Does the installation and operation of police band radio monitors by persons other than radio or television stations violate the provisions of s. 843.16, F.S.? In sum, I am of the opinion that: The installation of a police band radio monitor in a business establishment or motor vehicle, except in emergency or crime watch vehicles or in a place established by federal, state, county or municipal government for governmental purposes, by a person other than a radio or television station or a holder of a valid amateur radio operator or station license issued by the Federal Communications Commission, violates s. 843.16, F.S. It is assumed for purposes of this inquiry that a police band radio monitor is frequency modulation radio receiving equipment adjusted or tuned to receive messages or signals on frequencies assigned by the Federal Communications Commission to state or local law enforcement agencies.

The Lemon Law program has proven to be an effective means of recourse for Florida consumers who have purchased or leased NEW defective autos. Buying a new car is one of the most important and expensive purchases you will make. If you find yourself going back and forth to the dealer for frequent repairs, the fun and satisfaction of owning a new car can quickly change into a frustrating and costly experience. If you’ve invested hard-earned cash into a "showroom lemon," help is just a phone call away. Recognizing that "new" doesn’t always translate into "problem-free," the Florida Legislature in 1988 revised a law that makes car manufacturers responsible – under certain conditions for replacing defective vehicles or refunding consumers’ money. Commonly known as Florida’s automobile "Lemon Law," the Motor Vehicle Warranty Enforcement Act established arbitration boards throughout the state to hear and settle complaints between car manufacturers and owners. Consumers who are successful in Lemon Law arbitration have received either refunds or replacement vehicles. May 2002 One of the most important tools a contractor has is his or her legal ability to enforce claims for payment through Florida’s Lien Laws. In the same way that a contractor should come to the jobsite with the proper tools and equipment, he should also make the proper plans to protect his right to be paid for the work he does. Securing Lien Rights – General Contractors on Private Projects Before actually starting work: 1. Verify ownership of the property. This can be done by examining: a. The Notice of Commencement. If none is available, then examine:
b. The Building Permit, and
c. The Property Records, usually available from the Clerk of Courts in the County where the property is located.
  • If you find a discrepancy as to ownership of the property, send all notices to all addresses you have on file. Always send all important lien law notices by certified mail, return receipt requested. Be sure to keep your “green cards” so you can prove actual delivery.

Destin Civil Rights Case Resolved
A civil rights investigation of Destin Water Users, a public water and sewer service provider in Destin, has been resolved, Attorney General Charlie Crist announced. Two employees, Darrick Hall and Todd Oranje, reported that they were exposed to a racially hostile workplace and retaliated against for filing complaints with the Florida Commission on Human Relations and with company management about racial harassment. The types of behavior included frequent and regular racial slurs, the placement of a noose in the work area of an African-American, and denial of work opportunities. These violations of Florida's Civil Rights Act allegedly occurred between August and October 2002. "Forcing individuals to tolerate racial slurs and then to retaliate against them for making lawful complaints is deplorable," said Crist. "Thankfully, we have resolved this matter in the best interests of all concerned." More

In order to maintain the highest level of service, and to better meet the needs of criminal history record check customers, Florida's Legislature has implemented a change to criminal history record check fees. Effective July 1st, 2003 the fee for public requests is $23. Dear Representative Geller: You ask the following questions: (1) Is a Florida resident prohibited from gambling on the Internet or using a telephone to place bets outside of the state? May the State of Florida prohibit gambling on cruise ships? In sum: (1) Federal law currently prohibits an individual engaged in the business of betting or wagering from using wire communications for the transmission of information that assists in the placing of bets or wagers, while Florida law prohibits an individual within this state from placing a bet or wager. However, evolving technology appears to be far outstripping the ability of government to regulate gambling activities on the Internet and of law enforcement to enforce such regulations. Thus, resolution of these matters must be addressed at the national, if not international, level. (2) The ability of the state to regulate gambling on cruise ships is dependent upon a variety of factors, including federal law, the registry or ownership of the vessel, and where the gambling activity occurs.

BUTTERWORTH, Attorney General of the State of Florida, by and through the undersigned Assistant Attorneys General, submits the following comment as to issues 1, 3, 4, 5, 7, 8, 9 and 10 regarding the issue of disclosure of resold "lemon" vehicles. How many vehicles are repurchased each year by manufacturers? How many vehicles are repurchased each year by dealers? What is the disposition of these vehicles? How many are resold to consumers? How many are resold within the same state? How many are transported to another state and resold? What happens to those not resold?
Florida's Lemon Law (Ch. 681, Fla. Stat. (1995), copy attached as Exhibit A), Section 681.104(2)(a), Florida Statutes (1995), requires that "if the manufacturer or its authorized service agent, cannot conform the motor vehicle to the warranty by repairing or correcting any nonconformity after a reasonable number of attempts," the manufacturer shall repurchase or replace the vehicle. A nonconformity is defined as a "defect or condition that substantially impairs the use, value or safety of a motor vehicle, but does not include a defect or condition that results from an accident, abuse, neglect, modification, or alteration. . . by persons other than the manufacturer or its authorized service agent." 681.102(15), Fla. Stat. (1995).
