a broad section of the citizenry understand how the state supported institutions of knowledge are managed in Illinois. Retrenchment in funding for these institutions and the tremendous increase in operational costs (such as fuel supply) in a time of inflation have generated proposals to update the State's ongoing "Master Plan" for higher education. A major question in Illinois, then, is whether new conditions require dramatic changes in those institutions and agencies which manage this knowledge industry. Higher education: a public utility?
