Back to Research Guides page Florida Forms Much of a lawyer’s time is spent drafting forms. To assist lawyers in this aspect of their practice, there are many different types of form books available. When using form books, one should keep in mind that they are all general in nature. Therefore, before using a form, extreme care should be exercised to make sure that the language is entirely suitable for the purpose for which it is to be used. This pathfinder will look at two different categories of Florida legal forms: transactional forms such as for wills, contracts, sale of goods, and formation of business entities; and those for pleading and practice (litigation) purposes. The following list includes sources of Florida forms updated on a regular basis. The list is not all inclusive. Use it as a starting point. (This list, for the most part, does not include form books which are not regularly updated. The forms in those books may or may not still be valid. Check the Baron computer catalog for their availability. Transactional Form Books Index to Forms and Checklists : (Florida Collection KFF61.I52) Published by the Florida Bar. Serves as an index to all forms and checklists currently available in the Florida Bar’s CLE Publications. As of August 31, 1996, there were 77 CLE Publications practice manuals and rules pamphlets available. Very useful tool.

Sentences From 1983 to 1994 A. Background Parole in Florida
Section 8 of the Florida Constitution provides that There may be created by law a parole and probation commission with power to supervise persons on probation and to grant paroles or conditional releases to persons under sentences for crime. The qualifications, method of selection and terms, not to exceed six years, of members of the commission shall be prescribed by law. Florida’s parole program began in 1941 with the creation of the Florida Parole Commission (FPC), under Chapter 947, Florida Statutes. The FPC is the designated agency to grant parole or conditional release to persons under sentences for crime. Currently the Florida Parole Commission has 184 authorized positions and a budget of $10,368,041. Florida eliminated parole on October 1, 1983, with the exception of parole for offenders who committed capital felonies who received a life sentence (instead of a death sentence) but became eligible for parole after serving a mandatory 25-year term. Florida changed to a determinate sentence structure for all other offenses. However, from October 1, 1983 to May 24, 1994, there existed an anomaly in the law that allowed for true life sentences (no parole eligibility ever) for offenses other than capital felonies, whereas capital felonies were eligible for parole after serving 25 years. The Legislature fixed this anomaly and thereafter persons convicted for capital felonies now receive either death or a true life sentence. Florida’s parole program will eventually cease to exist.

1. Criminal

Medical attention and the forensic examination are handled by the Sexual Assault Response Center of Jacksonville. The Sexual Assault Response Center of Jacksonville is the only agency authorized to perform the medical and evidence-gathering examination. 2. Student Conduct Code
All alleged violations of the Student Conduct Code should be referred to the Office of the Vice President for Student Affairs. The rights afforded each University student who is accused of a crime are listed in the Student Handbook, General Student Conduct Code. In all proceedings, the complainant and the accused are entitled to the same opportunity to have an advisor present during a campus disciplinary hearing. In addition to the rights afforded each University student who brings an action against a fellow student under the Student Conduct Code, the student bringing sexual battery/rape charges against a fellow student is granted a number of additional protections. Included among these are:

On a daily basis we confront a host of problems relating to crime, the trial process, and the role of law enforcement in a free society. We consider questions such as protection of privacy under the search and seizure provision of the Constitution, the implications of the privilege against self-incrimination, the right to confront one's accusers, and the broad-based need for representation in criminal cases. The questions are tough, the answers can be quite troubling. In addition, numerous ethical issues occur regularly in class. We wonder how the defense counsel can represent the 'guilty' client. Students ask how far a prosecutor can go in trying a difficult case; we consider the role of the judge in ensuring that both sides are fairly and adequately represented."
