St. Paul, Minnesota 55101 Re: OCR #05974018 Dear Ms. Wain: In reaching determinations on the complainant's allegations, OCR reviewed and analyzed documents pertinent to the issues of the complaint. OCR also conducted interviews with the complainant and a representative of the MDCFL. In addition, in February 1996, in OCR #05964011, a complaint with similar allegations was filed against the Board concerning the PPST. Pertinent information obtained by OCR with regard to its investigation of #05964011 was used in reaching determinations on the instant complaint, including an interview OCR conducted with representatives of Educational Testing Services (ETS) concerning the PPST. As a result of our investigation, OCR has made the following determinations.
  • The complainant provided documentation of his disability, including a letter dated January 21, 1994, from his physician stating that he has a learning disability (dyslexia) and a letter date-stamped February 14, 1994, stating that he should be provided with test-taking accommodations, as follows: "1) "reader with extended time to read test questions [;] 2) scribe with extended time to assist him with essay questions." The complainant also provided a copy of an October 10, 1991, professional evaluation of his disability. OCR has determined that the complainant has a disability which substantially limits a major life activity, namely, learning.

Academic Regulations STUDENT RESPONSIBILITY
The College is responsible for publishing all rules and regulations affecting your educational opportunities. As mature students responsible for your own conduct, you are responsible for familiarizing yourself with these rules and regulations. Written rules and regulations in effect at the time are binding.

EMPHASIS ON COMPETENCY
The 1979 Florida Legislature enacted the Postsecondary Education Act (CS/HB 1689). The major emphasis of this legislation is improving the quality of higher education in Florida. Major goals of the competency movement include:

Residency Reclassification The offices of Undergraduate Admissions (407-823-3000) and Graduate Studies (407-823-2766) determine first term at UCF residency for tuition purposes for all newly-admitted students. Thereafter, the Registrar's Office will review student requests for changes in residency.
Enrolled students who are classified as non-Florida residents for tuition purposes and who believe they may qualify for in-state tuition effective with the next academic semester, may submit a Residency Reclassification form (download form link is below, or available in the Registrar's Office). Supporting documentation is required to substantiate residency for tuition purposes. Before submitting an application for Residency Reclassification, see "Twelve Things You Need to Know about Residency Reclassification" (included in the download link below); and for State of Florida and Department of Education residency reclassification requirements see 'Florida Residency for Tuition Purposes' within the current Undergraduate Catalog.
If appealing the first term of attendance residency determination, please contact the Undergraduate Admissions or Graduate Studies offices as appropriate. The "Practice of surveying and mapping" means, among other things, any professional service or work, the adequate performance of which involves the application of special knowledge of the principles of mathematics, the related physical and applied sciences, and the relevant requirements of law for adequate evidence of the act of measuring, locating, establishing, or reestablishing lines, angles, elevations, natural and manmade features in the air, on the surface and immediate subsurface of the earth, within underground workings, and on the beds or surface of bodies of water, for the purpose of determining, establishing, describing, displaying, or interpreting the facts of size, shape, topography, tidal datum planes, legal or geodetic location or relocation, and orientation of improved or unimproved real property and appurtenances thereto, including acreage and condominiums.
