Overview
This ECS StateNote examines policies dealing with charter school autonomy across the states and answers the following questions: Are the state’s standards and assessments applied to charter schools? Are there any restrictions on a charter school’s budgetary authority? What rules are waived for charter schools?
Summary
Thirty-nine states, the District of Columbia and Puerto Rico apply state standards and assessments to charter schools. Twenty-three states do not place any restrictions on a charter school’s budgetary authority. Eight states, the District of Columbia and Puerto Rico place restrictions on a charter school’s budgetary authority. In six states, restrictions, if any, on a charter school’s budgetary authority are specified in the charter. Restrictions on budgetary authority in two states, Massachusetts and Texas, depend on the type of charter school. In 22 states, the District of Columbia and Puerto Rico, charter schools receive an automatic waiver from most state and school district education laws, regulations and policies. In five states

EC PHARMACY UPDATE
- NEW - Hawaii's Administrative Rules for direct pharmacy access to EC were approved by the Board of Pharmacy on Nov. 13 and the state is making steady progress in finalizing their standardized collaborative agreement under which pharmacists will initiate EC. They are currently being reviewed by the Deputy Attorney General assigned to the Board of Pharmacy. From there, the proposed rules will be submitted to the Licensing Administrator for review. Nancy Partika has expressed hope that they will be finalized by June 2004. See below for a history of pharmacy access to EC in Hawaii. HB 123 click here . For an overview of Hawaii requirements for EC access through pharmacies, click here Hawaii is now in the process of developing a standardized EC collaborative agreement protocol that has agreement from major stakeholders, such as the Hawaii Medical Association, the John A. Burns School of Medicine at the University of Hawaii and the American College of Obstetricians and Gynecologists (ACOG) Hawaii Chapter. Once approved, the Board will post it on a website. The Department of Health will compile signed collaborative agreements on an interim basis, so that information may be collected and used for evaluation/quality assurance purposes.

The Secretary awards grants under paragraph (a) of this section on a competitive basis, pursuant to the recommendations of the Pacific Region Educational Laboratory in Honolulu, Hawaii. Those recommendations must be made by experts in the field of special education and related services. (c) Assistance requirements . Any freely associated State that wishes to receive funds under Part B of the Act shall include, in its application for assistance -

SCHOOL/COMMUNITYBASED MANAGEMENT (SCBM)
POLICY
The Department of Education shall implement School/Community Based Management (SCBM) to restructure Hawaii's public school system. Its implementation will gradually shift a significant degree of decisionmaking authority from the state and district levels to the school's community. SCBM is a democratic system of school management which allows greater school level flexibility and the increased involvement of those directly affected by decisions. The concept is based on the belief that the most effective decisions are those made closest to the point of its implementation. It acknowledges that a school's community has a right and an obligation to participate actively in open dialogue where issues are presented, defined, discussed and resolved. SCBM empowers people through shared decision making and requires collaborative involvement of the principal, teachers, support staff, parents, students and other community members. The members of a school's community are expected to accept greater accountability for the decisions they make as they are given flexibility and responsibility for decisionmaking. Accountability will be focused more at the school level.

The HEM staff has been considering pulling these listings. The main reason is that as homeschooling becomes more widely accepted, and as states are scrambling to reform their education system, the situation becomes more complex. This makes overviews, listings and rankings less valid. We have, however, decided to keep these listings in place because they carry, at a minimum, a link to your state government. Additionally we hope reading cited code and at least one homeschooler's interpretation will help start to demystify legislation and encourage you to investigate further. When talking to new homeschoolers we often hear concerns about the law. Is homeschooling legal? Who do I have to notify? What do I have to teach? While the legalities are a concern that should not be ignored, neither should our response be automatic and not thought out carefully.
There is no single source, no one true homeschooling authority. We all own the responsibility to think through laws and regulations on homeschooling. Of course you'll find those who disagree - an entire industry has grown up around the fact that there are differences of opinion on homeschooling's legal matters. What we offer here are overviews of laws and regulations compiled by knowledgeable homeschoolers. These files are not legal advice nor the final word on the subject. They are simply a starting point. To maintain our freedom to homeschool we will each need to go far beyond any convenient compilation or synopsis. We need to continue to do our own learning, lead our own research, and decide on our own actions.
