The scope of grandparental visitation in Texas is relatively narrow, with access strictly circumscribed to specific situations. Most importantly, a grandparent has no right to intervene into an intact nuclear family over the opposition of the biological mother and father. Family autonomy is supreme in that context. Physical custody is the actual physical possession and control of a minor child. Pennsylvania statutes further define physical custody based upon the amount of overnights each party spends with the minor child. A party may have primary physical custody, partial physical custody, shared physical custody, or visitation. Visitation is the right to spend time with a minor child, but not the right to remove the child from the custodial parent's control. Partial custody is the right to take possession of a minor child away from the custodial parent and may include the right to have overnight custody with the child. Shared physical custody (sometimes referred to as joint physical custody) is the term used to designate frequent and continuing contact between the child and his or her parents and is the term generally used when both parents have almost equal overnight periods of custody. Your first response should be to hire an experienced family law attorney to stand on your side. This type of legal battle is too complex to fight without professional assistance. Even though you and the grandchildren have done nothing wrong, you are caught between the arguing parents. You have rights, but you must take action to protect them. Under our laws, when parents divorce they can either agree how to handle the children or a Judge can impose who gets custody and visitation. Typically, one parent becomes the "managing conservator" to raise the children and the other parent becomes "possessory conservator" with certain visitation rights. The court can also allow the parents to be "joint managing conservators" who share the responsibility of raising the children. Since your daughter and her husband are arguing over the children, chances are they will not want to become joint managing conservators. If your daughter becomes only possessory conservator, then you might not see the kids as often as you'd like. A possessory conservator's time with the children is limited. She may not be given enough time to share.

A few years ago, the United States Supreme Court changed the law in many states regarding grandparent rights. The case dealt with a statute in Washington, our neighbor to the north. Because of the Supreme Court decision, Oregon law changed. Now, generally, grandparents have the right to see their grandchildren if they are denied access and if it can be demonstrated that the legal parents do not act in the child's best interests. The same rules that apply to grandparents apply to others who have developed close relationships with minor children. In the past year, I helped an unrelated family obtain custody of a young girl because one parent consented and the other parent was determined to not have sufficient skill to be an effective parent. I also helped a grandmother and grandfather obtain custody of their grandchild.

Grandparents often get to enjoy the pleasure of their grandchildren's company without the responsibility of raising or caring for the children full time. And for the grandchildren, their relationships with grandparents may be sources of stable, unconditional love. Divorce, death of a parent or adoption of grandchildren, however, frequently threatens these relationships and leaves grandparents with questions about their rights. When the legislature or the courts make decisions about the rights of grandparents, they seek a balance between two ideals. The first is the value attached to allowing parents to care for their children in the best way they can. The second is the value attached to doing what is in the best interests of the children. The wishes or best interests of grandparents are not among the most important factors considered in making these decisions. Here are some of the most commonly asked questions concerning the rights of grandparents. The answers are based in general on North Dakota law. In a decision that could touch every American family, the U.S Supreme Court on Monday curbed states' power to help grandparents visit their grandchildren when parents object. But the dispassionately worded ruling in one of the most emotionally charged cases in recent Supreme Court history stopped far short of answering all questions the state courts face daily in visitation battles over children. The court's 6-3 decision did not give parents absolute veto power over who gets to visit their children, disagreeing with part of a ruling by Washington's highest state court that appeared to do so.
