Grandparents Rights to Visitation By Maury D. Beaulier, Esq. Grandparents often envision their golden years spent by happily caring for and treating their grandchildren. In recent years, as a symptom of our skyrocketing divorce rates, much litigation has occurred when grandparent's are prevented from seeing their grandchildren.  As a direct result, today all states have statutes authorizing a court to award visitation to a grandparent under certain circumstances In Minnesota, a district court has broad discretion to determine what is in the best interests of a child regarding visitation .  The authority of the Court to consider grandparents when making visitation decisions with regard to Grandparents is spelled out in Minnesota Statute § 257.022, subd. 2 (1994).  This statute specifically allows the district court to consider a request (by petition) for grandparent visitation if

By Linda Greenhouse (NY Times, June 6,2000) WASHINGTON, June 5 Declaring that parents have a " fundamental right to make decisions concerning the care, custody and control" of their children , the Supreme Court ruled today that a Washington State law went too far in permitting a judge to order visiting rights for grandparents over a mother's objection. With a 6-to-3 vote but lacking a single rationale that could command a majority, the court stepped cautiously and appeared intent on avoiding a one-size-fits-all constitutional prescription for a world of rapidly changing family dynamics. As Justice Sandra Day O'Connor acknowledged in her opinion for a plurality of four justices: "The demographic changes of the past century make it difficult to speak of an average American family." Consequently, the court stopped short of declaring unconstitutional a Washington law, one of the broadest regarding the rights of grandparents in terms of permitting judicial intervention in family affairs. Nor did the justices offer much guidance for judging the constitutionality of similar laws in the 49 other states. Beginning with New York in 1966, states adopted laws on visiting rights that reflected the rising divorce rate and the impact of custody battles that caused grandparents to lose contact with their grandchildren. While most state laws make parental death or divorce a precondition for grandparents to seek visiting rights, the Washington law required no such triggering event.

WASHINGTON (AP) As it nears a decision that could touch every American family, the Supreme Court is assessing grandparents' right to see their grandchildren even when the parents object.
After hearing arguments today, the justices must decide whether parents' constitutional right to raise children without government interference trumps a Washington state law that lets grandparents and others gain court-ordered visitation found to be in a child's best interest. The dispute carries the court into "a complex constitutional area in which the liberty interests of parents, children and grandparents often swirl in emotionally charged conflict," said David Hudson, a Nashville, Tenn., lawyer who has studied the Washington case. The nine justices six of them grandparents will take their initial vote in a closed-door meeting Friday. A final decision is expected by late June.

WASHINGTON, Oct. 29 (UPI) We all know that divorce can be a traumatic event for children, an experience that can cost them their sense of stability and security. Divorce can sometimes even destroy the relationship a child has with a non-custodial parent. News Vantage Just all the news you want, with all the depth you need. But while there is a great deal of public discussion devoted to the harmful effects of divorce on nuclear families, far less attention is paid to damage done to extended family relationships. For many grandparents, in particular, the modern phenomenon of high divorce rates presents serious challenges to sustaining strong relationships with grandchildren. In most cultures and religious traditions, grandparents have long played an important role in childrearing. But even in the United States, where multi-generational living arrangements are relatively uncommon, grandparents often take responsibility for baby-sitting and even raising grandchildren on their own. In many cases, grandparents provide an additional source of love and support that can make a huge difference for a child with busy working parents. It is no wonder then that from a developmental psychology perspective, multi-generational relationships are considered valuable and should generally be encouraged.

Grandparent Visitation

Missouri law encourages contact between grandparents and grandchildren, but also encourages families to resolve familial problems without a great amount of governmental intrusion. Therefore, Missouri law allows grandparents to obtain visitation of their grandchildren over the objections of a parent only in limited situations.
In Missouri, a grandparent can request visitation of a child in four situations:
  • If the parents of the child have filed for divorce;
  • If one parent of the child is deceased and the surviving parent denies the grandparent reasonable visitation rights;
  • If the grandparent has been unreasonably denied visitation with the child for more than 90 days; or
  • The child is adopted by a stepparent, another grandparent or other blood relative. home study guardian ad litem to help determine the best interests of the child. A guardian ad litem is a special person appointed by the court for particular litigation to represent an infant, ward, or unborn person.
