Some Suggestions
Does your assignment require you to read the text of the statute, or to study its causes, interpretation, and effects? Generally, the causes, interpretation, and effects are more easily found OUTSIDE of the text of the statute itself. To start: Go to United States Code Annotated (Gov. Info. Ref. Y4.J89/1:UN3/3/West) Find the Index (paperback volumes) The last volume of the index will be the Popular Name Table
Look up your statute by name in the Popular Name Table . The first line describes the original statute and will read something like:
Any Pub. L.s that follow are statutes which change the original statute and you may also need to examine them. 2. To find the text of a statute as it originally passed: Find the Statutes at Large citation. In the example above it is: 81 Stat. 533
which means: volume 81 of Statutes at Large, page 533.
Statutes at Large is at AE2.111: in the Government Information Reference stacks.. 3. To find the text of a statute as it looks today: Find the US Code citation.

United States Supreme Court ruling: Roe vs. Wade (1973):
Prior to the U.S. Supreme Court's famous Roe v. Wade decision, abortions were permitted in certain states but banned in others. The court ruled in 1973 that, anywhere in the U.S.: a woman and her doctor may freely decide to terminate a pregnancy during the first trimester, state governments can restrict abortion access after the first trimester with laws intended to protect the woman's health. abortions after fetal viability must be available if the woman's health or life are at risk; state governments can prohibit other abortions. The Roe vs. Wade case involved a pregnant single woman ("Roe") who brought a class action challenging the constitutionality of the Texas criminal abortion laws, which prohibited any abortion except to save the woman's life. A married couple (the "Does") separately attacked the laws on the basis that an accidental pregnancy could find them unprepared for childbearing and could pose a hazard to the wife's health. Decided April 17, 1990. Decision: Oregon's prohibition of use of peyote in religious ceremony held not to violate free exercise of religion clause of Federal Constitution's First Amendment. SUMMARY On certiorari, the United States Supreme Court reversed. In an opinion by Scalia, J., joined by Rehnquist, Ch. J., and White, Stevens and Kennedy, JJ., it was held that (1) the free exercise of religion clause permits a state to include religiously inspired use of peyote within the reach of the state's general criminal prohibition on use of that drug, where there is no contention that the state's drug law represents an attempt to regulate religious beliefs, the communication of religious beliefs, or the raising of one's children in those beliefs; (2) the free exercise of religion clause thus permitted Oregon to deny unemployment benefits to persons dismissed from their jobs because of such religiously inspired use; and (3) generally applicable, religion-neutral criminal laws that have the effect of burdening a particular religious practice need not be justified, under the free exercise of religion clause, by a compelling governmental interest. Blackmun, J., joined by Brennan and Marshall, JJ., dissenting, expressed the view that (1 ) a state statute that burdens the free exercise of religion may stand only if the law in general, and the state's refusal to allow a religious exemption in particular, are justified by a compelling interest that cannot be served by less restrictive means, (2) Oregon's interest in refusing to make an exception for the religious use of peyote was not sufficiently compelling to outweigh the counselors' right to the free exercise of their religion, and therefore (3) Oregon could not, consistent with the free exercise of religion clause, deny the counselors unemployment benefits.

    The Supreme Court is one of the most important institutions in the United States. Thus, social studies teachers should emphasize the significance of the Court in our nation's history. This ERIC Digest highlights the origin and foundations of the Supreme Court, discusses the changing role of the Supreme Court in the United States, and recommends World Wide Web resources helpful in teaching and learning about the Supreme Court.
    CONSTITUTIONAL AND STATUTORY FOUNDATIONS OF THE SUPREME COURT.
    The majority of the men who met in Philadelphia during the summer of 1787 agreed on the need to create a more powerful central government. Concurrently, however, many of the delegates feared the abusive power a new national government could wield. During the ratification struggle, James Madison, in "Federalist 51," emphasized the necessity of providing for "auxiliary precautions" to limit governmental power. The judicial branch was designed in part to exercise such precautions on the legislative and executive branches. At the same time, the framers placed checks on the judiciary in order to ensure that no single branch would dominate the others.
