After spending over eight years helping divorcing and divorced parents at DivorceNet.com , we wanted to provide a similar service to parents who challenge the paternity of their children. Here you can research both the law and science of paternity. Your situation is far from unique, out-of-wedlock births are now commonplace. In fact, paternity cases outnumber divorce filings in many courts. If the alleged father signs a voluntary acknowledgment of paternity, the courts don't have to decide parentage, but custody, visitation and child support often remain at issue. However, if legal paternity is at issue, i.e. the alleged father (and sometimes the mother) denies paternity, the parent who wishes to establish paternity must bring a paternity suit or action. Unlike more conventional legal cases, contested paternity actions are decided primarily on the scientific evidence of DNA testing. Therefore, if biological fatherhood is in question, your first step is to conduct a paternity test. If parents can't agree to the test, the court will order it. These genetic test results are often conclusive, although courts often allow contradicting evidence, such as proof that the alleged father had no physical access to the mother at the time of conception.

I like this book. Those practicing family law (even outside of Ontario) would be well advised to use Wilson on Children and the Law Mr. Wilson has enlisted the assistance of other leaders in their fields. Barbara Jackman, a leading national and international advocate in immigration law contributed chapter nine: "The Child as Immigrant". Andrew J. Freedman, a chartered accountant as well as a chartered business valuator who is well known to the Ontario family law bar for his many contributions to various publications, contributed the primary content for the income tax sections in chapter four. The technical organization is helpful to the researcher. In the same manner as the C.E.D., paragraphs are numbered. The Table of Contents is well organized and detailed as is the Index. There is a helpful Table of Statutes, linking statutory provisions cited to the specific paragraphs in the text.

The law is clear: Every child in this country who has a disability - no matter the nature of the disability - has the right to a public education at no cost to their families. Schools must try to meet the individual needs of each child with disabilities by providing special education and related services.
The federal law that gives children with disabilities from birth to age 21 the right to a free and appropriate education is called the Individuals with Disabilities Education Act (IDEA). Free means at no cost to the families. Appropriate means that the educational services must be individually designed to meet each child's unique needs.
The individually designed education plan that is written for a child with a disability is called an Individualized Education Plan (IEP). For children younger than age 3, the plan is called an Individualized Family Service Plan (IFSP).

Morocco Adopts Landmark Family Law Supporting Women’s Equality
Women’s Learning Partnership (WLP) and our partner organization l’Association Démocratique des Femmes du Maroc (ADFM) are pleased to report that on January 25, 2004, the government of Morocco adopted a new landmark Family Law supporting women’s equality and granting them new rights in marriage and divorce, among others. In April 2001, efforts to pass similar family law reforms were suspended while a Consultative Commission established by His Majesty King Mohammed VI studied the possibility of revising the Moudawana On February 3, 2004, the Presidents of both houses of Parliament presented the unanimously approved new Family Law to HM King Mohammed VI. The new legislation replaces the family law included in the Moudawana and includes the following reforms:
    Equality
  • Husband and wife share joint responsibility for the family;
  • The wife is no longer legally obliged to obey her husband;
  • The adult woman is entitled to self-guardianship, rather than that of a male family member, and may exercise it freely and independently;
  • The minimum age of marriage is 18 for both men and women.

Chronology: Establishing Paternity
When a child is born to a married couple, a legal presumption arises that the husband is the child's father. The same is not true with unmarried couples. Establishing paternity is important for unmarried couples in the event they break up and a parent seeks custody or child support, for inheritance purposes, and in a variety of other circumstances. If the parents get married after the mother becomes pregnant but before the birth, the husband's paternity is presumed in the same manner as if the parents were married at the time of conception. If the parents marry after the child is born, they can sign a legitimation form , which grants the same rights as if the parents were married at the time of birth. Even if parents never marry, paternity can be established voluntarily when the parents are certain of the father's identity. In such cases, they may sign a legal form called a voluntary acknowledgement of paternity, or something similar, and then file the form with the court or appropriate state agency. Executing this voluntary acknowledgement can be done right in the hospital following the child's birth, or any time thereafter. The father's name is then included on the child's birth certificate. Even if a voluntary acknowledgement is not signed, the parties may later enter into an agreement with the help and advice of their attorneys that establishes the father's identity and resolves custody and support issues.

The purpose of this family law unit is to provide my 6th-grade students with a better understanding of the laws that affect them as citizens and the limits on their rights as children. With this unit as a model, my class will study the legislative and judicial processes that affect all laws created to protect and safeguard children from harm. This unit will focus on four legal issues which I feel will be of high interest for my students: compulsory education, juvenile curfews, refusal by parents to authorize medical care, and protection of children from inadequate parents. These issues and pertinent cases will be read and studied extensively as the students prepare both mock trials and mock legislative debates. The timeframe for this unit will be six weeks. This unit effectively integrates social studies, state and local government, public speaking, creative writing, communications skills, as well as dramatic skills. This unit is recommended for grades five and up. Field trips to the state capitol, local courthouse, and even a state representative’s office are possibilities for this unit.
