T oday, an increasing number of children likely will live some portion of their childhood with only one parent. Figures released by the Census Bureau show that the number of single fathers raising children has increased about 25 percent over the past four years. There are now approximately 2.1 million single fathers, up from 1.7 million in 1995. As more and more fathers have expressed an interest in being active parents, the courts too have abandoned traditional biases related to gender in parenting. Although the common belief is that fathers face a stigma when seeking parental rights of their children, the courts in Colorado have adopted a pro-child agenda and are neither pro-mom nor pro-dad. While some judges tend to view these cases in an old-fashioned view, the fact is, that in Colorado, it is statutorily forbidden to automatically favor mothers as "primary custodians". In fact, court determinations of decision-making responsibility and parental rights are based on what is in the "best interests of the child". The courts have even gone so far as to eliminate controversial terms such as "sole custody" and "visitation" while adopting new phrases such as "parental responsibilities" and "parenting time." The modern trend in the courts is to get away from the adversarial nature of litigation in cases involving children, and instead focuses on the issues that will allow both parties to enjoy successful co-parenting. Fathers are increasingly asserting themselves as excellent caretakers of even young children. And, society as a whole is finally beginning to recognize the crucial role of fathers.

The Incarcerated Mothers Law Project (IMLP) was launched by the Women's Prison Association and Home (WPA) in 1996 in response to the escalating number of mothers in prison in New York State. Many of these women experience difficulties in maintaining regular contact with their children. IMLP operates as a partnership between WPA and the Volunteers of Legal Service, Inc. (VOLS). The Adoption and Safe Families Act (ASFA), passed in 1997, places a premium on swift adoption of children who are in foster care. This law permits accelerated termination of parental rights. IMLP educates women about their rights and responsibilities with respect to the legal relationships with their children. These women are coached on how to advocate for themselves and for their children in court, with foster care agencies, and within the correctional facilities where they reside. IMLP provides educational workshops on family law to groups of incarcerated and formerly incarcerated women. Volunteer lawyers, recruited by VOLS, assist mothers in maintaining their families and in making important decisions about the care of their children.

LEARN ABOUT THE COURT SYSTEM-
In the Middle Ages, disputes were originally settled on a battlefield by knights. Consider the court room a battlefield, rather than a place for justice and protection of children or victims of family violence.
JUDGES: Judges are at the top of the court pyramid. Although other judges can hear custody cases, the trend in California is to have particular judges assigned to unified family courts and given special training. There are also commissioners, judges pro tem, referees, and private or retired judges who hear cases. All of these justices have complete power over your case.
  • The advantage to having a unified court is that one judge hears and coordinates a family's problems. These problems may include domestic violence, temporary restraining orders, divorce and custody issues.
  • The disadvantage is that one judge may be prejudiced against women, burned out, or uncaring. Many judges are biased against women, according to studies.
You will want to find out the judge's reputation early. You have the right to have a judge hear your case, and to dismiss one judge without a reason given, up to 10 days after you know s/he is assigned to your case, before any contested hearing begins

Under Pakistani family law, which is based on Islamic law, the father controls virtually all aspects of his family's life. He decides where his wife and children will live, how the children are to be educated and whether or where they may travel. Courts rarely, if ever, give custody of children to a woman who is not a Muslim, who will not raise the children as Muslims, does not plan to raise them in Pakistan, or has remarried. In all probability, even if the mother wins custody, the children would still need the father's permission, to leave the country. Any matter of custody in Pakistan can only be resolved through the appropriate local judicial system.
