The U.S. Supreme Court's decision to affirm the right of a mother to prevent her daughters from seeing their grandparents may not be quite the victory for parental rights that observers first thought, a University of Illinois family law expert says. On the face of it, last month's closely watched decision (Troxel vs. Granville) was a defeat for grandparents seeking court-ordered visitation rights in cases where the parents have divorced or one of the parents has died. What was most striking about the split decision, said David D. Meyer, a UI law professor, was the narrow grounds on which the majority of justices based their ruling. "The court did not rule on the constitutionality of the Washington state law itself, holding only that the judge's application of the law in this case was unconstitutional. This seems to leave the door open for a better balancing between the rights of parents to raise their children without interference and the rights of other members of the family to continue a meaningful relationship with the children."

    Every state in the union is attempting to address this question, as reflected by the fact that all 50 have statutes that provide for grandparent visitation in some form. One such law, Washington's "nonparental visitation" law, was the center of a dispute between a mother and her children's paternal grandparents that made it all the way to the U.S. Supreme Court.
    Tommie Granville and Brad Troxel, though never married, had two daughters, Isabelle and Natalie. They separated in 1991. Brad went to live with his parents, regularly bringing his daughters to their home for weekend visits.
    Brad committed suicide in May 1993.

    Madeleine Bremner hasn't seen her two grandchildren in seven years, but she keeps a picture of them in the locket she wears around her neck. A court decision denied her the right to visit her grandchildren after her daughter died and her son-in-law remarried. Bremner refuses to discuss her case with the media in order to protect her grandchildren. Bremner is president of Ottawa's Canadian Grandparents Rights Association which supports grandparents who have lost access to their grandchildren after a divorce or death. "If we are prevented from seeing our grandchildren we have to apply to the courts like any third person, like a neighbour, to try and get access to our grandchildren," says Bremner. Federal and most provincial laws do not prevent divorcing parents from denying grandparents access without valid reasons. Because there is no law which supports the rights of grandparents to see their grandchildren, the courts are not obligated to consider the grandparent-grandchild relationship in child custody or access cases. The association is lobbying the federal and provincial government to pass a law that would protect grandparents from losing access to their grandchildren.

    Grandparent Visitation Rights
    Learn how a Supreme Court decision affects grandparents' rights to spend time with their grandkids. Grandparents, stepparents and other caretakers often form deep and loving attachments with the children in their lives. Yet when death, divorce or estrangement tears families apart, these caretakers may find themselves without any legal right to maintain contact with the children they love.
    State Child-Visitation Laws
    All 50 states currently have some type of "grandparent visitation" statute through which grandparents and sometimes others (foster parents and stepparents, for example) can ask a court to grant them the legal right to maintain their relationships with loved children. But state laws vary greatly when it comes to the crucial details, such as who can visit and under what circumstances. Approximately twenty states have "restrictive" visitation statutes, meaning that generally only grandparents can get a court order for visitation and only if the child's parents are divorcing or if one or both parents have died. Most states have more permissive visitation laws that allow courts to consider a visitation request even without the death of a parent or the dissolution of the family, so long as visitation would serve the best interests of the child. Some states allow other caretaking adults not just grandparents to make such a petition.

    Grandparents rights to visitation with children
    The United States Supreme Court has placed restrictions on laws establishing child visitation rights for grandparents. This article explores the reasoning behind the courts ruling.
    Many state legislatures have passed laws giving grandparents the right to take legal action to gain visitation with grandchildren. The idea behind such laws is to maintain the channels of communication between the grandparents and the children in the event of a divorce, death or other circumstances that break up families. In 2000, in the landmark case of Troxel v. Granville, the United States Supreme Court placed limits on the grandparent visitation laws. The Troxel ruling stemmed from a case in the state of Washington. A man and woman had two daughters together, but had never married. The man subsequently committed suicide, and the woman eventually married another man and started a new family. The dead mans parents wanted to continue to have contact with their sons children, and approached the mother about setting up visits. The mother agreed, and proposed a visitation schedule. The grandparents and other relatives of the dead man wanted more time with the children than the mother was offering, and filed suit under Washingtons grandparent visitation law. bodyOffer(16827) When the case went to court, the trial judge sided with the grandparents. Citing benefits to the children of a connection to "a large, central, loving family" with "opportunities for the children in the areas of cousins and music," the judge issued a far-reaching visitation order. The mother appealed the ruling to the Washington state appeals court, and that court sided with her.

    My son and girlfriend are going to have an abortion...What if any legal rights do I have to stop it? I told her to have it and not murder it and let me raise it.
    Thank You Susan In live in Albuquerque, NM Answer Dear Susan, Since you feel so passionately about this, do consider consulting with a real attorney in your area. I think that you're going to find, though, that from a legal standpoint, you won't be able to stop the abortion. I am pretty sure that even fathers have not been able to stop an abortion. However, unless you get professional advice regarding this, there will always be some doubt there for you. This really is not my area of expertise, as I know more about how things go after the children are born. My mind is telling me that time and again, the Supreme Court has ruled that this is a decision between the woman and her Dr. I hope that I am wrong! Good Luck to you.

    Introduction
    The purpose of this annotated bibliography is to help elderly laypersons find useful resources about their rights as grandparents. The site can offer guidance to grandparents in regards to what rights they have in various situations with their grandchildren. The world is changing - and no family member can tell you more about how the world is changing and has changed than grandparents. With the dawning of the 21st century, there is a greater realization that families come in every imaginable shape and size. For some children, grandparents play a major role in their upbringing - whether it is in the "traditional" grandparent role or whether it is in situations in which grandparents are raising their grandchildren. 1Grandparents are now, more than ever, finding that their defined roles within their grandchild's life are challenged - whether it is because of divorce of the child's parents, incarceration of the parents, death of one of the parents, or other unfortunate circumstances for the children. Grandparents can face many legal situations in regard to their grandchildren that take informed, intelligent decisions. In this regard, it is necessary that grandparents have the most accurate, reliable information in making their decisions.
