    The Roman Family
    It may be that a general understanding of the traditional Roman familia can give us a better grasp of the Roman woman's everyday reality. This will be a general overview only. More specific discussions of specific themes will follow in other essays. NOTE: The information contained in this flyer is intended as an introduction to the basic elements of Islamic family law. It is not intended as a legal reference. It is designed to make clear the basic rights and restrictions resulting from marriages sanctioned by Islamic law between Muslim and non-Muslim partners. For Americans, the most troubling of these restrictions have been: the inability of wives to leave an Islamic country without permission of their husbands; the wives' inability to take their children from these countries without such permission; and the fact that fathers have ultimate custody of children. MARRIAGE In Islam, the act of marriage occurs with the conclusion of the marriage contract. The marriage contract itself is completed by an offer and acceptance, both of which must be made on the same occasion by two qualified parties. If a marriage has been contracted by competent persons in the presence of two witnesses and has been adequately publicized, it is complete and binding. It requires no religious or other rites and ceremonies because in Islamic law formalities have no value insofar as contracts are concerned. Such marriages are conducted only if both parties are willing.

As stated above, there are estimated to be more than 80,000 mothers among the women in prison and jail. They have approximately 200,000 children aged under 18. Surveysindicate that the great majority of imprisoned women with children under 18 lived with their children before they were imprisoned. All states have laws permitting the termination of parental rights of parents who are incarcerated. Women's prisons are often located in rural areas far from the cities in which the majority of inmates lived, making it difficult to maintain contact with their children and jeopardising the prospects of successful reunification. A national study found that more than half of the children of women prisoners did not visit their mothers while they were in prison. Over 60 percent of the children who did not visit lived more than 100 miles (160 kilometres) from the prison where their mother was incarcerated. Many of the children of incarcerated women are placed in foster care, "where the inability of imprisoned mothers to meet court-mandated family reunification requirements for contact and visitation with their children can result in termination of the mother's parental rights."

There are so many "father's rights" attorneys, laws and concerns these days. Are there any mother's rights anything. Who is protecting the mother's who are trying to protect their children from dad's who are abusive. Mothers are just looked at as manipulative. It just is not in the best interest of a child to have watched a father abuse his mother, then not pay child support or spend any quality time with the child on his visitation and then have the child bothered by family memembers and not even protect the child and now wants full custody. Just does not make sense. Who is to protect this child? The principle of equality of men and women with respect to citizenship and before the courts is expressly stipulated in Tunisian legal texts.
As early as 1956, the Code of Personal Status established a new organization of the family based on equality of rights, through a series of provisions that included:
  • the abolition of polygamy;
  • the establishment of judicial divorce proceedings, granting both spouses the right to request divorce;
  • setting the minimum age for marriage at 17 for girls, and providing that they must consent to the marriage;
  • in the case of death of the child's father, granting the mother the right of custody of their minor children.
The new amendments announced by the President of the Republic on August 13, 1992 have, meanwhile, strengthened the place of women still further, confirming the principle according to which their rights are inseparable from those of men, eliminating legal provisions that could be interpreted as discriminatory and sexist. These amendments, adopted by the Chamber of Deputies in July 1993, stipulate in particular:
  • that the two spouses "must treat each other with kindness and consideration, and assist each other in the management of the household and the affairs of their children." This provision replaces the former clause providing that "the woman must obey her husband";

These cases have established that the policy of the Prison Service that children should cease to live with their mothers in prison at 18 months was lawful. It was confirmed that neither the Secretary of State nor the Prison Service had assumed parental responsibility for the children of prisoners under Section 3 of the Children Act 1989 , and that that responsibility remained vested in the prisoners. The Vermont Guide to Civil Unions
Vermont's Civil Union law will go into effect July 1st, 2000. This law permits eligible couples of the same sex to be joined in civil union. The eligibility criteria are discussed in this pamphlet.
Parties to a civil union shall have all the same benefits, protections and responsibilities under Vermont law, whether they derive from statute, policy, administrative or court rule, common law or any other source of civil law, as are granted to spouses in a marriage.
In order to be joined in civil union the couple must complete the following steps:
  • Apply for a civil union license from the town clerk of the town where either party resides or, if neither is a resident of the state, from any Vermont town clerk. At least one of the parties must sign the license application and pay a $23.00 fee to the town clerk.
  • The couple must then deliver the license to an official authorized to certify a civil union: a judge, justice of the peace or member of the clergy. The civil union may be certified anywhere in the state.

    By Glenn Sacks and Dianna Thompson This week's "virtual visitation" ruling by a Massachusetts court points to a new and dangerous trend in family lawjudges permitting mothers to move their children hundreds or thousands of miles away from their fathers, and justifying the separation by ordering Internet video conferencing as a purported substitute for a father's time with his children. In her ruling, Judge E. Chouteau Merrill awarded a Boston-area woman sole custody of her three small children, and gave her permission to move the children 225 miles away. Merrill granted two weekend visits a month to Paul, the ex-husband and father of the couple's five year-old son and twin two year-old daughters. The children will be moved to Long Island, New York. Paul's standard weekday visitation was replaced by ''virtual visits'' on Tuesdays and Thursdays from 6 to 7 p.m. Merrill explained that the computer conferences are relatively cheap and will allow Paul to read to his children and help them with their homework.
