My in-laws divorced two years ago. They have a 14-year-old daughter. Because her mother was unable to care for her at the time of the divorce, the daughter remained with the father, who remarried shortly afterward.
Can parental rights be terminated post divorce if one parent was unable to care for the child due to financial or medical reasons during and directly after the divorce?

- Mother's rights -
A paternity case in the State of Texas is a lawsuit to determine the natural and legal father of a minor child and to confer the rights and duties of a parent. The Mother in a paternity action has the right to raise and litigate the minor child's rights on the child's behalf. The mother has the right to bring a paternity action on behalf of the minor child against an alleged father to determine whether he is the biological and legal father of the minor child. The mother is designated under the laws of the State of Florida the natural custodian of the minor child. This means that the mother has the initial legal right to exercise sole parental responsibility over the minor child until a legal father has been determined by a court of law. Once a paternity action is filed and a legal father is determined by a court of law the mother will most likely have to share the parental responsibility concerning the minor child with the father. If the mother does not wish to share these rights with the legal father then she should consider whether she should file a paternity action. The mother has the right to request, on the minor child's behalf, that the father pay child support, cover the minor child with medical and health insurance, pay a portion of the non-covered medical expenses of the minor child, pay a portion of the mother's medical expenses related to the birth of the minor child, and pay a portion of the mother's attorney's fees and litigation expenses.

There is no evidence that breastfeeding a child beyond infancy is harmful. Quite the opposite is true: breastfeeding benefits toddlers and young children, both nutritionally and psychologically. Over the past year, mothers have expressed growing concerns about the legality of extended breastfeeding. And with little wonder. The media has been giving more and more publicity to the subject, and social service agencies throughout the United States have been addressing these issues in their cases. Rest assured, however, breastfeeding is not child abuse or neglect, and no reported decisions to date claim that it is. To the contrary, upon learning of the normalcy and frequency of extended nursing in this country, several social service agencies have closed out cases involving breastfeeding. A Minnesota mother was accused of abuse for nursing a six year old in public. In reality, she was nursing a three year old; and as soon as the child's age was established, the case was closed. In Tennessee, accusations against a mother nursing a four and a half year old were dropped. In Florida, a mother was cleared of abuse for nursing a six year old!

Here you can research both the law and science of paternity. Your situation is far from unique, out-of-wedlock births are now commonplace. In fact, paternity cases outnumber divorce filings in many courts. If the alleged father signs a voluntary acknowledgment of paternity, the courts don't have to decide parentage, but custody, visitation and child support often remain at issue. However, if legal paternity is at issue, i.e. the alleged father (and sometimes the mother) denies paternity, the parent who wishes to establish paternity must bring a paternity suit or action. Unlike more conventional legal cases, contested paternity actions are decided primarily on the scientific evidence of DNA testing. Therefore, if biological fatherhood is in question, your first step is to conduct a paternity test. If parents can't agree to the test, the court will order it. These genetic test results are often conclusive, although courts often allow contradicting evidence, such as proof that the alleged father had no physical access to the mother at the time of conception.

ROCHESTER, New York (AP) A couple has been ordered not to conceive any more children until the ones they already have are no longer in foster care. A civil liberties advocate said the court ruling unsealed Friday was "blatantly unconstitutional." Monroe County Family Court Judge Marilyn O'Connor ruled March 31 that both parents "should not have yet another child which must be cared for at public expense." "The facts of this case and the reality of parenthood cry out for family planning education," she ruled. "This court believes the constitutional right to have children is overcome when society must bear the financial and everyday burden of care." The judge is not forcing contraception on the couple nor is she requiring the mother to get an abortion should she become pregnant. The couple may choose to be sterilized at no cost to them, O'Connor ruled. If the couple violates O'Connor's ruling, they could be jailed for contempt of court.

De Facto Relationships - Maintenance Since April 1988 children who are born to parents who are not married (that is, ex-nuptial) have identical rights to financial support as those children whose parents are legally married. Courts that can hear family law cases can make orders for all children whether they are children of the marriage or not. A woman who is not married to the father of her child may apply to the Family Court, Federal Magistrates Service or the Magistrates' Court for an order that the father pays her child-bearing expenses. She has 12 months after the birth to make this application, although this may be extended in some cases. A claim may also be made for the mother's maintenance for a period of two months prior to the birth and three months after the birth of the child. If a woman is required to cease work early due to medical reasons relating to the pregnancy she may be able to make a claim for maintenance from the date upon which she ceases employment. Parents may also have entitlements to government assistance and inquiries can be made through Centrelink (http://www.centrelink.gov.au). The telephone number of the Family Assistance Office of Centrelink is 13 61 50.

There are several new Iraqi bloggers. The first blog to introduce is the Iraqi Agora - a group blog by Iraqis inside and outside of Iraq. It's basically a blog for Iraqis too lazy to begin their own blog. The truth is that 3 of the contributing bloggers ( Salam Liminal and I) have our own blogs. The guy calling himself 'Liminal' is a twenty-something Iraqi living in the US and you'll have to read his personal blog to learn more about him . Hurria is an Iraqi woman who has lived abroad for a long time and has some fantastic opinions about... everything. Torshe is another Iraqi abroad and is new to blogging but you won't want to miss him either. You'll have to be patient with the group blog because we're still getting it on its feet (and Liminal is doing most of the work). I have two other contributors inside of Iraq interested in blogging on it.

Exact Match Mother's Rights and Children's Welfare Threatened by Forced Joint Custody Michigan has proposed legislation that would impose joint custody on parents who are in conflict over custody. The legislation states that in a custody dispute the judge must presume that joint custody is in the "best interests of the child" and "should be ordered." To make any other decision, a judge must find reasons why joint custody is not in the children's "best interest." This is an ambiguously high legal standard that makes it very difficult for judges to award sole-custody. It is a departure from the traditionally accepted standards determining what's in the best interest of the child based on the biological bond of mother and child and the fact that in the vast majority of cases, the mother is the primary child care provider.
Any judge who refuses to even hear testimony as to what is the in the child's best interests and instead follow statutes or precedents and disregards the welfare of the child is irresponsible and unfit to be making any judgments whatsoever over any child. Any just court or decent person should only consider what's best for the child. Most child custody cases are settled through mutual agreement, sometimes aided by mediation, and the overwhelming majority of the time the mother gets custody with the father getting visitation in a way that satisfies both of them.
