Ethics Information for Special Government Employees: Emoluments Clause of the U. S. Constitution The Emoluments Clause of the United States Constitution applies to all U.S. Government employees, including Special Government Employees (SGE's). The Clause places constitutional limitations on a SGE advisory committee member's employment by a foreign government, including political subdivisions of a foreign government. This provision has particular relevance to positions with foreign universities that are government-operated rather than private institutions. United States Constitution, art. I 9, cl. 8. The Emoluments Clause applies at all times during an SGE's appointment Under the Foreign Gifts and Decorations Act, 5 U.S.C. 7342, Congress has authorized employees, including advisory committee members, to accept items from a foreign government that do not exceed minimal value (currently $285). The Act authorizes acceptance of items over minimal value when such items consist of an educational scholarship, medical treatment, or expenses for travel taking place entirely outside the United States, thus permitting hotel and meal reimbursements in the foreign country, but not airfare for flights originating or terminating in the United States. The statutory restriction on gifts over minimal value extends to the spouse and dependents of the employee.

Special Government Employees and Foreign Activities All U.S. Government employees, including those appointed as Special Government Employees (SGEs), are subject to legal restrictions concerning foreign activities. SGEs are Government employees who are appointed to temporary service on an advisory committee (i.e., NIH Institute/Center Advisory Council, Board of Scientific Counselors, or Program Advisory Committee) or, in some cases, as individual experts or consultants. Although SGEs may spend fewer than 10 days per year in an NIH position, many Government regulations apply to them, including the Emoluments Clause of the U.S. Constitution, which may limit acceptance of funds from foreign sources.
As an SGE, you are required to complete and submit the enclosed Foreign Activities Questionnaire, HHS 697 form. Some have found the questions and process confusing. Questions may arise concerning what is allowable and whether prior commitments made to foreign entities can be fulfilled while serving as an SGE for the NIH. This information sheet provides additional information, answers questions, clarifies the information required by the Foreign Activities Questionnaire, and provides names, phone numbers, and email addresses of people to contact for further clarification. We want to reassure you that we will work to resolve any problems, and usually you will be able to carry out all of your activities.

Panel: Government IT must consider privacy, ethics
By Grant Gross IDG News Service, 03/23/04 U.S. government agencies such as the Department of Homeland Security are being pitched many new technologies, but government technologists have an obligation to consider ethical and moral issues such as privacy when embracing new applications, concluded a panel of technology experts speaking at the FOSE government computing trade show. The Association for Federal Information Resources Management (AFFIRM), a nonprofit group focused at improving information management in the U.S. government, sponsored the Tuesday panel as a way to kick off a long-term discussion on the ethics of technology regarding privacy and other ethical issues, said Scott Hastings, president of AFFIRM and chief information officer in the DHS US-VISIT (U.S. Visitor and Immigrant Status Indicator Technology) immigration security program. AFFIRM plans to launch a Web site addressing technology and ethics within weeks and eventually issue a white paper on related topics, Hastings said.

Throughout its existence, Republic has exemplified the highest level of professional integrity and ethical standards. Since Republic's reputation rests on the conduct of its directors, officers and Associates, we expect the maintenance of the highest integrity and ethical standards in the conduct of all business and personal activities.
This Code provides general guidelines of ethical behavior for all directors, advisory directors, officers and Associates (collectively referred to as "Associates"). It sets out standards of conduct for you to follow in dealing with customers, suppliers, and other persons. It does not cover every possible situation involving an Associate's conduct and is not a substitute for the use of good judgement. Honest and ethical conduct, including the ethical handling of actual or apparent conflicts of interest, is required at all times. Avoidance of conflicts of interest is required, including disclosure to an appropriate person or persons of any material transaction or relationship that reasonably could be expected to give rise to such a conflict.
Full, fair, accurate, timely, and understandable disclosure in reports and document that we file with, or submit to the SEC and other public communications are required without exception. All directors, officers and Associates must comply with all applicable governmental laws, rules and regulations and any known violations of this Code should be reported to the appropriate person timely. The Board of Directors is the only body authorized to waive compliance with this Code as it relates to any executive officer or director of the Company. With respect to these individuals, the Board of Directors also has the authority to investigate (or supervise the investigation of) alleged violations of this Code and to determine the appropriate consequences for violations by such individuals, or to approve a waiver. Enforcement of the Code, including waivers or exceptions, as to others not specifically set forth above shall be the responsibility of the Audit Committee.

The goals of the State Ethics Commission as established in the State Ethics Law , State Government Article, Title 15, are as follows:

Ethics in State Government
A Guide for New York State Employees Introduction Every officer and employee in State service is bound by the provisions of the State ethics laws, which establish specific standards of conduct, restrict certain business and professional activities both while in State service and after leaving government and require financial disclosure of policymakers and other higher level officials. Violators face serious penalties. Although the underlying principles of the laws are fairly simple preventing conflicts of interest and encouraging ethical behavior the law's specific provisions can be quite technical. This brochure outlines what is expected of State officers and employees. It is intended only as a brief introductory guide, and should not be considered as a comprehensive legal document. History In 1987, New York State adopted the Ethics in Government Act, a sweeping reform of the State's laws intended to maintain the integrity of State government. The Act created the New York State Ethics Commission and gave it jurisdiction over officers and employees of the executive branch and entities with at least one member appointed by the Governor. Its five members are appointed by the Governor; one of the members is nominated by the State Attorney General and another by the State Comptroller.

Revolving Door Restrictions Leaving State Service The following general description of the "revolving door" statute, which applies to all State employees after they leave government service, is intended only as a guide, and should not be considered to be a comprehensive legal document. The questions that arise under this law can be complex and difficult. Employees, both before and after they leave State service, may call the State Ethics Commission at 518-432-8207 or 800-87-ETHICS. The Commission's assistance is confidential. The revolving door statute is designed to keep former State employees from using their former government connections to benefit themselves, their clients or the business for which they work after leaving State government. It does this (1) by restricting for two years the contacts they can have with the agency where they worked and (2) by restricting the work they can do on matters on which they worked while in State service. The first restriction is known as "the two year bar" and the second as "the lifetime bar." The Two-Year Bar The Public Officers Law prohibits all former State employees from "appearing or practicing" before their former agencies for two years after they leave their State jobs. The Commission has interpreted "appear" to include more than a physical appearance at an agency office. It means that former State employees may not write letters to the former agency, prepare or submit contract proposals to the agency, call agency staff on official business or review agency files. The bar on practicing means they may not represent a client before the agency. For example, they may not handle reviews or audits performed by the agency.
