Biased Family Court System Hurts Mothers Run Date: 09/05/01 By Garland Waller
WEnews contributor Behind closed doors of the family court system, thousands of women each year lose child custody to violent men who beat and abuse mothers and children. The writer says family courts are not family-friendly and betray the best interests of the child. Editor's Note: The following is a commentary. The opinions expressed are those of the author and not necessarily the views of Women's Enews or NOW Legal Defense and Education Fund. (WOMENSENEWS)Studies show that in approximately 70 percent of challenged cases, battering parents have been able to convince authorities during custody battles that their victim is unfit or undeserving of sole custody, according to a recent report published by the American Judges Foundation. That statement would have once shocked me, but no more. Nor am I surprised when I read that a family court judge has awarded custody of a 3-year-old girl to the father who has violently beaten her mother. I do not even lift an eyebrow when a 2-year-old boy, who comes home from unsupervised visitation with his dad, has a diaper filled with his own rectal blood and that same child is later turned over to his father on a full-time basis. And when a mother is thrown into jail, denied the right to ever see her children again, because she brought up the issue of child abuse in a family court, I'm sickened, but not shocked. These injustices are commonplace today in the closed-door family court system. These courts often claim to operate in a manner consistent with the "best interests of the child." In practice this often means that a judge, often a male judge, biased and imperious, defines that phrase. These judges decide, time and time again, when a woman raises the allegation of sexual abuse in a custody dispute, that it is she who will lose her children forever.

Justices Limit Visiting Rights of Grandparents in Divided Case
By Linda Greenhouse (NY Times, June 6,2000) WASHINGTON, June 5 Declaring that parents have a " fundamental right to make decisions concerning the care, custody and control" of their children , the Supreme Court ruled today that a Washington State law went too far in permitting a judge to order visiting rights for grandparents over a mother's objection. With a 6-to-3 vote but lacking a single rationale that could command a majority, the court stepped cautiously and appeared intent on avoiding a one-size-fits-all constitutional prescription for a world of rapidly changing family dynamics. As Justice Sandra Day O'Connor acknowledged in her opinion for a plurality of four justices: "The demographic changes of the past century make it difficult to speak of an average American family." Consequently, the court stopped short of declaring unconstitutional a Washington law, one of the broadest regarding the rights of grandparents in terms of permitting judicial intervention in family affairs. Nor did the justices offer much guidance for judging the constitutionality of similar laws in the 49 other states. Beginning with New York in 1966, states adopted laws on visiting rights that reflected the rising divorce rate and the impact of custody battles that caused grandparents to lose contact with their grandchildren. While most state laws make parental death or divorce a precondition for grandparents to seek visiting rights, the Washington law required no such triggering event.

After noting that the DHHR did not recommend termination during the dispositional proceedings and that the GAL agreed with that decision, finding that there was no evidence of abuse in the record, and that the father[base ']s parental rights should not have been terminated. However, noting that in light of all the circumstances, that the father[base ']s only contact with the children must remain noncustodial, and that visitation be closely, strictly, and constantly supervised. Further rejecting appellant[base ']s hearsay objections based on the unavailability of the truancy officer, noting that the disposition was not based entirely upon hearsay testimony.

The government is being accused of undermining the rights of parents with its proposed changes to the law covering children affected by family break-ups. The Care of Children Bill, introduced to Parliament on Tuesday, will give the courts wider powers to encourage and enforce compliance with parenting orders. The Bill also removes the distinction between married and de-facto partners, and replaces words such as "parental custody" from legislation with the concept of "day-to-day care." The government says the Care of Children Bill shifts the focus from parental rights to parental responsibilities - and puts the welfare and interests of children first.
