NOTE: The information contained in this flyer is intended as an introduction to the basic elements of Islamic family law. It is not intended as a legal reference. It is designed to make clear the basic rights and restrictions resulting from marriages sanctioned by Islamic law between Muslim and non-Muslim partners. For Americans, the most troubling of these restrictions have been: the inability of wives to leave an Islamic country without permission of their husbands; the wives' inability to take their children from these countries without such permission; and the fact that fathers have ultimate custody of children. MARRIAGE In Islam, the act of marriage occurs with the conclusion of the marriage contract. The marriage contract itself is completed by an offer and acceptance, both of which must be made on the same occasion by two qualified parties. If a marriage has been contracted by competent persons in the presence of two witnesses and has been adequately publicized, it is complete and binding. It requires no religious or other rites and ceremonies because in Islamic law formalities have no value insofar as contracts are concerned. Such marriages are conducted only if both parties are willing.

Updated : Tuesday, 08 June, 2004 Media releases Home Top Previous Next Child Focus Lost in Family Law Act Reforms A report released today shows that changes to the Family Law Act in 1995, aimed at reducing disputes about children and encouraging both parents to share responsibility for children after separation, have not worked as intended. Instead, there has been an increase in the number of child related disputes and shared parenting has proved to be unworkable for parents who are unable to make their own amicable arrangements The research, funded by the Australian Research Council, was conducted jointly by the Faculty of Law at the University of Sydney, and the Family Court of Australia. The report, The Family Law Reform Act 1995: the First Three Years, was launched by the Dean of Law, Professor Jeremy Webber, and the Chief Justice of the Family Court, Alastair Nicholson. At the launch Chief Justice Nicholson said:

  • When are my children emancipated, so that I am no longer obligated to support them?
  • A parents liability for the support of his or her children is limited to children under the age of 21 years. In the absence of an express or implied contract, parents have no duty to support an adult child. For custody, visitation and other purposes, the age of majority is age 18, but for purposes of the parental support obligation the age of majority remains at 21. The mutual parental duty of child support is not absolute. It may be suspended or terminated before the child is 21 if the child becomes emancipated by becoming economically independent of his/her parents through employment, by marriage or entry into the military service. Under unusual circumstances, a child may be deemed emancipated if he/she is guilty of outrageous misbehavior, such as makes it inequitable to enforce the support obligation, or if without cause, he/she withdraws from parental control and supervision.
