    The passage of legislation in the Bundesrat
    In keeping with the Basic Law, it is more usual for bills not to require the consent of the Bundesrat in order to become law. In such cases, the Bundesrat may lodge an objection to the bill. Thus the Bundesrat has the right to lodge an objection to most bills adopted by the Bundestag. If the Bundesrat wishes to object to a bill it must first ask the Mediation Committee to convene (for the mediation procedure, see below). The Bundestag can reject an objection from the Bundesrat by an absolute majority, i.e. a majority of its statutory members. (As a rule, the Bundestag adopts bills by a majority of the Members present.) Thus, by holding another vote, sometimes referred to as a "fourth reading", the Bundestag can overcome the opposition of the Bundesrat and open the way for the law to be promulgated. The question of whether the Bundestag is concerned with a bill to which the Bundesrat may lodge an objection or for which its consent is required is thus a key aspect of the legislative process and may determine whether the Bundestag in fact succeeds in having a bill passed. It is, however, not always easy to determine into which category the bill falls. Disagreements on this issue are not uncommon between the Federal Government and the Bundestag on the one hand and the Bundesrat on the other. The Federal Constitutional Court has had to decide more than once whether a bill requires, or should have required, the consent of the Bundesrat. If the Bundesrat fails to give its consent to a bill of this kind, then the bill becomes invalid.

Pierce: Bills to curb ID theft, e-mail spam set to become law
INDIANAPOLIS Consumer protection bills championed by State Rep. Matt Pierce (D-Bloomington) that will help Hoosiers harmed by identity theft and e-mail "spam" are set to become law in Indiana. Pierce said Gov. Frank O'Bannon has signed a pair of measures scheduled to take effect on July 1: House Enrolled Act 1083 , legislation co-authored by Pierce that will require those who send unsolicited electronic mail to make it clear to recipients that the mail is an advertisement. Senders will be required to remove from their e-mail lists the names of those people who no longer wish to receive these ads. If those wishes are not honored, people will gain the right to pursue legal action against spammers through Indiana's deceptive consumer sales laws. Senate Enrolled Act 320 , co-sponsored by Pierce, provides a means for victims of identity theft to ensure tainted credit histories are properly restored and expands the legal definition of identity theft to make prosecutions of the crime easier. "These bills come in direct response to two of the growing concerns facing people across our state in an expanded information age," Pierce said. "Identity theft has become one of the fastest-growing crimes in the U.S., and criminals are finding it easier to locate critical information about potential victims through their computers. E-mail spam has become prevalent as more people use that system to transact personal and professional business."

Virginia state lawmakers, officials and lobbyists are urging Gov. Mark Warner to sign two identical bills that would make murdering a fetus a crime.
The decision on the measures could affect the Democratic governor politically, since he is under pressure from both pro-life and pro-choice groups.
Mr. Warner has until midnight next Friday to act on the bills, which passed the Republican-controlled Legislature by a veto-proof majority. He can sign them, veto them, or allow them to become law without his signature.
Mr. Warner has said he supports the intent of the feticide bills, which were inspired by the murder of Laci Peterson and her unborn child, Conner, in California.
Warner spokeswoman Ellen Qualls said the governor is reviewing the bills.
The bills state that fetal homicide is murder when the person who killed the unborn child did so with malice. Current law requires prosecutors to prove that a person specifically intended to cause harm to an unborn child, which legal experts say is difficult.
The concept received national attention last month when President Bush signed a federal law called the Unborn Victims of Violence Act. Twenty-nine states have similar laws.

The Legislative Process: The Basics
The process by which a bill becomes a law is very involved and highly inefficient. As a result, very few pieces of legislation ultimately become law. In fact, an average of only 5% of the 10,000 to 12,000 bills that are introduced in a Congress become law. The key steps to understand are as follows (please note that this is a very basic overview). 1. Legislation is introduced by a Representative or Senator 2. The legislation is referred to one or more committees and subcommittees by the parliamentarian. Bills introduced in the House are sent to House Committees and subcommittees, and bills introduced in the Senate are sent to Senate Committees and subcommittees. 3. The subcommittee considers the legislation by holding special sessions where witnesses provide testimony about the legislation. These sessions are called hearings. 4. The subcommittee “marks-up” the legislation. In a “mark-up” session, the various members of the subcommittee decide what changes they would like to make to the bill. Controversial changes are voted on.

Congress may soon give Attorney General John Ashcroft the power to take away more of your rights, including your right to free speech unless you act right now. Three American heroes are being forced to plead guilty to relieving the suffering of others by providing medical marijuana to AIDS and cancer patients in California. They face up to twenty years in federal prison for their acts of compassion and you could be next! Scott Imler, Jeff Yablan and Jeffrey Farrington were accused of violating the federal "crack house statute", a law designed to imprison people operating crack houses but which is now being used by the Bush Administration to prosecute people caring for medical marijuana patients. As if this is not bad enough, Congress is now considering two proposed laws the RAVE Act (HR 718) and the Illicit Drug Anti-Proliferation Act (S.226) that would further expand the federal "crack house law" to apply to more people, including home owners and organizers of marijuana rallies. A third proposed law, the CLEAN-UP Act (HR 834), would make it a federal crime punishable by up to nine years in prison to promote any entertainment event in which drug offenses might occur, such as hemp festivals and music concerts.

Immigrants' Rights Update, Vol. 17, No. 4, July 15, 2003 During the 2003 state legislative sessions, approximately 117 bills were introduced that address immigrants’ ability to obtain a driver’s license. Approximately 37 of the proposals sought to expand immigrants’ access to driver’s licenses, and 65 bills sought to restrict access. In addition, 14 bills that affect immigrants—but that don’t directly expand or restrict their access to driver’s licenses—were introduced. As of July 2003, 17 of these driver’s license–related bills have been enacted into law. The bills that seek to remove restrictions do so by, for example, removing Social Security number (SSN), lawful presence, or documentation requirements, which prevent many non–U.S. citizens from obtaining driver’s licenses and automobile insurance. Other proposals include allowing documents, such as the individual taxpayer identification number (ITIN) and consular identification cards, to be accepted as forms of identification. Thus far, Georgia, Hawaii, Kansas, Louisiana, and New Mexico have passed such legislation. Georgia and Hawaii now allow applicants who are not eligible for an SSN to submit documentation from the Social Security Administration stating that they are ineligible to obtain an SSN; Kansas and New Mexico allow applicants to use an ITIN if they are ineligible for an SSN; and Louisiana created a temporary license for immigrants who are employed in the agricultural industry.

Local Bills Vitally Important to Counties
In training courses for county officials and county administrators and engineers, we often talk about the nuts and bolts of getting a local bill through the legislative process and the importance of working with your local legislators to help see the bills become law. However, it is just as important to make sure that the bill is written properly and says what it is supposed to say. It is also extremely important to watch the legislative process carefully to make sure that what you want or what you thought was going to pass is actually the bill that does become law.
In the last few months, ACCA staff have discovered (unfortunately after the fact) several instances where the local bill passed by the Legislature was not quite what it was supposed to be - or did not pass in the manner in which it was supposed to pass. Here is one example:

Targeting the illegal use of Social Security numbers and making it easier for residents to report the crime is among the 180 bills the Legislature has sent to Gov. Janet Napolitano. She has signed 159 bills and vetoed three. Bills become law 90 days after the Legislature adjourns.
Most of the 1,225 bills filed in January when lawmakers convened have either been shelved, are in limbo or are awaiting action during a session that is expected to last several more weeks. Legislators originally had hoped to adjourn by Sunday, the 104th day of the session.
