The United States is not liable under the Federal Tort Claims Act for injuries to members of the armed forces sustained while on active duty and not on furlough and resulting from the negligence of others in the armed forces. Pp. 136-146.
(a) The Tort Claims Act should be construed to fit, so far as will comport with its words, into the entire statutory system of remedies against the Government to make a workable, consistent and equitable whole. P. 139.
(b) One of the purposes of the Act was to transfer from Congress to the courts the burden of examining tort claims against the Government; and Congress was not burdened with private bills on behalf of military and naval personnel, because a comprehensive system of relief had been authorized by statute for them and their dependents. Pp. 139-140.

It would be very convenient if all state and federal codes, statutes, and caselaw were available on the World Wide Web. This would give lay people easy access to the laws that they must follow and it would allow attorneys to do legal research without having to leave their office to go to a law library, or pay for expensive collections of casebooks. Unfortunately, economic realities dictate that we may never see all of the substantive law of all the states on the Web. Several states receive quite a bit of income by selling the exclusive rights to publish that state's caselaw. In addition, it is quite expensive to publish and maintain a web site, and money for such a project is not available in all states. Caselaw on the Web ideally would include decisions from at least the last 30 years, a sophistocated search engine for locating relevant law, case summaries, headnotes, etc. Providing all of these on a Web site would be very expensive. Given the above, it is impressive how much substantive law

State and Federal Laws Affecting School Crime and Violence
In recent decades, Congress and state legislatures along with the national and state courts have actively addressed the issues of school crime, violence, and disorder. A large body of law currently affects this area. Congress has made school-related drug trafficking a federal crime. It has imposed requirements for states to impose penalties for weapons possession in schools. The U.S. Supreme Court has strengthened the search authority of school officials and improved the ability of educators to enforce rules restricting student expression that interferes with safe, orderly schools. The Supreme Court has clearly stated, however, that students carry their civil rights with them into school, even if those rights are less extensive than comparable rights held by adults. Although it is important for educators to understand their obligations and limitations in maintaining safe schools, it is equally important that they understand and respect the rights of students in the process. Educators concerned with school order and safety should be aware of the following statutes and court decisions: Federal Law: The federal "schoolyard statute," which is part of the Comprehensive Crime Control Act, enhances the penalty by making it a federal crime to traffick drugs within 1,000 feet of a school.

Court Declares Medicaid Statute Unenforceable
Encouraged by the recent sovereign immunity cases, some states have begun a wholesale attack on the ability of private parties to enforce federal laws against states by suing for injunctive relief only and naming state officials as defendants. One of the first fruits of this attack is a lengthy, complex decision handed down on March 26, 2001 in Westside Mothers v. Haveman , 133 F. Supp. 2d 549 (E.D. Mich.), that refuses to enforce the Medicaid statute under the process of Ex parte Young , 209 U.S. 123 (1908). Harris v. McRae , 448 U.S. 297, 301 (1980). The court in Westside ruled that under the new emphasis on sovereign immunity in Supreme Court decisions, the existing precedents enforcing the Medicaid statute are no longer good law. It held that the suit against the state officials is essentially against the state and could not be brought. At the heart of the decision is an argument that Young only applies to violations by state officials of the federal Constitution or federal laws. Since the Medicaid program is enacted under the Spending Clause, the federal requirements are not federal laws, since the states are free not to participate in the Medicaid program. Rather, the nature of the program is a contract between the federal and state government. Ex parte Young , the court concludes, does not authorize suits for breach of contract against state officers. It reaches this conclusion while acknowledging that the Supreme Court has in the past “held that federal-state cooperative programs enacted under the Spending Clause fall within the ambit of the Supremacy Clause.” Describing those cases to be assertions “without analysis, ” the decision relies on “a more searching analysis” found in recent Supreme Court immunity cases.
