Fathers Rights?
In defense of family and other fundamental rights
July 25, 2003 by Roger F. Gay

In " Hounding Baskerville ," Tom Sylvester demonstrates the deepest divisions between activist social conservatism and core American political values. Activist social conservatives ignore boundaries between private and public issues as easily as they ignore the boundary between state and federal power. Like their far left counterparts, they abandon individual rights when embracing social causes. Nowhere are the divisions sharper or more critical than on issues that involve the basic social unit; family.
Mr. Sylvester's article is a response to "

about Fathers' Rights and Duties Pregnancy raises a number of important concerns for a woman, especially if her partner is absent or otherwise unwilling to participate in the parenting process. This document attempts to address a number of the most commonly asked legal questions about the father's responsibilities and rights.
Legal information adapted from "Father's Rights and Duties," by T. Glessner, NIFLA, 3(6), June 1996. Note: While this web page attempts to address some of the most common questions raised by single mothers, it is not intended as a substitute for legal advice from a competent attorney. Questions
Do I have to put the father's name on the birth certificate?
Mothers have the option of putting "Unknown" or "Refuse to State," in place of the father's name. However, leaving his name off the birth certificate will not prevent him from claiming his paternal rights. He may be able to have his name added to the birth certificate.
Do I have to tell the authorities who the father is, even if he's not on the birth certificate?
To receive public assistance - such as AFDC, food stamps, or Medi-Cal - you will most likely be required to provide the father's name as well as his last known address. The authorities may then attempt to force him to make child support payments to you. If you will not collect child support from him, then you will probably not be eligible for public assistance.

Fathers for Equal Rights
Fathers for Equal Rights, Inc. (FER) is a Chapter 501(c)3, non-profit organization with an elected Board of Directors, serving the cause of fathers' rights since 1973. We are a strong advocate for equal parenting responsibility and strengthening the father-child relationship. We assist our members in obtaining favorable resolutions to their pre-and post-divorce problems. The Dallas FER organization provides very specific hands-on services to fathers, grandparents, and others who have a current or future case in the Dallas or surrounding areas, or who have children in this geographic area. Holding weekly meetings that focus on experience sharing and self-education, we teach our members family law, how to research their own cases, where to find (and how to use) the forms they need to resolve their case, and how to keep an attorney "on point." Fathers for Equal Rights, Inc. is located in Dallas, Texas. Thanks to the Board of Directors of FER, membership in the NFRC, including access to members-only areas of this website, is free for visitors throughout the world. Membership in the Dallas FER organization requires an annual membership fee.

Is the Fathers' Rights Movement the Next Big Threat to Women's Equality? Two Reasons the Answer May Be Yes
The next serious threat to women's rights in the United States may come from the respectable-sounding movements to protect fathers' rights and promote marriage. NOW and other feminist groups are following closely the efforts of these advocates in the government, the courts and the culture. "Look below the surface of the growing pro-marriage and pro-fathers' rights sentiment in this country and you will see a very anti-woman, anti-equality message," says NOW Executive Vice President Kim Gandy. The following two stories illustrate some of these movements' new tactics for controlling women.
Marriage Movement Announces Itself
by Megan Peterson, Government Relations Intern "The marriage movement is giving women the message that a bad husband and father is better than none at all. Single moms are being demonized," says NOW Executive Vice President Kim Gandy. "NOW is committed to exposing and organizing against this deliberate return to the days of unchallenged male control." An outgrowth of the fatherhood movement and the conservative agenda, the current marriage movement has declared its cultural, social and political goals in a document titled "The Marriage Movement: A Statement of Principles." Released on June 29, 2000, at the Smart Marriages conference in Denver, Colo., the Statement pledges that "in this decade we will turn the tide on marriage and reduce divorce and unmarried childbearing, so that each year more children will grow up protected by their own two happily married parents and more adults' marriage dreams will come true."

MANIFESTO For Justice in Family Law
FATHERS 4 JUSTICE
is a new civil rights group campaigning for truth, justice and equality in Family Law for children, their parents and grandparents. Children growing up without fathers, mothers or grandparents is an obscenity and social catastrophe waiting to happen. We support a child's right to see both parents after separation and demand AN END TO THE SYSTEMATIC REMOVAL OF ONE PARENT (mostly fathers and their families) by the so-called Family Courts, for no good reason. Children need BOTH parents. We demand the AUTOMATIC RIGHT to enjoy a meaningful, loving relationship with our children and grandchildren, and support Parliament's intention in the 1989 Children Act that SHARED PARENTING become the normal form of order issued in the Family Courts. All parents should be assumed to be fit, loving, caring parents unless proven otherwise.

NEWSMAKINGNEWS.COM Family Court Corruption, Part 2: Fathers' Rights and Conciliation Court Law: Federally funded misogyny and pedophile protection by Cindy Ross © 2/19/03 Numerous reports have identified bias against women and corruption in family courts across the country. In bizarre and illegal rulings, family court judges ignore or deliberately suppress evidence of male perpetrated family violence and child molest. Fathers who are batterers and sex offenders are routinely granted visitation and custody, while mothers and children trying to escape abuse are punished through financial sanctions, loss of custody, supervised visitation, jail and institutionalization. [1]
Very occasionally, men reporting abuse of their children have also been targeted for retaliation through family court. [2] However, the systematic mishandling of domestic violence and child molest cases as "custody disputes" is based in a financial corruption scheme that calls for diverting grant program funding through "high conflict" cases, in the guise of promoting "fatherhood" and "shared parenting" post-divorce. [3]
Rather than assisting men become responsible parents, "Responsible Fatherhood", "Access to Visitation Enforcement" (supervised visitation for noncustodial parents), "Child Support Enforcement" and similar federal programs perpetuate abuse of women and children through the legal system. [4] Abusive men striving to maintain control over their victims are provided an array of benefits, not only to get custody and get out of paying child support, but to terrorize the mothers of their children and society in general. [5] Government programs are not producing responsible fathers, but motherless children, in order to advance the agenda of the so-called "fathers' rights" movement.

Printable version November 16, 2003 Fathers' Rights Showdown in CA Supreme Court Over two dozen feminist groups nationwide have joined together to help ensure that California custodial parents can move children hundreds or thousands of miles away from their noncustodial parents. Against them all stands one loving father and his tenacious attorney. Gary LaMusga has fought a seven-year battle to prevent his two boys, now aged 11 and 9, from being moved 2,400 miles away from him. Over the summer his ex-wife defied a court order and moved his children to Arizona (after originally seeking to move to Ohio), while Gary remains in Northern California, unable to leave his business and follow his children due to onerous child support obligations. Gary is fighting for his children against an ex-wife so petty and vindictive that, according to his son's teacher's court testimony, the alienating mother asked the school to keep track of the time Gary spent volunteering as an aid in his son's Kindergarten classroom so she could deduct it from his visitation time! The issue of move-aways is headed for a showdown in the California Supreme Court. Since the 1996 Burgess decision, California custodial parents, usually mothers, have generally been able to move children. In some cases, courts have even allowed children to be moved out of the country, as far away as New Zealand and Zaire. Last year the California Supreme Court voted 6-0 to revisit the move-away issue by hearing the LaMusga case
