Governing the Operation of Degree-Granting
For-Profit Institutions of Higher Education March 2000
Abstract
The Education Commission of the States (ECS) surveyed 11 states to inquire about regulations governing the operation of degree-granting for-profit institutions of higher education. Based on the survey results, for-profit institutions are not singled out in the regulatory process. For-profit institutions undergo similar application reviews to those required of private nonprofit institutions (with the exception of providing supplemental forms on shareholders). While most states, however, provide some form of financial assistance to students attending for-profit institutions, it is not on the same level as the aid available to public and private nonprofit institutions.
Introduction
With the rapid growth of for-profit institutions of higher education, many questions arise about quality, competition, market models and appropriate public policy. The Education Commission of the States (ECS), with a grant from the Alfred P. Sloan Foundation, undertook a descriptive study of the growth and impact of for-profit institutions that grant degrees. As part of that study, ECS asked 11 state agency leaders with large for-profit sectors and markets to share information on how they regulate these institutions of higher education. As for-profit institutions grow in number and size, public agencies charged with oversight and consumer-protection responsibilities must respond within existing legal frameworks. The purpose of the study was to determine if and how these frameworks are changing.

CHAPTER EMPLOYMENT LAW COMMITTEE PROVIDES...Update on Employment Law Issue: New Development with FLSA
It is anticipated that the U.S. Department of Labor (DOL) will release the new Fair Labor Standards Act (FLSA) regulations which include changes to the so-called "white-collar" exemption rules by March 31. In testimony before a Senate committee recently Secretary Elaine Chao responded to a request by Sen. Arlen Specter, R-Pa., to delay release of the new rules until Sept. 30 by saying that the DOL is committed to adopting new regulations by the end of March, because further delay would only harm workers.
It is unknown whether the regulations release will be identical to the proposals issued last year but it is expected they will change the way employers determine who is exempt from the FLSA’s overtime and minimum wage requirements.

Environmental Resource Permitting Program
Training and Public Education
The Program Development and Support Section is responsible for providing training on the environmental resource permit program, the wetland resource permit program and the sovereign submerged lands proprietary program. In addition to training staff of the Department and of other agencies, this section also teaches the public about these programs and about wetlands and aquatic resources in general. TRAINING: Training for agency staff is presented in the form of printed materials, periodic conference calls and meetings, small seminars around the state, and an annual conference. In addition to these traditional modes of education, we have recently started to develop our own training videos. While our equipment doesn't allow us to produce broadcast quality video, the materials are suitable for classroom style presentations. So far we have completed 2 videos entitled Getting to Know the Hydrologic Indicators and Field Indicators of Hydric Soils. The first one is a technical review of hydrologic indicators used to determine the presence and extent of wetlands and also to evaluate wetland functions.

Brief Description of the Program:
The Master of Science (M.S.) degree program in Educational Leadership comprises courses and experiences designed to develop entry level competencies in the practice of educational leadership. The program incorporates coursework that constitutes the “modified Florida program in educational leadership” at Florida International University and addresses the competencies assessed in the Florida Educational Leadership Examination. The program is fully approved by the Florida Department of Education and may be used to satisfy part of the requirements for state certification in Educational Leadership.

Hunting Handbook Table of Contents HUNTER SAFETY REQUIREMENT A person born on or after June 1, 1975 may not be issued a hunting license in Florida without first having successfully completed a hunter safety course. Hunters affected by this requirement must present proof of satisfactory completion of Florida’s hunter safety course or an approved course provided by another state or province when purchasing a license. Children under the age of 16 may hunt with adult supervision even though they have not completed a hunter safety course. Hunters who need proof they’ve passed the Florida Fish and Wildlife Commission’s (FWC’s) Hunter Safety Course can print out duplicate certificates from the FWC’s Web site at www.floridaconservation.org, click on “hunting” and scroll down to “hunter education.” See “Free Hunter Safety Course” page 20. PERSONS EXEMPT FROM LICENSE AND PERMIT REQUIREMENTS The following persons are exempt and do not have to obtain a Hunting License, Florida Waterfowl Permit, Turkey Permit, Wildlife Management Area Permit, Archery Permit, Muzzleloading Gun Permit and Migratory Bird Permit.
