LIFE EXPECTANCY HITS NEW HIGH IN 2000; MORTALITY
DECLINES FOR SEVERAL LEADING CAUSES OF DEATH
Life expectancy for the U.S. population reached a record high of 76.9 years in 2000 as mortality declined for several leading causes of death, according to preliminary figures from a report released today by HHS' Centers for Disease Control and Prevention (CDC). "Americans on average are living longer than ever before, and much of this is due to the progress we've made in fighting diseases that account for a majority of deaths in the country," HHS Secretary Tommy G. Thompson said. "But we can do even more by eating right, exercising regularly and taking other simple steps to promote good health and prevent serious illness and disease." The estimates are featured in a new CDC report, "Deaths: Preliminary Data for 2000," an analysis of over 85 percent of the death certificates recorded in the United States for 2000. The report shows that age-adjusted death rates continued to fall for heart disease and cancer, the two leading causes of death in the U.S. that account for more than half of all deaths in the country each year. Mortality from heart disease has declined steadily since 1950, while cancer mortality has been on the decline since 1990. Age-adjusted death rates also fell for other leading causes of death, including: homicide, suicide, accidents or "unintentional injuries," stroke, diabetes, chronic lower respiratory diseases, and chronic liver disease and cirrhosis.

Dementia is a medical condition that interferes with the way the brain works. Symptoms include anxiety, paranoia, personality changes, lack of initiative, and difficulty acquiring new skills. Besides Alzheimer's disease, some other types or causes of dementia include: alcoholic dementia, depression, delirium, HIV/AIDS-related dementia, Huntington's disease (a disorder of the nervous system), inflammatory disease (for example, syphilis), vascular dementia (blood vessel disease in the brain), tumors, and Parkinson's disease. Alzheimer's disease is the most common form of dementia. It proceeds in stages over months or years and gradually destroys memory, reason, judgment, language, and eventually the ability to carry out even simple tasks. Delirium is a state of temporary but acute mental confusion that comes on suddenly. Symptoms may include anxiety, disorientation, tremors, hallucinations, delusions, and incoherence. Delirium can occur in older persons who have short-term illnesses, heart or lung disease, long-term infections, poor nutrition, or hormone disorders. Alcohol or drugs (including medications) also may cause confusion.

FLUORIDES, HYDROGEN FLUORIDE, AND FLUORINE A Toxicological Profile by the U.S. Dept. of Health and Human Services, Public Health Service, Agency for Toxic Substances and Disease Registry (ATSDR) TP-91/17, Page 112, Sec. 2.7 (Health Impacts), April 1993 POPULATIONS THAT ARE UNUSUALLY SUSCEPTIBLE Existing data indicate that subsets of the population may be unusually susceptible to the toxic effects of fluoride and its compounds. These populations include the elderly, people with deficiencies of calcium, magnesium, and/or vitamin C, and people with cardiovascular and kidney problems. Some people with cardiovascular problems may be at increased risk of fluoride toxicity. Fluoride inhibits glycolysis by inhibiting enolase (Guminska and Sterkowicz 1975; Peters et al. 1964). It also inhibits energy metabolism through the tricarboxylic acid cycle by blocking the entry of pyruvate and fatty acids and by inhibiting succinic dehydrogenase (Slater and Bonner 1952). There is evidence that daily doses of 34 mg fluoride (0.48 mg/kg/day) increases the risk of nonvertebral fractures in women with postmenopausal osteoporosis (Riggs et al. 1990). Postmenopausal women (Danielson et al. 1992; Sowers et al. 1991) and elderly men (Danielson et al. 1992) in fluoridated communities may also be at increased risk of fractures.

HHS proposes rapid process for review of fixed dose combination and co-packaged products
May 16, 2004 HHS Secretary Tommy G. Thompson today announced an expedited review process to ensure that the United States is providing safe, effective drugs to developing countries under the President's $15 billion Emergency Plan for AIDS Relief. U.S. Global AIDS Coordinator Randal L. Tobias said the new process will enable his office to ensure the quality of drugs purchased by the United States for developing countries under the President's Emergency Plan for AIDS relief. Under the new guidance to be proposed next week by HHS' Food and Drug Administration (FDA), the United States will be able to provide life-saving drugs at lower prices to millions of people in Africa and the Caribbean.

The Division of Alcohol and Drug Abuse Prevention and Recovery is responsible for public education about alcohol and drug abuse and to develop a system for prevention and treatment services. DADAPR financially supports and monitors a continuum of contracted prevention and treatment services with private, not-for-profit organizations to meet those responsibilities. DADAPR efforts focus on three primary program and service areas. Impaired Driving Intervention Services: Designed for individuals with substance abuse related driving convictions and include the First Offender Program, Phase II Programs for Repeat First Offenders and the Multiple Offender Program for Second or Subsequent Offenders. Substance Abuse Prevention and Treatment Services: Include treatment services of non-medical detoxification, sobriety maintenance, short-term residential and transitional sober housing, and residential services for pregnant and parenting women. Prevention activities include peer leadership programs, school-based assistance, drop-in centers and after school programs. Created to advise the Governor regarding the delivery of effective and coordinated alcohol and drug abuse prevention and treatment services.

This action arises from plaintiff's inability to secure federal funding from the Department of Health and Human Services ("HHS") and/or the National Endowment for the Arts ("NEA") (collectively, "government") for various projects she has proposed. Currently before the court are five motions, the most substantive of which is the government's motion for summary judgment. For the reasons discussed herein, this court finds that it does not have subject matter jurisdiction over the majority of plaintiff's causes of action. For the remaining claims, plaintiff has failed to state a claim upon which relief can be granted. Hence, plaintiff's complaint is dismissed with prejudice. This ruling obviates the need to rule on the other motions brought before the court. FACTS Plaintiff Susan R. Frasier is a resident of Schenectady, new York. . . . . [I]n 1989, plaintiff applied to the National Endowment for the Arts for a "Design Advancement Project" grant through the NEA's Design Arts Program. Plaintiff sought NEA financing for her proposed purchase of a $15,000 "computer-assisted design work-station." . . . She satisfied all of the program's procedural requirements, thus allowing her application to be considered in the NEA's selection process.
