Margaret Harrison There are various categories of legislative intervention in the parent-child relationship - protection of the neglected or abused child, determinations relating to custody, access or financial support following parental separation, consent to the sterilisation of intellectually disabled teenagers, or the 'dissolution' of the parental relationship on the application of a parent or child. Recurring concerns are the purpose, nature and process of such intervention, its perceived or anticipated outcomes for children and the 'rights' of parents where orders are made. Where the criminal law (a notoriously blunt instrument) is relied on, as it is when child abuse allegations are litigated, there is always a danger that the exposure to its procedures will amount to an additional abuse of the child. In this particularly sensitive area there is a widespread view that any belief in the ability of the legal system to cope with child abuse is founded on ignorance of the deep social and psychological roots of such abuse (Myers 1986-87). Nevertheless, as it is naive, unproductive and often dangerous to even consider eliminating legal processes from the area of child protection, ways must be found to make the legal system as 'child friendly' as possible, while maintaining its integrity and the protection of legitimate competing rights.

Global Programs Global Assembly Debates Radical Changes to Family Law Maputo, 29 Apr (AIM) - The Mozambican parliament, the Assembly of the Republic, on Tuesday began debating a bill that proposes sweeping changes in the country's family legislation, in favor of women's and children's rights. Family law is dealt with in the Civil Code, a document that dates from 1966, when Mozambique was still under Portuguese colonial rule, and regarded as a Portuguese "overseas province". It is thus full of anachronisms, recognizes the Catholic church but no other religion, and is deeply hostile to women.
Under the Civil Code, the head of the family is automatically a man, women are subject to the "marital power" of their husbands, women require their husband's consent before taking any paid job, and all the property of the household is administered by the husband.
Nobody has paid much attention to these rules for the past quarter of a century, since they openly violate the clause in the Mozambican constitution enshrining equality between the sexes.
Mozambican jurists sat down to write a new family law in the late 1970s - but this was one of many projects shelved as the war of destabilization worsened and the country plunged into economic crisis. Work on the Family Law resumed in the 1990s, and a draft was widely discussed in heated meetings around the country.

Childhood is a Special Time!
It is my prayer and hope that someday our society, social services and the court system may actually work and function to protect our most precious resource, the children. The child welfare system currently protects the accuser, the prosecutor, with immunities and protection from disclosure as well as confidentiality laws that are abused. The system also currently protects the social worker and court appointed expert/therapist/evaluator from their own negligence with immunities. The child welfare system and laws affecting children gives the judge discretion and immunity from negligent decisions based on convenience, for the court and not in the best interests of children. When the current child protection laws are "corrected," to not only protect children from actual abuse situations, but to also protect children from negligent and incompetent social workers, psychologists, judges, and prosecutors, as well as many of the court appointed attorneys involved then we will have effective and just child protection laws. Any law that can effectively protect children must also thoroughly acknowledge system abuse, incompetence, agency error and negligence in order to protect children. If the government cannot, or will not, protect children from its own negligence and incompetence, then many of these children will not be protected and when these situations happen while the government intervenes in these cases the government and its many taxpayer funded agencies then becomes responsible for promoting, if not allowing, child abuse. These children suffer the injustice and indifference promoted by those presumed to protect the best interests and the rights of children who also happen to profit from the current laws, procedures, and public policies.

  • My ex-spouse has custody and tries to dictate terms and activities for our children. Can she do this?
    No. Unless there is a Court order specifically stating this, it is interference with your visitation rights. Take her to Court.
  • My ex-spouse constantly schedules other activities for my children during my scheduled visitation time. What should I do?
    Petition the Court to hold your ex-spouse in contempt of Court. If your lawyer has already taken him/her to Court, then you can petition the Court for a change of custody. Constant denial of visitation may be a case for parental unfitness.
  • What if my ex-spouse completely withholds visitation?
    Immediately call the police. Get a police report. Do not engage in any form of verbal abuse. This could lead to your arrest. If you do not have an order of visitation, have your lawyer obtain a Court order. If you do have one, have your attorney seek Court enforcement and a charge of contempt. Don't wait too long to get Court action or the Court may think you don't care.

    Alliance for Non-Custodial Rights is a nonprofit corporation dedicated to protecting and promoting the civil and inalienable human rights of non-custodial parents and their families.     Children's Rights Clinic Family Violence Clinic Health Care Access Clinic Special Education Clinic ... Legal Policy Seminar Clinic Whittier Law School is committed to providing a wide variety of clinical education opportunities to its students. In addition to the clinics discussed below, the Law School offers an extensive externship program and numerous skills simulation courses and student activities.

    Under the supervision of the Director of Clinics and numerous clinical professors, students enrolled in a clinic participate in all aspects of client representation, including interviewing clients, negotiating with interested parties, conducting research and drafting court documents, and appearing on behalf of clients when permitted. The 2,000 square foot clinics facility includes numerous interview rooms, attorney offices, and student workspaces. With the assistance of volunteer attorneys from the Los Angeles and Orange County communities and clinical professors, students work on projects designed to meet the special legal needs of children and to increase the number of advocates available to serve this most vulnerable of client groups.
