FAA sets flight restrictions over southern California
Special Washington, D.C., restrictions for President Reagan's services temporary flight restriction over the Simi Valley in southern California Friday, June 11, from 4:45 p.m. local through 8:30 p.m. local during President Reagan's funeral. The FAA has also issued a notam suspending waivers for flight operations in the Washington, D.C., flight-restricted zone (FRZ) Friday from 10:30 a.m. local until 3:45 p.m. during the services for the President. That notam also prohibits flight operations at College Park, Potomac, and Hyde Field airports. OF CHARTER SCHOOL AND NURSING HOME ORGANIZATION ACTIVITIES INTRODUCTION
On September 6, 2000, the Internal Revenue Service (the "IRS") published an article for its Exempt Organizations Continuing Professional Education Technical Instruction Program Textbook, which sets forth the IRS's current position that certain organizations that develop and operate charter schools and nursing homes confer private benefits to their management and development companies and should not be granted exemptions (the "Private Benefit CPE"). This is a reversal of IRS policy. BACKGROUND In general, educational facilities and nursing homes are considered to be trades or businesses, and organizations that engage in the operation or development of such facilities are subject to tax. Section 501(c)(3) of the Internal Revenue Code of 1986, as amended (the "Code"), provides, however, that organizations that engage in the foregoing types of activities may be exempt from federal income taxation if, among other things, they are "organized and operated exclusively for . . . charitable . . . educational" and certain other purposes. Thus, two rules must be complied with in order for an exemption to exist. First, the organization must have a charitable purpose (the "Charitable Purpose Test").

NEW IDENTITY THEFT LAWS WILL PROVIDE ASSISTANCE TO VICTIMS AND LAW ENFORCEMENT
On June 7th, 2004, Attorney General William H. Sorrell and Senators Dick Sears (Bennington) and John Bloomer (Rutland) announced at a press conference in Manchester today that a bill to protect consumers from identity theft has been passed by the Legislature. Governor Jim Douglas is expected to sign the bill into law tomorrow. The bill creates a new crime of identity theft, and provides new tools to assist victims. “Identity theft is a big problem getting bigger both here in Vermont and nationally. The financial losses to victims, both individuals and businesses, are staggering,” said Attorney General Sorrell. Identity theft occurs when a thief takes over a consumer’s entire identity by stealing critical private information (such as SSN, driver’s license number, address, credit card number or bank account number) so that the thief can use the stolen information to obtain illegal loans or credit lines to buy goods or services under the stolen name. Usually the identity thief changes the consumer’s mailing address on new or old accounts to hide his or her illegal activities.
