Home Law Center Clinical Program Juvenile Justice Clinic Introduction to the Clinic Table of Contents Our Program History      The Juvenile Justice Clinic was founded in 1973, a mere six years after the Supreme Court's landmark decision in In re Gault . In that case, the Supreme Court guaranteed children a constitutional right to counsel and to procedural due process. One of the first law school-based legal clinics specializing in children's issues, the Juvenile Justice Clinic and its staff seeks to fulfill the mandates of the Gault decision, to expand the legal rights of children, and to insure that children are protected from maltreatment by their parents or by the government.      In its early years, the clinic was a full service children's rights center as well as a teaching program operating within the Law Center community. As such, the clinic staff provided legal assistance in every type of case concerning children. We also assisted in the formulation of policy at both the local and federal level and trained a cadre of young lawyers to continue the work they began as students in law school.

However, when a juvenile is charged with a crime, a different set of court procedures will apply, namely the Wisconsin or Minnesota Rules of Juvenile Procedure (Juvenile Court). In part, these Rules mirror those that guide adult court, but they differ in language, pretrial procedure, and disposition of cases. For example, when a juvenile is charged with a crime, the State may attempt to have the minor "adjudicated delinquent" of the crime, versus seeking a finding of guilt. The State may also attempt to keep a child on probation for a greater amount of time, and may even attempt to try the minor as an adult. Although the laws in Wisconsin and Minnesota vary slightly, many of the same rules apply.

Abstract
The contributors to this work share a concern about the possible effects of the criminal justice system on juvenile offenders. However, they have different views as to how justice should be administered. They question whether it is possible to punish without stigmatisation and whether the prevention of re-offending can be achieved. They consider whether family conferencing is the best alternative. Examines the relationship of the family (both the traditional family and the family in its extended form) to the existing legal system. Will discuss the legal rights and obligations of all the parties involved in the family. Included in this study is the Family Law Act, and the Property (Relationships) Act 1984.
Presenter:
Helen Walsh LLB (SCU), Solicitor of the Supreme Court of New South Wales. Helen has been the resident tutor at Southern Cross University School of Law and Justice for the past year. She has been teaching in the areas of Legal Research and Family Law for the past four years. Prior to that Helen was employed in private practice in the Northern Rivers region working mainly in the area of Family Law. Helen coordinates a number of special projects in the School including the Southern Cross University Law Review and the external LLB program.

The Judicial Council of California adopted a Long-Range Strategic Plan in May 1997 to prepare for changes facing the courts and to comply with new federal regulations. The introduction to the plan notes the role of courts in society: "Owing to changes in societal structures, the courts are now expected to provide much more than the services which have been traditionally and strictly associated with the court's dispute resolution function. Many people, government officials as well as court users, seek therapeutic or preventive justice from the courts. They look to the courts to coordinate the provision of social services while providing dispute resolution services that affect the very core of people's lives. After graduating from law school, where she was Managing Editor for the Law Review and President of the Public Interest Law Foundation, Professor Federle was a public defender in the state of Washington. She then received a prestigious E. Barrett Prettyman Fellowship from Georgetown University Law Center in 1984, where she supervised third-year law students in the Juvenile Justice Clinic and represented children and adults in both the D.C. court system and the federal courts.
She serves on the Advisory Board of the Dave Thomas Center for Adoption Law, the Editorial Advisory Board of the International Journal of Children's Rights, the Ohio State Bar Association Juvenile Justice Committee, the Columbus Bar Association's Task Force on Domestic Violence and the Courts, and is co-chair of the Child Welfare Subcommittee of the American Bar Association Litigation Section's Children's Rights Committee. Professor Federle is a past chair of the American Bar Association Family Law Section's Committee on Juvenile Law and the Needs of Children. While serving as chair, Professor Federle helped draft the ABA's Standards for the Representation of Children in Abuse and Neglect Cases. She also serves as the faculty advisor to two law student organizations, Advocates for Children and the American Constitution Society.

Cases not specifically assigned by law to another court are heard by the Superior Court, including felony criminal cases, civil cases, domestic relations (divorce) cases, probate cases (administration of wills), juvenile, paternity, guardianship and adoption cases.
