    Business owners need to be increasingly aware of how they might run afoul of criminal laws in the operation of their businesses. Newspapers today are so full of reports of corporate criminal investigations and prosecutions that most business owners do not even realize that business entities were once thought to be incapable of committing crimes. Criminal Identity Theft and Assumption Deterrence Act
In October 1998, Congress passed the Identity Theft and Assumption Deterrence Act of 1998 (Identity Theft Act) to address the problem of identity theft. Specifically, the Act amended 18 U.S.C. § 1028 to make it a federal crime when anyone: knowingly transfers or uses, without lawful authority, a means of identification of another person with the intent to commit, or to aid or abet, any unlawful activity that constitutes a violation of Federal law, or that constitutes a felony under any applicable State or local law. Violations of the Act are investigated by federal investigative agencies such as the U.S. Secret Service, the FBI, and the U.S. Postal Inspection Service and prosecuted by the Department of Justice.

A crime is a violation of a specific law (federal, state or local) that prohibits certain behaviors or activities. Collectively, these are generally known as the "criminal code." Crimes are generally broken down into two categories: felonies and misdemeanors. Felonies are crimes that are punishable by a sentence that includes more than one year in jail. Misdemeanors are less serious offenses. These categories are normally further divided. For example, in Florida, there are five classes of felonies (capital felonies, life felonies, first degree felonies, second degree felonies, and third degree felonies). Misdemeanors in Florida are divided into first degree misdemeanors (punishable by up to one year in ' jail and a $1,000 fine) and second degree misdemeanors (punishable by up to 60 days in jail, and a $500 fine). ARE TRAFFIC TICKETS CRIMINAL? In some states some traffic offenses (usually moving violations) are classified as criminal offenses. Other states consider minor traffic violations to be "infractions" and do not consider them criminal. Because a non-criminal traffic infraction is not a crime less evidence is necessary to prove the infraction and a jury trial is usually not available. Once charges have been filed, the suspect is ordered to appear before a court. If the person is not yet in police custody, an arrest warrant may be issued. In some cases, an order or summons to appear may be used in place of an arrest. A court will initially determine if there is probable cause to believe the suspect committed the crime charged. Bail must also be set "promptly". The exact timing of these steps will vary from state to state, but must be within 72 hours of an arrest.

The following statutes relating to driving under the influence (DUI) and boating under the influence (BUI) are effective as of July 1, 2003: Recent DUI Legislation On 3/22/02 the Florida Legislature passed House Bill 1057 greatly affecting DUI laws. In summary, this new legislation provides in part as follows: Felony DUI Felony DUI's have been expanded to include the following:
  • As of July 1, 2002 any person who is convicted of a third time DUI within 10 years from his/her last DUI conviction can be charged with a third degree felony.
    "Serious bodily injury" language of felony DUI statute is expanded to include the words "contributes to causing" in addition to "the former language that provides: "causes." (Effective 7/1/02)
    Amends Florida Criminal Punishment code F.S. Section 921.0022 to include a third time felony DUI conviction as a level three offense.
Ignition Interlock Devices Recently, the Department of Motor Vehicles has begun to require the imposition of an interlock device in the vehicles of those convicted of Driving under the Influence. There is a possibility that this requirement is incorrect. If you were convicted of a DUI between July 1, 2002 and July 1, 2003 AND the Judge did not order the imposition of an interlock device in your car, then the DMV CANNOT impose that requirement.
YOU HAVE 30 DAYS FROM THE DATE OF THE DMV LETTER TO FIGHT THE DMV IF THEY IMPOSE THE INTERLOCK WITHOUT A COURT ORDER.

As a child, I feasted on fairytales, the adventures of Robin Hood, and exploits of Joan of Arc. So when I graduated from law school, I naturally wanted to slay dragons, defend people against crime and injustice and help steer mankind toward a future devoid of conflict and strife. Cloaked with my new legal armor, I headed to Orlando, Florida, to work as an assistant state prosecutor. Over the next several years, I found that truth was often elusive and not always what appeared at first blush. The good guys were not quite as good as I thought, and the bad guys were not quite as bad. I learned that defense attorneys were a necessary component of a truly just legal system in which the rights of all parties are zealously guarded. I also came to understand that judges are not magically endowed with a superior understanding of the law and automatically able to mete out fair and impartial rulings; but that they are human, open to the same hopes, temptations and need for continued learning as the rest of us.
