Conflicts in neighboring countries can be a serendipitous affair. Ask Pakistan. Even Macedonia, battered as it was by the war in adjacent Kosovo in 1999, benefited from NATO largesse, later supplanted by KFOR spending. It is estimated that the allied forces expended well over $40 million a month on purchases in the Balkan region during the bombing of Serbia. This is a meager percentage of the total cost of the war (c. $34 billion) - but it constituted a major boost to the regional economy. Macedonia's GDP at the time was less than $3 billion. The phenomenon may be recurring now in the Central Asian former Soviet republics. In its May 4 issue, "The Economist" estimated that Kyrgyzstan enjoyed an infusion of at least $16 million in American expenditures on fuel, gravel, food, and beds. In return, it allowed the West to use its crumbling infrastructure, both civilian and military - roads, airports, bases and railways. It is now home to a multinational force of 1900 exorbitantly well-paid soldiers, pilots, engineers, and support staff. Kyrgyzstan is an impoverished country with less than $1.5 billion in GDP. Its authoritarian president, Askar Akaev and his ring of cronies own and operate a swathe of businesses. International profligacy is bound to prop up his regime by boosting the local economy and his own pecuniary fortunes.

The Arms Export Control Act provides the President with authority to transfer US defense articles and services (including construction services) to friendly countries and allies. Under the Foreign Military Sales ("FMS") program, DoD procures the goods or services from the US contractor on behalf of the foreign government recipient. Under the Foreign Military Financing ("FMF") program, DoD provides grants—principally to Israel and Egypt—for the purchase of US goods and services. We have nearly 25 years of experience with both these programs. Indeed, we litigated and won the case that established the US government's liability for US contractor claims under FMS contracts:

Although FMS contracts are accordingly now considered virtually the same as any other DoD contract, some differences remain. We continue to counsel clients regularly concerning agent fees, offset arrangements and costs and other unique circumstances presented by FMS arrangements. For example, we successfully litigated a claim against the Air Force to recover coproduction costs incurred as a result of Turkey's direction to use an Egyptian subcontractor. Lockheed Martin Tactical Aircraft Systems Although limited to a handful of countries, the FMF program presents significant challenges to US companies whose commercial contracts are financed under it. Executive Summary
U.S. government-run or -supported training programs for foreign military and police forces have grown dramatically since the end of the cold war, both in size and number. In recent years, U.S. forces have trained 100,000 or more foreign police and soldiers annually. This training takes place in some 200 institutions within the U.S., as well as in at least 150 countries around the world. Funding for the best-known of these programs, IMET, has increased more than three-fold from $22 million in fiscal year 1994 to $70 million for 2002. Meanwhile, Congress and the executive branch have established several new sources of funding and new training programs. While these programs have previously been justified primarily on counter-narcotics grounds, the September terrorist attacks created new impetus for foreign military training as part of the fight against terrorism. Since September 11, the Bush administration has reportedly offered counter-terrorism assistance, including training, to a growing list of countries, including Indonesia, the Philippines, Uzbekistan, Tajikistan, Ethiopia, and Yemen. And in December 2001, Congress created a new regional counter-terrorism fellowship and provided $18 million to fund attendance by foreign officers at U.S. military institutions. The enormous expansion of U.S. military training programs over the past decade has occurred with insufficient congressional oversight and scant public debate. Serious scrutiny of these programs is needed now more than ever, to ensure that the United State’s fight against terrorism is pursued by means consistent with its democratic ideals.

Overview
Section 581 of the 1999 Foreign Operations Appropriations Act contained a significant advance in congressional oversight of foreign military assistance. This provision required the Departments of State and Defense to provide a detailed report on all military training that the United States provided to foreign military personnel the previous year, plus estimates of training for the current year. For every military training activity, the Foreign Military Training Report (or "fmtr") must include the activity's foreign policy justification and purpose, the number of foreign military personnel provided training and their units of operation, the location of the training, the U.S. military units involved, the aggregate number of students trained from each country, the aggregate cost of military training activities with each country, and the operational benefits to U.S. personnel derived from each military training activity. The law allows the Defense and State Departments to include a classified annex "if deemed necessary and appropriate."

FMF by country Program description Law The Foreign Military Financing (FMF) program provides grants and loans to help countries purchase U.S.-produced weapons, defense equipment, defense services and military training. FMF funds purchases made through the Foreign Military Sales ( FMS ) program, which manages government-to-government sales. On a much less frequent basis, FMF also funds purchases made through the Direct Commercial Sales ( DCS ) program, which oversees sales between foreign governments and private U.S. companies. FMF does not provide cash grants to other countries; it generally pays for sales of specific goods or services through FMS or DCS.

A responsibility of the ODC is the management and coordination of the FMS Training Program. This includes development of UK FMS training programs in coordination with U.K. Ministry of Defence, British Defence Staff, and U.S. Military Departments. In addition, the ODC publishes all Invitational Travel Orders for U.K. students as well as manages and coordinates all FMS training purchased by the United Kingdom.
